RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING AGREEMENT~'tFOR
INSTALLATION OF SEWER IMPROVEMENTS
- The Council of the City of Chula Vista hereby resolves as ,
follows:
1. That certain agreement for the installation of sewer
improvements executed by ROBINHOOD HOMES, INC., CASEY CONSTRUCTION
CO., and ROBERT CASEY is hereby approved and the Mayor is authorized -

to execute same'.on behalf of the City of Chula Vista.
2. A true copy of said agreement is attached hereto and
incorporated herein by this reference thereto as though here set
forth in full.
ADOPTED AND APPROVED by the CITY COUNCIL of the
CZTY OF CHULA VISTA, CALIFORNIA; this ;28th. day of April ,

AGREEMENT FOR INSTALLATION
OF SEWER IMPROVEMENTS
It is hereby agreed by and between the CITY OF CHULA VISTA, a munici-
'~ pal corporation,and ROBINHOOD HOMES, INC., a California corporation, and
~. CASEY CONSTRUCTION CO., hereinafter referred to as SECOND PARTY, as follows:
.-. 1. The Second Party represents that it is the owner of certain
real property in the City of Chula Vista, County of San Diego,
That portion of Quarter Section 95 of Rancho de la Nacion
. according to Map thereof No. 166, San Diego County Records,
[hat is contained within a strip of land 20 feet in width,
being 10 feet in width on each side of the following de-
scribed centerline:
Beginning at a point on the centerline of Telegraph Canyon
' Road (vacated) said point being South 88°50'43" East a dis-
' ~ ~ tance of 145.44 feet and North 1°09'17" East adistance of
50 feet from the most westerly corner of Lot 332 of Robin-
~~ .~~ hood Unit No. 7 Subdivision according to Map thereof No.
-.~ ~ ~ 4964, San Diego County Records, Thence from said point of
_.. ~~~~-~~`~~~ beginning South 35°50'43" East a distance of 36.31 feet;
Thence South 88°50'43" East a distance of 207.30 feet;
Thence North 38°09'17" East a distance of 36.31 feet to
the centerline of said Telegraph Canyon Road (vacated).
The above described strip of land is to terminate at each

Road (vacated).
..~ 2. The Second Party agrees to undertake and complete the'installa-
tions of an eighteen-inch sanitary sewer, including connection to the line
known as Telegraph Canyon Road Trunk Sewer line, located upon the real
property referred to in paragraph 1, according to the plans and specifi-
cations therefor on file in the office of the City Engineer, Drawing Number
64-12L, to which said documents reference is hereby made and same are in-
corporated herein by this reference thereto as though here set forth in
full.
3. The Second Party further agrees to pay for all labor and ma-
ter ials in connection therewith within a period of sixty (60) days from
date hereof, and in full conformity with the ordinances of the City of
' ~ Chula Vista, the laws of the State of California, and the directions of
- proper off icia is ~of the City of Chula Vista as may be applicable thereto.

. The Second Party further agrees to indemnify, protect and hold
harmless the said~City of Chula Vista from any and all claims of liability
for personal injury, property damage, labor or material claims which may
be made against the said City by reason of said work and installation of
improvements as herein provided.
5._ As a guarantee and as security for its full and faithful per-

formance in complying with all the requirements for the completion of said
subdivision as aforesaid, the said Second Party shall deliver to the City
of Chula Vista, upon the execution of this agreement, a good 'and sufficient
bond executed by an authorized surety company satisfactory to the said City
of Ghula Vista in the sum of $7,645.00.
6. The Second Party further agrees to relocate and seal off an
existing sewer line presently existing near the said real property described
in paragraph lthe exact location of which is shown upon Improvement plan
for Telegraph Canyon Road Trunk Sewer on file with the City Engineer and
found in drawings No. 59 -42L and 59-43L, dated 5 May 1959.
7. As'part of the consideration for the execution of this Agreement
and the posting of the bond hereinabove referred to, the City of Chula Vista
agrees to vacate the existing Sewer Easement in which the line referred to
in paragraph 6 hereinabove is located.
