I. RECITALS
l. Project Site
�\'HEREAS. the parcel. that is the subject matter of this Resolution. is represented in
Exhibit A; attached hereto and incorporated herein b�� this reference, and commonly kno�ti�n as
Eastlake III Lake Pointe Project Tentati��e Subdi��ision Map, Chula Vista Tract No. 10-02; and
for the purpose of general description is located on the north side of Olympic Park���ay; bet���een
Olti�mpic Vista Road and Wueste Road/Lake Crest Dri��e (Propem�); and
2. Project; Applications for Discretionar}� Approval
V1'HEREAS, on September 30; 2010: a duly verified application for a tentati��e
subdivision map (PCS-10-02) ���as filed �vith the Ciri� of Chula Vista Development Services
Department by Integral Communities (Applicant and/or Developer); for the subdi��ision oF a 12.2
acre site into fi��e lots consistina of 284 condominium units on a site located on the north side of
Ol��mpic Park���ay bet���een Ol}�mpic Vista Drive and Wueste Road (Project); and
«'HEREAS, subsequent to the previous Cit}� Council hearine on September 2�, 2012, the
project has been re��ised to reduce the number of condominium units to 221: and
3. En��ironmental Determination
l�'HEREAS. The Development Sen�ices Director has reviewed [he proposed project for
compliance with the Califomia Environmental Quality Act (CEQA) and has determined that the
project H�as covered previously in certified Final En��ironmental Impact Report. Eastlake III
Woods and Vistas Replanning Program Subsequent EIR #01-01 and subsequent Addendum
thereto dated September 2�, 2012; and

4. Planning Commission Record on Application
WHEREAS, on September 1 Z; 2012; the Director of Development Services set a hearing
before the Planning Commission for the consideration of and recommendation on the Tentative
Subdivision Map. Notice of said hearing, together with its purpose, was given by its publication
in a newspaper of general circulation in the City and its mailin� to property owners and residents
within 500 feet of the exterior boundaries of the Property, at least ten (10) days prior to the
hearing; and
WHEREAS, a hearing at the time and place as advertised, namely September 12, 2012, at
6:00 p.m. in the City Council Chambers, 276 Fourth Avenue, was held before the Planning
Commission and said hearing ��as thereafrer closed; and
WHEREAS, the Planning Commission, reviewed and considered the Tentative
Subdivision Map PCS-10-02; and
WHEREAS, the Planning Commission afrer considering all evidence and testimony
presented, recommended by a vote of 4-2-0-0 that the City of Chula Vista City Council approve
the Tentative Subdivision Map (PCS-10-02) for the subdivision of a 12.2 acre site into five lots,
including two hundred eighty-four (284) condominium units for individual ownership; and
5. City Council Record on Application
WHEREAS; a hearing time and place was set by the City Council of the City of Chula
Vista for consideration of the Project and notice of said hearing, together with its purpose, was
given by its publication in a newspaper of general circulation in the City and its mailing to
property owmers and residents within 1,000 feet of the exterior boundaries of the Property, at
least ten (10) days prior to the hearing; and
WI-IEREAS, the City Council of the City of Chula Vista held a duly noticed public
hearing to consider said Project at the time and place as advertised, namely September 25, 2012,
at 630 p.m. (time certain) in the Council Chambers, 276 Fourth Avenue. Said hearing N�as
thereafter closed; and
WHEREAS, the City Council of the City of Chula Vista did not take action on the
Tentative Map at its meeting of September 25, 2012, and subsequently the Project was revised to
reduce the number of condominium units to 221; and
WHEREAS, another public hearing was duly noticed to consider said Project at the time
and place as advertised, namely March 19, 20li, at 5:30 pm. (time ceRain) in the Council
Chambers, 276 Fourth Avenue. Said heari�g was thereafter closed.
NOW, THEREFORE, BE IT RESOLVED that the City Council does hereb}� find and
determine as follows:

