HomeMy WebLinkAboutReso 1964-3366Resolution No. 3366 mw:~ t, RESOLUTION NO. 3366 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA, RECITING THE FACT OF THE GENERAL. ELECTION HELD IN SAID CITY OF.CHULA VISTA ON THE 14th DAY OF APRIL, 1964, DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW WHEREAS, a regular general municipal election was held and conducted in the City .of Chula Vista, County of San Diego, State of California, on Tuesday, the 14th day of April, 1964, as required by law; and WHEREAS, notice of said election was duly and regularly given in .time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects said election was held and conducted and the votes cast thereat, received and canvassed and the re- turns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in gen- eral law cities; and WHEREAS, on the 21st day of April, 1964, at the hour of 7:00 P. M., the City Council duly assembled at its usual place of meeting and has canvassed the returns of said election and as a result of which, the City Council findsithat the number of votes cast and the names of the persons voted for, the office each person was voted for, and other matters required by law to be as stated hereinafter; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA, DOES RESOLVE AS FOLLOWS: Section 1. That there were 61 voting precincts established for the pur- pose of holding said election consisting of-consolidations of the regular election precincts in the City of Chula Vista and Chula Vista City School District as estab- lished for the holding of state and county elections. Section;~2. That said regular general,municipal'election was held for the purpose of electing the following officers of said City and .City School District as required by laws relating to general law cities in the State of California, to-wit: Three members of the City Council of said City for the full term of four years;.' ~ _, Three members of the Board of Education of the Chula Vista City School District for the full term of four years; One member of the Board of Education of the Chula Vista City School District for the short term of two years; Section. 3. That at said regular general municipal election, the following measures were submitted to the electors of said City, to-wit: Proposition A. Amend Article V of the Charter of the City of Chula Vista to be and to read as follows: ARTICLE V -'OFFICERS AND EMPLOYEES, Section 511 (a) The City Council shall not appoint to a salaried position under the City Government any person who is a relative by blood or marriage within the third degree of any one or more of the members of such City Council, provided that such prohibition shall not apply to persons who achieved permanent salaried status prior to the date upon which any such relative became elected or appointed to such City Council. (b) No department head or other officer having appointive power shall appoint to a salaried position under the City Government any person who is a relative of such appointing authority within the third degree by blood or marriage, pro- vided that such prohibition shall not apply to persons who achieved permanent salaried position prior to the effective date of such appointing authority assuming such position, and provided the Chief Administrative Officer approves in writing such appointment. Proposition B. Amend Article XII of the Charter of the City of Chula Vista to be and to read as follows: ARTICLE XII - BOARD OF EDUCATION, Section 1200 There shall be a board of education which shall consist of five members elected from the school district at large, at the times and in the manner in this Charter provided, and who shall serve a term of four years and until their successors are elected and qualified. Members of the board of education shall receive no compensation for their services as such, but each member shall be entitled to receive the sum of Twenty-Five Dollars ($25.00) per month which amount shall be deemed to be reimbursement of out=of-pocket expenditures and costs imposed upon such member for serving on the board of education. Such payments shall commence upon the filing with the City Clerk a true copy of a Resolution or Ordinance declaring that it is the desire of the Board of Education to receive such payments; unless such Resolution or Ordinance is adopted or passed by the board of education such payments shall not be made. Proposition C. Amend Article XII of the Charter of the City of Chula Vista to be and to read as follows: ARTICLE XII - BOARD OF EDUCATION, Section 1203 Generally.. A vacancy in ,the board of education from whatever cause arising shall be filled by appointment by the board of education within sixty (60) days after such vacancy occurs; the board's power to fill such vacancy by appointment shall cease upon the expiration of the said sixty (60) day period. Such appointee shall hold office until the next general mu- nicipal election and until his successor is elected and quali- fied. At the next general municipal election following any vacancy, a new member shall be elected to serve for the re- maining period of any unexpired term. Declaration of vacancy. If a member of the board of education absents himself from all regular meetings of the board for a period of sixty days, consecutively, unless by permission of the board expressed in its official minutes,-or is convicted of a crime involving moral turpitude, or ceases to be an elector of the school district, his office shall become vacant and shall be so declared by the board of education. ~ ~. •n - - - r.. ti ~ ~ , 1 ' i - ~ ~ - - ~ ~ ~ - , t Proposition D.