Signed resolutions must be submitted to SANDAG by June 7, 2013. Staff recommends obtaining Council approval prior to approval of the Fiscal Year 2013-14 Capita] Improvement Program in order to verify funding availability. ENVIRONMENTAL REVIEW The Director of Development Services has reviewed the proposed activity, consisting of approval to submit a funding request for various TransNet Projects to SANDAG, for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a "Project" as defined under Section 15378 of the State CEQA Guidelines. Therefore, pursuant to Section 15060 (c)(3) of the State CEQA Guidelines the activity is not subject to CEQA. Thus, no environmental review is necessary at this time. Although environmental review is not necessary at this time, once the scope of the individual projects proposed to be funded have been more specifically defined, environmental review will be required for each project and the appropriate environmental determination will be made. 16-1 5/07/13, Item1~ Page 2 of 7 RECOMMENDATION Council conduct the public heazing and adopt the resolution. BOARDS/COMMISSION RECOMMENDATION Not applicable. DISCUSSION TransNet History and Re¢ulations The voters of San Diego County approved the TransNet Program as Proposition A in November 1987. This proposition enacted ahalf--cent increase in the countywide sales tax through 2008 to fund specified transportation programs and projects. One third of the revenues generated by the tax were allocated by SANDAG to the local agencies for local streets and roads purposes. These funds have been distributed to cities annually and programmed by cities into local projects. In November 2004, 67 percent of County voters supported Proposition A, which extends TransNet from 2008 to 2048. The TransNet Extension Ordinance states that at least 70 percent of the funds allocated to local agencies for local road projects should be used to fund Congestion Relief (CR) projects. CR projects include the construction of new or expanded facilities, major rehabilitation and reconstruction of roadways, traffic signalization, transportation infrastructure to support smart growth, capital improvements for transit facilities, and operating support for local shuttle and circulator transit routes. No more than 30 percent of TransNet funds allocated to local agencies for local road projects are expected to be used for local street and road maintenance. Projects included under the Congestion Relief portion of TransNet aze required to accommodate travel by pedestrians and bicyclists in accordance with the TransNet Ordinance and Rule 20 of SANDAG Board Policy 31, "Accommodation of Bicyclists and Pedestrians". This rule states that "All new projects, or major reconstruction projects, funded by revenues provided under this Ordinance shall accommodate travel by pedestrians and bicyclists, except where pedestrians and bicyclists aze prohibited by law from using a given facility or where the cost of including bikeways and walkways would be excessively disproportionate to the need or probable use." Evaluating bicycle and pedestrian accommodation is required for all major reconstruction projects included under Congestion Relief under the 70-30 requirement. The decision not to provide for pedestrian and bicycle facilities in a construction or major reconstruction project must be made for good cause, such as severe topographic or biologic constraints, unreasonable cost, lack of sufficient right-of--way, or missing curb and gutter (for sidewalks). Cities may use a bicycle or pedestrian master plan adopted by the City Council and approved by SANDAG within the last five years to determine the appropriate means of accommodating bicyclists and pedestrians in a given project. Since Chula Vista's Bikeway Master Plan Update was adopted by the City Council on February 1, 2011, and the Pedestrian Master Plan was adopted on June 22, 2010, they qualify under this provision. According to the report, "TransNet Revenue vs. Programmed by Agency", the City has a total balance of $395,000 that has not been programmed in Fiscal Year 2012-13. This is primarily due to additional unexpected TransNet revenue. This amount will be carried forwazd into Fiscal Yeaz 2013-14. The City's FY2012 TransNet audit indicated that the City has $130,038 in 16-2 5/07/13, Item /~ Page 3 of 7 unallocated Old TransNet cash available, which needs to be reprogrammed. Additionally, $1,142,954 will be reprogrammed from other projects. Thus, total available TransNet funds for Fiscal Year 2013-14 will be $7,010,992, including the new TransNet allocation for Fiscal Yeaz 2013-14. Changes are proposed for the following projects: Congestion Relief (CR) Projects CHV-NEW: Otav Lakes Road (STM355) This is an existing CIP project for the widening of Otay Lakes Road between Telegraph Canyon Road and Ridgeback Road to six-lane major