RESOLUTION OF THE CITY COUNCIL OF THE CITY OI= CHULA
VISTA SUPPORTING AB 2228 (DAVIS) PETROLEUM:
COMPETITION
WHEREAS, in January, 1998, the County of San Diego adopted an ordinance which
prohibits refiner-operated retail service stations (also known as "divorcement"); and
WHEREAS, in response to the County of San Diego's actions, the Western Regional
Petroleum Association (WRPA) has filed a lawsuit which alleges, in part, that local ordinances
of this type are invalid because state law preempts local control over gasoline regulation; and
WHEREAS, working cooperatively with the County of San Diego, Assemblymember
Susan Davis has introduced AB 2228 which clarifies that no preemption exists in state law
which prohibits local agencies from enacting ordinances which regulate the distribution or sale
of motor vehicle fuels; and
WHEREAS, this bill will assist local agencies by negating the above-stated segment of
the WRPA lawsuit; and
WHEREAS, Assemblymember Davis stresses that AB 2228 is not an effort to regulate
the oil industry but, rather a clarification of current state law; and
WHEREAS, Assemblymember Davis is requesting letters of support for AB 2228 from
all the cities within the region; and
WHEREAS, because this issue is not covered in the City's adopted 1998 Legislative
Program, Council action is required in order for the City to take a position on the bill.
NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Chula Vista does
hereby support AB 2228 (Davis) Petroleum: competition.