II. TENTATIVE SUBDIVISION MAP FINDI\GS
A. Pursuant to Go��emment Code Section 66�73.� of the Subdi��ision A4ap Act. the Cin�
Council finds that the Tentati��e Subdi��ision Map, as conditioned herein, is in
conformance ��ith the elements of the Cin�`s General Plan. based on the following.
1. Land Use and Transportation
The proposed subdivision pro��ides for five lots, to be developed ���ith a mixed use
project that includes 221 condominium units. The site is designated Mixed Use
Residential (A4UR) in the General Plan and Miaed Use (MU-1) in the Eastlake [II
General De��elopment Plan (GDP) and Sectional Plannine Area (SPA) Plan. The
residential component of the project ���ill contain a densit}� of 19 du/ac, which is
consistent �rith the multi-famil�� high-densit�� residential densin (18-27 du/ac)
desienation.
All off-site public streets required to sen�e the subdi��ision alread�� ezist or �i�ill be
constructed or paid for by the Applicant in accordance ti�ith the Conditions of
Appro��al. The on-site public street is designed in accordance ���ith the City desien
standards and/or requirements and pro��ides for��ehicular and pedestrian connections.
2. Economic Development
The Project ���ill pro��ide new, high-quality, energy-efficient multi-family homes that
wil] enhance the imaee and appearance of the neiehborhood. and create jobs related
to construction of the homes that w�ill benefit the local economv. Appro��al of the
Project ���ill help achie��e the General Plan objectives that seek to promote a ��ariety of
job and housing opportunities to improve the Citv's job/housing balance, provide a
di��erse economic base. and encouraae the ero��th of small businesses.
3. Public Facilities and Services
The Project has been conditioned to ensure that all necessarv public facilities and
sen�ices �+�ill be a��ailable to serve the Project concurrent ���ith the demand for those
sen�ices. A Public Facilities Financing Plan has been prepared to suppiement that
which is already in place to define public sen�ice. facility and phasing needs created.
4. Housine
The residential component of the mixed-use Project is consistent ���ith the densitv
prescribed within the Residential Hieh land use desionation of the General Plan. and
provides additional opportuni[ies for multi-famil}� residential home o���nership in [he
southeastem portion of the City.

�. Grow�th Mana�ement
The surrounding street segments and intersections including Olympic Parkti�ay N�ill
continue to operate at the same Level of Service in compliance with the City's traffic
threshold standard with the proposed project traffic. No adverse impact to the City's
traffic threshold standards would occur as a result of the proposed project.
The Chula Vista Elementary School District has indicated capacity will be available
to house the students at either Camarena Llementary School (cunently under
construction) or Wolf Canyon Elementary School. The Project is also ��ithin the
attendance area of Eastlake Middle Scl�ool and Eastlake High School within the
Sweetwater Union High School District. The Applicant will be required to pay
applicable de��eloper school impact fees based upon assessable area.
The project site lies within the Ota�- Lakes Drainage Basin. Howe��er, runoff from the
site is diverted into the Salt Creek Basin to prevent impacts to the Lower Otay
Reservoir. Presently, runoff From the site is discharged into a 60-inch pipe and into
the City's storm water conveyance system in Olympic Parkway, which ultimately
discharges into Salt Creek. The project will be conditioned to provide for the
conveyance of storni water flows in accordance with City standards, policies and
requirements.
Sewer semice to the project site is provided by the City of Chula Vista. A private on-
site sewer collection system will convey wastewater flows to an existing City owned
8-inch and 12-inch diameter gravity main located north of Olympic Parkway. This
sewer collects flows oenerated within the Eastlake Vistas Tentative Map
neighborhoods located norih of Olympic Parkway and conveys the flows to an
existing 15-inch diameter sewer in Olympic Parkway. The Olympic Pazkway se��er
com�eys the flo��s westerly approximately 1,700 feet to a connection to the 18-inch
Salt Creek Interceptor.
The proposed project N�ould not induce significant population groH�th, as it is a small
mixed use residential project and would not impact existing or proposed recreational
facilities. The Project has been conditioned to pay park acquisition and de��elopment
fees prior to recordation of the Final Map.
6. Em�ironmental
The project proposes multi-fainily homes tl�at meet the minimum open space
requirement in accordance with the Chula Vista Municipal Code (CVMC). As
discussed above; the Applicant would also be required to pay in-lieu park fees
towards the acquisition and development of future parks. The development of the site
is consistent with the goals and policies of the �nvironmental Element.