standards. This project is being constructed in several phases. Previous funding has been provided from the Transportation Development Impact Fee (TDIF). An additional $200,000 is needed to complete the project. CHV08• Willow Street Bridge Project (STL-261) The total funding amount will not be changed for this project. However, after discussion with Caltrans staff, the following reallocation will be done in order to reflect project schedules: • $300,000 of the right-of--way money will remain in FY2012. The remaining $1,050,800 ofright-of--way money will be moved to FY2014. • Engineering funding in FY2012 will be moved to FY2013 The current Caltrans project schedule is provided as Attachment 1. CHV29• L Street Improvements Monserate to Nacion (STL-328) This project is complete. The remaining $188,348 will be reprogrammed into other CR projects. CHV37: Palomar Gateway (STL-280) This project is complete. The remaining $605 will be programmed into other CR projects. CHV44• I-805 SR54 and Otay Mesa Transportation System (TF359) The following changes are needed for this project: • TF344: I-805 Direct Access Ramp East H Street and East Palomar Street: $75,000 will be deleted from this project • TF359: SR-54 Corridor and Arterial Operations: $75,000 from TF344 will be added • TF356: Otay Mesa Transportation System: $40,000 will be added from Fiscal Year 2013-14 revenues CHV48• Pavement Major Rehabilitation (STM-379 NEW) Two projects classified under CHV48 have been completed: STL345 and STL354. The remaining money in these projects totals $359,985. These funds will be reprogrammed into the upcoming FY2013-14 program for major pavement rehabilitation. The total amount requested for the Major Pavement Rehabilitation Program in Fiscal Yeaz 2013- 14 is $3,100,000. As discussed at the February 2013 Pavement Rehabilitation Workshop, the CHV48 list will be used for an overlay contract. This list currently includes both collector and 16-3 5/07/13, Item1(z Page 4 of 7 locaUresidential streets. Priority will be given to both collectors and those local/residential streets that can be saved from needing reconstruction in a few yeazs. The current list for CHV48 is provided as Attachment 2. All streets on the list were checked for compliance with SANDAG Policy No. 31 on pedestrian and bicycle accommodation. Streets that aze in compliance with this policy aze labeled with a "C", while streets that are not in compliance are labeled with "NC". Two locations need to be checked for Americans with Disabilities Act (ADA) compliance at the bus stops. None of the streets on this list labeled "C" require pedestrian bicycle exclusions. All other streets will be investigated regarding the possibility of compliance with this policy prior to inclusion in a CIP project, and requests for exclusions will be submitted at a later date if necessary. Alternatively, the overlay of the 16 non- compliant streets may be funded by a different funding source, such as Proposition 42 (Gas Tax). CHV51: Cross-Gutter Realacement (STL-3591 This CIP project is for the reconstruction ofcross-gutters that present an obstruction to traffic due to steep slopes. $25,000 will be added to this project for Fiscal Yeaz 2013-14. The locations will not be changed. CHV54: South Broadwav Improvements (STM367) This project includes the construction of curb, gutter, sidewalk and bike lanes on Broadway south of Main Street. Existing TransNet funding in this project is $500,000. An additional $550,000 will be added in order to provide funding for construction. Note that the CIP only shows $300,000 currently allocated to this project, so the CIP funding for Fiscal Yeaz 2013-14 will show an additional $750,000. CHV55: Castle Park Sidewalk Improvements This project includes funding for a number of street improvement projects. Currently $3,285 remains in the fund. One of the projects, Glenhaven Way to Amy Street (STL304), has been completed. The $556 associated with STL304 will be reallocated to other Congestion Relief (CR) projects. CHV58: New Sidewalk Construction There are several projects associated with this number. The following changes are proposed: STL368: Oxford Street Sidewalk Installation -add $50,000 STL394: Moss Street Improvements -add $50,000 STL379: Alpine Avenue Improvements -reduce by $200,000 Therefore, a total of $100,000 will be reallocated to other Congestion Relief (CR) projects CHV60: Traffic Signal Uperades This project includes traffic signal upgrades and modifications at several locations. Additional funds are requested for the following projects. All of these locations aze included in the current project description. • TF382: Traffic Signal Modifications at Third Ave./Naples St. and Third Ave./I Street: add $50,000 16-4 5/07/13, ltem~ Page 5 of 7 • TF383: Traffic Signal Installation at Industrial Blvd./Moss Street and Industrial Blvd./Naples