Chula Vista Pony League
LEASE FROM CITY OF CHULA VISTA TO
THE CHULA VISTA PONY LEAGUE
This lease was entered into on the date set forth at the end of
this agreement between the City of Chula Vista, lessor herein, herein-
after referred to as the City, and the Chula Vista Pony League, its
successors and assigns, lessee herein, hereinafter referred to as
the Pony .League,
WITNESSETH:
That the City does hereby lease to the Pony League the real
property described as follows:
That certain real property situated in the City of Chula Vista,
County of San Diego, State of California, and more particularly
described as follows:
Being a portion of Lots 14 and 15 in Quartersection 150, accord-
ing to the Record of Survey Map No, 850, filed in the office of the
CountyRecorder, County of San Diego, July23, 1940, and commencing
at the Northwest corner of Lot 16 according~to the above described
Map No, 850; thence Southerly along the Westerly-line of said Lot 16
and 15 (said line also being the Easterlyline of Fifth Avenue, formerly
First Avenue) a distance of 456,31 feet to the TRUE POINT OF BEGINNING:
thence .Easterly along a line being parallel to the Southerly line of
Lot 15 a~distance of 310,00 feet; thence Southerly along a line being
parallel to the Easterly line of Fifth Avenue a distance of 447.82 feet;
thence Westerly along a line being parallel to said Southerly line of
Lot 15 a distance of 155,00 feet; thence Northerly along a line being
parallel to the Easterly line of Fifth Avenue a distance of 30,00 feet;
thence Westerly along a line being parallel to said Southerly line of
Lot 15 a distance of 155,00 feet; thence Northerly along the Easterly
line of Fifth Avenue a distance of 417,82 feet to the TRUE POINT OF
BEGINNING.
The Pony League shall have and hold the said real property with
the appurtenances ±hereto, for a maximum term of five years, commencing
on the date of execution of this agreement; after the expiration of
three years of said five year term, this lease may be terminated by
either party giving 120 days written notice of termination to the
other party.
1, The Pony League covenants and agrees as follows:
(a) To pay to the City as rent for said real property
in advance of each gear of tenancy, the annual rental of
$1.00.
(b) To use said real property solely for the lawful
activities of a Pony League.
(c) To comply with all laws, ordinances and regulations
in the occupancy and use of the property,
(d) Not to let this lease nor sub-let. the wholeor any
part of the lease without the written permission of the City,
(e) To be responsible for and to promptly pay for ser¢ices
and utilities furnished to the property.
(f) To maintain the property, including any buildings
or structures which it places upon the property in good
condition.
(g) TO remove any building or structure which it may place
on said real property prior to the termination of this
~e lease, otherwise title to said buildings or structures
shall vest in the City at that time,
(h) Not to sell nor permit to be sold any alcoholic
beverages on said real property.
(i) To submit any plans for the construction of any
buildings, appurtenances or structures, including bleachers,
to the City for its approval prior to the construction,
(j) Not to construct any building or structure without
the prior approval of the City.

(k) To maintain rest room facilities which are adequate
for all contemplated uses to which said property is put.
(1) To maintain parking spaces adequate to meet any use
to which the property may be devoted,
(m) In the event that any concessions are maintained, to
charge no more than reasonable prices, for any item sold,
(n) To carry on no activities later than nine o'clock P.M.
(0) To be responsible for maintaining order among all
persons making use of said property.
(p) To maintain during the term of this lease, public
liability insurance for bodily injury in the amount of
$100,000 for one person, and in the amount of $300,000 for
bodily injfiry to two or more persons arising out of each
occurrence, and in the amount of $25,000 for property damage
arising out of each occurrence. Said policy of insurance
shall name the City as co-insured along with the Pony League,
and shall provide that the City shall be notified at least
15 days prior to its being cancelled.
(q) The City may re-enter the property and terminate the
lease if the Pony League is in default inthe performance
of any of the provisions of this lease,
(r) To indemnify and save the City harmless from and
against any loss, damage and liability occasioned by, grow-
ing out of, or arising from any default hereunder, or any
tortious or negligent act on the part of the~Pony League,
its agents or employees.
(s) To install such drainage facilities as the Engineer
of the City deems necessary or essential for adequate
drainage of said real property.
(t) To clean all litter, papers and other refuse from
said real property after each use of said property,

The Pony .League agrees that it will maintain no space devoted
to advertising on any of the fences excepting on the faces of said
fences facing the interior of said real property, No advertising
shall be permitted which is contrary to the spirit and purpose of
the Pony League,
The Pony League shall use any and all money received or collected
from any source or by any means in connection with the use of said
real property solely for the benefit of the Pony League,
The City shall be sent a complete financial report on all
receipts and expenditures from all of the activities of the Pony
League on or in connection with said real property by October 1st
of each year,
