Ji ~ ~ RESOLUTION N0. 3395 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND HENRY RIENSTRA FOR THE PURCHASE OF A PARK SITE AND APPROVING SPECIAL APPROPRIATION OF $27,014.00 FOR PURCHASE OF SAID PARK SITE AND THE FURTHER SUM OF $500.00 FOR NECESSARY COSTS AND AUTHORIZING THE EXECUTION OF DOCUMENTS The City Council of the City of Chula Vista does hereby resolve as follows: 1. That certain agreement between the City of Chula Vista and HENRY RIENSTRA for the purchase and sale of real property is hereby ap- proved and ratified and the Mayor is authorized to execute same on be- half of the City of Chula Vista. A true copy of the said agreement is .~, attached hereto and incorporated herein by this reference thereto as though here set forth in full. 2. The City Clerk is hereby authorized and directed to record the Warranty Deed to said property and same is authorized to be filed with the Office of the County Recorder of San Diego County for record- ing purposes 3. The Mayor is hereby authorized to execute escrow instructions to the Bank of America, Third and "E" Street Branch „ Chula Vista, Cali- fornia, and same shall be approved as to form and legality by the City Attorney. 4. The sum of $27,014.00 is hereby appropriated for the pur- chase of certain real property described in the agreement attached hereto for the purpose of a park site and the Finance Officer is directed to deposit said sum with the escrow holder designated therein. 5. The further sum of $500.00 is appropriated for necessary costs and the Finance Officer is directed to disburse said sums upon proper request. DATED: City Clerk Henry Rienstra AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND HENRY RIIBNSTRA FOR THE PURCHASE AND SALE OF REAL PROPERTY This agreement made this 19th day of May 1964, by and .between the CITY OF CHULA VISTA, hereinafter sometimes referred to as PURCHASER, and HENRY RT"ENSTRA, sometimes hereinafter referred to as VENDOR, and agree as follows: WITNESSETH as follows: 1. HENRY RiIENSTRA agrees to sell that certain real property described as: That portion of fractional Section_13, Township 18 South, Range 2 West, San Bernardino Meridian in the County of San Diego, State of California, as shown on the Recordof Survey No. 3307, filed in the office of San Diego County Recorder March 1, 1954, more particularly described as follows:' Beginning at the Northwest corner of said fractional Section 13; thence North 71°34'30" East along the Northerly line of said fractional Section 13,640.00 feet; thence at right angle to said Northerly line South 18°25'30" East, a distance of 88.00 feet; thence South 47°19'09" West, a distance of 199.00 feet; thence South 18°22'28" West, a distance of 373.87 feet; thence South 76°29'42" West, a distance of 382.00 feet to a point on the Westerlyline of said fractional Section 13; thence North 0°03'11" East, a distance of 460.00 feet to the Point of Beginning and consisting of 5.4028 acres of land. 2. THE CITY OF CHULA VISTA agrees topurchase real property described in paragraph~l hereof for a purchase price of $27,014.00. 3. The parties hereby agree to open an escrow at the "E" Street, Chula Vista Branch of the Bank of America. Said escrow holder shall be instructed to deliver the purchase price of $27,014.00 to the VENDOR when the said escrow holds for purchaser (1) A warranty deed conveying said property to the CITY OF CHULA VISTA (2) A policy of title insurance in the usual form insuring title in the CITY OF CHULA VISTA and showing no liens for any unpaid taxes. ~' ~il,iU~ ~~)~~~1 ~ f 3~~'S 4. Possession of said real property shall be delivered to PURCHASER not later than July 1, 1964, 5.