Street: add $250,000 • TF319: Signal Modification Anita and Industrial: add $200,000 • TF378: Traffic Signal Modifications at Second and E Street: reduce by $49,000 • TF316: Signal Installation Second and Quintazd: reduce by $40,000 The funding in this project will therefore be increased by a net $411,000. CHV62: Chula Vista Nature Center Road Repaving Project There is no change in the overall level of funding for this project. However, the project description will be changed to delete the size (3-inch) of the water line. Also, the breakdown of costs will be changed to reflect documents submitted to Caltrans ($85,000 in Env/Eng., $415,000 in Construction). Maintenance Projects CHV06: Minor Pavement Rehabilitation Two projects aze being closed under this category: • STL340: Pavement Rehabilitation 06/07: reallocate $148,338 • STL335: Pavement Rehabilitation 07/08: reallocate $46,134 We also need $150,000 in additional funding for OP219: Pavement Management System. This means that we will return $44,472 for use in other projects. Since this is old TransNet money, it can be used for either Congestion Relief or Maintenance projects. CHV22: Advance Plannin¢ Studies A total of $75,372 in TransNet funding is requested for this project. It is proposed that $53,000 of new TransNet funds and $22,372 of unrestricted old TransNet Cash be used. CHV33• School Zone Traffic Calming (TF3451(STM-380 NEW) Additional funding is being requested for the following projects: • TF345: Traffic Calming Program: $70,000 • STM-380: Sidewalk Replacement on East H Street: $100,000 CHV34• Neighborhood Traffic/ Pedestrian Safety Program (TF327) An additional $220,000 is being requested for this program. CHV35: Traffic Signing, Studies and Signal Upgrade This includes a number of traffic-related projects. The following funding changes are being requested: • TF330: Traffic Signal Modifications at Fourth/Main and FourthBeyer: return $33,145 • TF331: Traffic Signal Modifications at Third/Montgomery: return $1,843 • TF366: Traffic Signal and Streetlights Systems Upgrade: add $209,500 • TF332: Signing and Striping Program: add $50,000 • STM369: Bikeway Facilities Gap Project: add $50,000 • TF-385: Signing and Striping Program for Elementary Schools: add $370,000 16-5 5/07/13, Item Page 6 of 7 This results in the need for additional funding of $644,512. CHV43: Congestion Relief Study and Implementation (TF354) This program allows for the identification and implementation of solutions for congestion relief on local streets. An additional $75,000 is being requested for this program in Fiscal Yeaz 13/14. CHV45: Traffic Monitoring Program Funding will be included for the following projects in Fiscal Yeaz 2013-14: • TF274: Traffic Count Station Program: $65,000 • TF321: Citywide Traffic Count Program: $50,000 CHV50: Emergency Storm Drain Reaair Program (DR180. DR193) (DR196 NEWT This project includes the repair/replacement of storm drains that carry street drainage and need to be repaired in order to maintain safe driving conditions. Previous allocations to this program have included $2,200,000 in TransNet funds. The following locations will be added, along with an additional $710,000. As many locations will be completed as possible based on the current level of funding. • Brandywine Ave. neaz Sequoia Street • Fourth Avenue at Roosevelt Street • Mankato Street at Fourth Avenue • Flower Street at Woodlawn Avenue • Orange Avenue at Third Avenue • Minot Street at Las Flores Drive • Inkopah Street at Melrose Avenue • Fourth Avenue at Moss Street • Maple Drive at Spruce Road • Press Lane at Trousdale Drive • J Street at Garrett Avenue • Industrial Blvd. at the I-5 Freeway The location on Brandywine Ave. involved repairing a sinkhole spanning several lanes that occurred on April 11, 2013. Since this presented an immediate safety issue, it was repaired as soon as possible. There were sufficient funds in the Fiscal Year 2012-13 allocation to take caze of this emergency. CHV71: Main Street Streetscape Master Plan This project was added to the RTIP after the City obtained an Active Transportation Grant for $299,981. This project will result in a plan for Main Street between I-5 and I-805 based on "complete street" principles. A match of $51,120 from TransNet funds is required. Although the grant funds and TransNet allocation have already been accepted by Council, this project needs to be included in the RTIP amendment in order to allocate the TransNet funds in Fiscal Year 2013-14. A summary of TransNet allocations is shown on Attachment 3, "TransNet Allocation - FY 2013 through FY2017." Allocations from FY2015 through FY2017 are approximate and aze not part 16-6 5/07/13, Item /Cv Page 7 of 7 of this Counci] action. Attachment 4, "TransNet Reprogrammed Funds", shows funds from closed CIP projects that will be used in this yeaz's program. Projects designated