PR318)" PROJECT AND DIRECTING STAFF TO RE-BID THE PROJECT _ SUBMITTED BY: DIRECTOR OF PUBLIC WORKS ,rl/f~d~'q_ ASSISTANT DIRECTOR OF ENGINEERING ~ ~,P.(~/ REVIEWED BY: CITY MANAGER ASSISTANT CITY MANAGER 4/STHS VOTE: YES ^ NO SUMMARY On April 24, 2013, the Director of Public Works received fourteen (14) sealed bids for the "Chula Vista and Golf Course Pedestrian Trail and Bridge Improvements in the City of Chula Vista, CA (CIP No. PR318)" project. One of the requirements of the bid request was that bidders list the name of the bridge prefabricator that would supply the bridge for the project. Of the fourteen bids received, only the sixth- and eighth-ranked bidders listed the bridge prefabricator in their bid packages. Therefore, staff determined that this requirement was uncleaz to bidders and hereby recommends, in the best interests of the public, that all bids received be rejected and that the project be re-bid with improved instructions to bidders. ENVIRONMENTAL REVIEW The Development Services Director has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the proposed action of rejecting all bids received for a trail and bridge improvement project is not a "Project" as defined under Section 15378 of the State CEQA Guidelines because said action consists of administrative activities of government that will not result in direct or indirect physical changes to the environment. Therefore, pursuant to Section 15060(c) (3) of the State CEQA Guidelines the rejection of all consultant bids is not subject to CEQA. Thus, no environmental review is required at this time. 14-1 5/07/13, Item ~~{- Page 2 of 3 RECOMMENDATION Council adopt the resolution. BOARDS/COMMISSION RECOMMENDATION Not applicable. DISCUSSION On April 24, 2013, the Director of Public Works received fourteen (14) sealed bids from the following contractors: Bidder Valley Coast Construction, Inc. Just Construction Alvand Construction, Inc. Blue Pacific Engineering & Construction Portillo Concrete Hazard Construction Ted Enterprises, Inc. Fordyce Construction Piperin Corporation HTA Engineering & Construction, Inc. Streamline Engineering Jaycor Construction PAL General Engineering, Inc. The Richards Group Listed Bride Fabricator? No No No No No Yes No Yes No No No No No No Only the sixth- and eighth-ranked bidders listed the bridge prefabricator that would supply the bridge for the project, as was required in the bid request. However, staff determined that this bid requirement was not clearly identified, having been placed in an appendix rather than within the main body of the bid request. The lack of clarity in the bid request is further supported by the fact that only two bids out of fourteen (approx. 14%) received (those bids received from the sixth- and eighth-ranked bidders) listed the bridge prefabricator in their bid packages. In light of the placement of the requirement for the bid submittals and the supporting statistical evidence that the requirement was unclear, staff recommends that all bids received be rejected in the best interests of the public and that the project be re-bid with improved instructions to bidders. DECISION MAKER CONFLICT Staff has reviewed the property holdings of the City Council and has found no property holdings within 500 feet of the boundaries of the property which is the subject of this action. Staff is not independently aware, nor has staff been informed by any City Council member, of airy other fact that may constitute a basis for a decision maker conflict of interest in this matter. 14-2 5/07/13, Item1 Page 3 of 3 CURRENT YEAR FISCAL IMPACT The construction cost for the bridge and trail improvements is paid through a $185,000 County of San Diego Neighborhood Reinvestment Program Grant received through Supervisor Cox's office. All City staff costs for this project are funded from the General Fund (approximately $7,800 to date) and represent the City's grant match. The City will incur approximately $2,500 in additional General Fund costs as a result of the proposed action to reject all bids and to re-bid the project.