7. Scenic Hiehwav
This Project Site is located adjacent to and visible from Olympic Pazk��a�� N�hich is a
designated scenic highwa��. A special building setback of 7� feet is required in order
to maintain a scenic buffer beh��een the road and the proposed development. The
applicant is requestine an allowable reduction in this setback based upon superior
desien proposed at the project entrance. Enhanced architecmral elevations have been
provided along the "end units" of the coum�ard buildings and the southem building
plane of the commercial buildine.
B. Pursuant to Government Code Section 66473.1 of the Subdi��ision Map Act, the
configuration, orientation, and topoeraph�� of the site alloH�s for the optimum sitin� of
lots for natural and passive heating and cooling opportunities and that the development of
' the site ti�ill be subject to site plan and architectural re��iew to ensure the makimum
utilization of natural and passive heatine and cooling opportunities.
C. Pursuant to Go��emment Code Section 664123 of the Subdivision Map Act, the Council
certifies that it has considered the effect of this appro��al on the housine needs of the
region and has balanced those needs against the public service needs of the residents of
the Citv and the available fiscal and en��ironmental resources.
D. The site is physicallv suited for residential development because it is generalh� le��el and
is located adjacent to e�isting residential developments. The Project conforms to all
standards established by the City for a residential development.
E. The conditions herein imposed on the erant of permit or other entitlement herein
contained is proportional both in nature and extent to the impact created by the proposed
de��elopment.
III. GOVERi\`MENT CODE SECTION 66020 NOTICE
Pursuant to Govemment Code Section 66020(d)(1): I�OTICE IS HEREBY GIVE\' that the 90
day period to protest the imposition of any impact fee, dedication, resen�ation_ or other exaction
described in this resolution begins on the effective date of this resolution and an}� such protest
must be in a manner that complies ���ith Section 66020(a) and failure to timelti� follo�i this
procedure will bar anv subsequent leeal action to attack; set aside, ��oid or annual imposition.
The right to protest the fees, dedications, reservations, or other e�actions does not appl�� to
plannina. zonine, erading, or other similar application processine fees or service fees in
connection w�ith the project; and it does not apply to anv fees, dedication. resenations, or other
e�actions H�hich have been Qiven notice similar to this, nor does it revive challenges to any fees
for �vhich the Statute of Limitations has pre�iousl�� expired.
BE IT FURTHER RESOLVED that the Cin� Council does hereby approve the Project
subject to the general and special conditions set forth belo��-.

IV. TENTATIVE MAP GENERAL CONDITIONS OF APPROVAL
A. Project Site is Improved with Project
The Applicant, or his/her successors in interest and assigns, shall improve the Project Site
as described in the Tentative Subdivision Map, Chula Vista Tract 10-02, Final
Em�ironmental Impact Report, Eastlake III Woods and Vistas Replannin� Prosram (EIR
01-01), and associated Mitigation Monitoring and Reporting Program.
B. Implement Mitigation Measures
Developer shall diligently implement, or cause the implementation of all mitigation
measures pertaining to the Project identified in Final Environmental Impact Report;
Eastlake llI Woods and Vistas Replanning Program (EIR 01-01) and associated
Mitigation Monitoring and Reporting Program.
C. Implement Public Facilities Financing Plan
Developer shall install pablic facilities in accordance with the Lake Pointe Project Public
Facilities Financing Plan, as required by the City �ngineer, to meet the threshold
standards adopted by the City of Chula Vista. The City Engineer may, at their discretion,
modify the sequence of improvement construction should conditions change to warrant
such a revision.
D. Design Consistency '
The Developer shall develop the lots in accordance with the Eastlake III Planned
Community District Regulations and Design Guidelines in accordance with approval of
the Design Revie�v Permit (DRC 10-19) by the City Council.
V. SPECIAL CONDITIONS OF APPROVAL
A. The conditions imposed on the Tentative Map approval, contained herein, are
proportional both to the nature and extent of the impact created by the proposed
development. Unless otherwise specified, all conditions and code requirements listed
below shall be fully completed by the Applicant, or successor-in-interest, to the
Development Services Director, or designee, satisfaction priar to approval of the Final
Map, unless otherN�ise specified:
Planning:
1. Applicant shall develop and maintain the Project Site in accordance with the approved
plans, which include site plans, floor plans, and elevation plans on file in the Planning
Division, the conditions contained herein, and Title 19 ofthe CVMC.