as "Old" are from Fiscal Yeaz 2008 or before and these funds can be used for either Maintenance or Congestion Relief projects. DECISION MAKER CONFLICT For CHV06, CHV48 and CHV50: Pursuant to California Code of Regulations Section 18704.2 (b)(2), there is no material effect on any economic interests in real property as the "decision solely concerns repairs, replacement, or maintenance of existing streets, water, sewer, storm drainage or similar facilities." For other projects: Staff has reviewed the property holdings of the City Council on the site specific portions of this action and has found no property holdings within 500 feet of the boundaries of the properties which aze the subject of this action. Staff is not independently awaze, nor has staff been informed by any City Councilmember, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter. CURRENT YEAR FISCAL IMPACT These actions will have no direct impact on the General Fund. Changes that result in a firnd allocation for Fiscal Year 2013-14 will be approved as part of the Fiscal Year 2013-14 Capital Improvement Program. ONGOING FISCAL IMPACT None. Amendment is needed fox the projects shown in Exhibit B; and WHEREAS, in order to receive additional Highway Bridge Program funds, the City must revise its bridge projects in the RTIP to agree with Caltrans programming. This includes the Willow Street Bridge (CHV08), where $1,921,470 in funding. will be moved from Fiscal Year 2011-12 and 2012-13 to Fiscal Years 2012-13 and 2013-14; and WHEREAS, the City Of Chula Vista has held a noticed public meeting on May 7, 2013, with an agenda item that clearly identified the proposed list of projects prior to approval of the projects by its authorized legislative body in accordance with Section 5(A) of the TransNet Extension Ordinance and Rule 7 of SANDAG Board Policy No. 31; and NOW THEREFORE, BE IT RESOLVED that pursuant to Section 2(C)(1) of the TransNet Extension Ordinance, the City Of Chula Vista certifies that no more than 30 percent of its annual revenues shall be spent on maintenance-related projects. 16-17 Resolution No. Page 2 BE IT FURTHER RESOLVED that pursuant to Section 4(E)(3) of the TransNet Extension Ordinance, the City of Chula Vista certifies that all new projects, or major reconstruction projects, funded by TransNet revenues shall accommodate travel by pedestrians and bicyclists, and that any exception to this requirement permitted under the Ordinance and proposed shall be clearly noticed as part of the City of Chula Vista's public heazing process. BE IT FURTHER RESOLVED that the pedestrian exclusion on the south side of D Street between Third and Fourth Avenues be approved because of the excessive cost of constructing the sidewalk due to the necessity of constructing a retaining wall. This exception has been noticed as part of the public hearing process. BE IT FURTHER RESOLVED that pursuant to Section 8 of the TransNet Extension Ordinance, the City of Chula Vista certifies that the required minimum annual level of local discretionazy funds to be expended for street and road purposes will be met throughout the 5- year period consistent with the most recent Maintenance of Effort Requirements adopted by SANDAG. BE IT FURTHER RESOLVED that pursuant to Section 9A of the TransNet Extension Ordinance, the City of Chula Vista certifies that it will collect $2,165, plus all applicable annual increases, from the private sector for each newly constructed residential housing unit in that jurisdiction to comply with the provisions of the Regional Transportation Congestion Improvement Program (RTCIP). BE IT FURTHER RESOLVED that pursuant to Section 13 of the TransNet Extension Ordinance, the City of Chula Vista certifies that it has established a separate Transportation Improvement Account for TransNet revenues with interest earned expended only for those purposes for which the funds were allocated. BE IT FURTHER RESOLVED that pursuant to Section 18 of the TransNet Extension Ordinance, the City of Chula Vista certifies that each project of $250,000 or more will be clearly designated during construction with TransNet project funding identification signs. BE IT FURTHER RESOLVED that the City of Chula Vista does hereby certify that all other applicable provisions of the TransNet Extension Ordinance and SANDAG Board Policy No. 31 have been met. BE IT FURTHER RESOLVED that the City of Chula Vista agrees to indemnify, hold harmless, and defend SANDAG, the San Diego County Regional Transportation Commission, and all officers and employees thereof against all causes of action or claims related to City of Chula Vista's TransNet funded projects. BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista adopts the amendments to the TransNet Local Street Improvement Program of Projects for Fiscal Years 2012/2013 through 2016/2017 for inclusion in the RTIP.