• -Amend Article III of the Charter of the City of Chula Vista f to be and to read as follows: - ARTICLE III - CITY COUNCIL, Section 303 • ~ A vacancy in the. city council from whatever cause-arising,- - shall be filled by appointment by the city council, within' sixty (60) days after such vacancy occurs. The city council's power,to fill such vacancy shall cease upon the expiration of such sixty (60) day period. Such appointee shall hold office, until the first Tuesday following the next general municipal election and until his successor is qualified. At ..the next general municipal election following any vacancy, a councilman shall be elected-to serve for ,the remainder of any unexpired term. ; If a member of the city council absents himself.'from all regu- • lar meetings of the city council for a period of. sixty (60) ' - days consecutively from and after the last regular city.coun- ~ _ cil meeting attended by such member, unless by permission of ~ the city council expressed in its official minutes, or is con- , victed of a crime•involding moral turpitude, his office shall F become vacant.- .The city council shall declare the existence of any vacancy. In the event it shall..fail to fill a vacancy by appointment within thirty'(30) days after such office shall have been so ~l declared vacant, .it shall forthwith cause an election to be I" ,, held to fill such vacancy. Proposition E. Article XIII of the Charter of the City of Chula Vista-dealing with the City Court shall be deleted and repealed. , E Section 4. That the whole number of votes cast in 'said City (except absent ' •. voter ballots) was 8,0.79: That the whole number of absent voter ballots cast in said City was 53, making a total of 8,132 votes cast in said City. That the City Council does declare and determine that: Daniel A. McCorquodale was elected as Member of the City Council of said City for the full term of four years; Eleanor Anderson was elected as Member of the City Council of said City for the full term of four years; Cecil E. Sparling was elected as Member of the City Council of said. City for the full term of four years; Hazel Goes'Cook was elected a Member of the Board of Education for the Chula Vista City School District-for the full term of four years; Robert H. King was elected a Member of ,the Board of Education for the Chula Vista City School District for the full term. of four years; Ralph E. Schrock was elected a Member of the Board of Education for the Chula Vista City School;Di'strict,for the full term of four years; Jeanne L. Kelly was elected a Member of the Board of. Education for the Chula Vista City School District for, the short term of two years. That as a result of said election, a majority of the qualified voters voting on said propositions relating to Charter changes did vote in favor thereof, and that said .propositions carried, and shall be deemed adopted and rati- fied. Section 7. The City Clerk shall enter on the records of the City Council of said City, a statement•of the result of said election showing; (1) The whole number of votes cast in the City and City School District (2) The names of the persons voted for {3) The propositions voted upon (4) Fbr what off ice .each person was voted for (5) The number of votes given at each precinct to each person, and for and against each proposition (6) The number of votes given in the City and City School District to each person, and for and against each proposition. . Section 8. That the City Clerk shall immediately make and, upon compliance by the persons elected with the provisions of Section 4533 and Section 4536 of the Elections Code of the State of California, shall deliver to each of such persons so elected a certificate of election signed by him and duly authenticated; that he shall also administer to each person elected the oath of office prescribed in the Y State Constitution of the State of California; and shall have them subscribe there- to and file the same in his office. He, shall also require .from each of such respec- tive persons so elected, the required loyalty oath and file the same in his office. Whereupon, each and all of said persons so elected shall be inducted into the re- spective office to which they have been elected. Section 9. That the City Clerk shall certify to the passage and adoption of this resolution; shall enter the same ih the book of original Resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the Minutes of the meeting at which the same is passed and adopted. Passed, approved and adopted this 21st day of April, 1964.