2. Prior to. or in conjunction �rith the issuance of the first building permit, the Applicant
shall pa�� all applicable fees. including am unpaid balances of permit processino fees for
deposit account DQ-1638.
3. Prior to appro��al of a Final Map or prior to appro��al of the first building permit,
���hichever occurs first, the Applicant shall provide Covenants. Conditions and
Restrictions (CC&R's) to the Planning Di��ision for re��ie��� and approval. Said CC&R's
shall state the folloH�ing:
a. All homeo�mers and residents hereby ackno�ti�ledge that garages shall provide
sufficient floor area available at all times to accommodate the required parking of
vehicles and that periodic inspections �vill take place by the Homeo���ners
Association to ensure compliance ���ith this requirement.
4. In accordance ���ith Section 19.09.060(J) of the CVMC, applicant shall pro��ide fundine to
the Cit� for periods �ahere e�penditures generated bv the Project exceed projected
re��enues.
�. Prior to issuance of the first building permit. the City Council shall approve and execute
�aith the De��eloper an "Agreement to Post Security for Affordable Housing Oblieation '
and the Developer shall post a performance bond for the benefit of the Cit�� in the amount
of the Affordable Housing Requirement in lieu fee, in accordance ��ith the referenced
asreement.
6. Prior to issuance of the first buildine permit, that Applicant shall demonstrate that
adequate storaee is pro��ided for each residential unit in accordance with CVMC section
1�.�6.020 (C).
Land Development Di�•ision:
7. All of the terms. covenants and conditions contained ���ithin the Amendment to the Citv
of Chula Subdi�ision Manual Section 5-301 for the inclusion of the Standard Conditions
of Appro��al for Tentati��e Maps shall be binding upon and insure to the benefit of the
heirs, successors. assigns and representati�es of the Developer as to anv or all of the
Propert}�.
8. Prior to the issuance of the first buildine permit, the Applicant shall pay all associated
de��elopment impact fees to the satisfaction of the Director of De��elopment Services or
desienee.
9. Prior to issuance of the first buildin� permit for residential units not requiring the filine of
a Final "B" Map. the Applicant shall pa� all applicable Parkland Acquisition and
De��elopment fees (PAD Fees) to the Cit}� in accordance ���ith CVMC Chapter 17.10 and
anv deferrals currentiv in effect.

]0. Prior to approval of Tentative or Final Map, the Applicant shall submit copies of all
Tentative Maps, Final n9aps, gradine and improvement plans in a digital format. The
drati�ing projection shall be in California State Plane Coordinate System (NAD 83, Zone
6). The digital file of the maps shal] combine all map sheets into a single CADD drawing,
in DXF, DWG or ArcView (GIS) format in accordance to Section 1-500 of the Ciry of
Chula Vista Subdivision Manual and Human Resources Department Policies and
Procedures Policy No. 917.
11. Prior to issuance of the first building permit for the Project, the Applicant shall remove
and replace any damaged improvements within the right of way to the satisfaction of the
City Engineer.
12. Prior to approval of the first building permit, the Applicant shall construct and secure the
traffic signal modification for Olympic Parkway and the entrances to the Project.
Improvements shall also include the installation of pedeslrian ramps to the satisfaction of
the City Engineer.
13. All proposed onsite sewer and stonn drain systems shall be private unless otherwise
directed by the Director of Public Works.
14. Prior to approval of the first Final Map for the Project, the Applicant shall obtain
approval from the De��elopment Services Director, and/or Director of Public Works, or
designee for the street names for the Project.
Fire Department:
15. The Building Permit plans shall demonstrate a fire 1]ow of 2,750 gallons per minute for a
2-hour duration (at 20psi).
16. Prior to issuance of the first Building Permit, the Applicant shall provide a water flow
letter from the applicable ��ater agency having jurisdiction indicating that standard fire
flow is a��ailable to serve the Project.
U. Prior to issuance of the first Building Permit, the Applicant shall install Fire Hydrants
located not greater than 300 feet apari for multi-family properties. The minimum fire
hydrant size shall be in accordance with the Chula Vista Fire Department requirements.
An additional fire hydrant shall be provided at the Project entrance or as otherwise
determined by the Fire Marshall.
18. The Applicant shall place fire lane markings (which signs shall be approved by the Fire
Marshall) within all access/driveways within the Project. No parking shall be allowed
within these areas.
19. Prior to occupaney, the Applicant shall install building addresses in accordance H�ith the
following criteria:

• 0-�0 feet from the buildine to the face of the curb. 6-inches in heieht ��ith a 2-
inch stroke. � �

inch stroke. � �
20. Prior to issuance of the first Building Permit, the Applicant shall comply N�ith the adopted
State of Califomia Building Code changes that �+ill require all ne�i� one and t�-o-family
homes and to�inhouses built in the State startine Januarv l. 2011. to be equipped ��•ith
life-sa��ine fire sprinkler s}�stems. �
21. Durine the buildine permit review, it �rill be determined by the Fire n4arshall if the
Project �vill need to be protected throughout b�� a fire alarm s}stem (automatic, manual,
fire flo«- monitorine). Prior to issuance of the first buildins permit, the fire alarm system
�vill be re��ieu�ed and appro��ed b�� the Fire n4arshall and installed.
B. The follo���ine on-eoine conditions shall apph� to the Project Site as lone as it relies on
this appro��al� � �
1. Applicant shall comply with all sections of the CVMC. and all other applicable City
Ordinances in effect at the time of buildine permit issuance.
2. All of the terms. covenants and conditions contained ���ithin the Amendment to the Cih�
of Chula Vista Subdivision Manual Section �-301 for the inclusion of the Standard
Conditions of Approval for Tentati��e Maps shall be binding upon and inure to the benefit
of the heirs, successors, assigns and representati��es of the De��eloper as to any or all of
the Propert��.
3. All proposed onsite seH�er and storm drain systems shall be pri��ate unless othernise
directed bv the Director of Public Vlorks.
�. The Propem� O���ner and Applicant shall and do aeree to indemnif��_ protect. defend and
hold harmless Cit��. its City Council A4embers, officers, emplo��ees and representati��es,
from and against any and all liabilities, losses, damages, demands; claims and costs,
including court costs and attornev's fees (collectivelv. liabilities) incurzed by the Cit��
arising. directiv or indirectiv, from (a) Cit��'s approval and issuance of this Tentative
Subdivision Map and (b) Cit}�`s approval or issuance of an}� other permit or action,
���hether discretionary or non-discretionan�, in connection ��'ith the Tentative Subdi��ision
Map contemplated on the Project Site. The Property O�vner and Applicant shall
ackno���ledee their agreement to this provision b}• e�ecutine a copy of this Tentative
Subdivision 1�4ap Resolution ���here indicated belo�v. The Propert}� OH�ner's and
Applicant's compliance �vith this pro��ision shall be bindine on an.� and all of the
Propem� O��mers and Applicant`s successors and assigns.

VI. EXECUTION AND RECORDATION OF RESOLUTION OF APPROVAL
The Property Ow�ner and Applicant shall execute this document signing on the lines
provided below, indicating that the Property Owner and Applicant have each read;
understood and agreed to the conditions contained herein, and will implement the same.
Upon execution, this document shall be recorded with the County Recorder of the Counry
of San Diego, at the sole expense of the Property Owner and/or Applicant. and a signed,
stamped copy returned to the Ciry Clerk's Office and the City's Development Services
Department. Pailure to return the signed and stamped copy of this recorded document
within 10 days of recordation shall indicate the Property OwnedApplicant's desire that the
Project, and the correspondin� application for building pern�its and/or a business license,
be held in abeyance without approval.

VII. CONFORMANCE WITH CITY SUBDIVISION MANUAL
BE IT FURTHER RESOLVED, that the City Council does hereby find that the Project is
in conformance with the City of Chula Vista Subdivision Manual, Section 18.12 and the
requirements of the Zoning Ordinance.
VIII. INVALiDITY; AUTOMATIC REVOCATION
BE IT FURTHER RESOLVED, that it is the intention of the City Council that its
adoption of this Resolution is dependent upon the enforceability of each and every term;
provision, and condition herein stated: and that in the event that any one or more terms,
provisions, or conditions are detem�ined by a Court of competent jurisdiction to be invalid,
illegal, or unenforceable, this Resolution and the permit shall be deemed to be automatically
revoked and of no further force and effect ab initio.
BE IT FURTI-IER RESOLVED that the Chula Vista City Council does hereby approve
Tentative Subdivision Map (PCS-10-02), subject to the conditions listed above for the
subdivision of a 12.2 acre site into five lots including two-hundred rii�enty one (221)
condominium units for individual ownership at the Project Site.
