The Department is currently experiencing issues attracting qualified entry-level and experienced peace officers to fill these vacancies. Because of the urgency to fill these 15 vacancies, the Department has proposed offering a monetary incentive to qualified lateral-hire candidates to increase the number qualified peace officer applicants. ENVIRONMENTAL REVIEW This proposed activity has been reviewed for compliance with the California Environmental Quality Act (CEQA) and it has been determined that the activity is not a `Troject" as defined under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is necessary. RECOMMENDATION Council adopt the resolution. BOARDS/COMMISSION RECOMMENDATION Not Applicable. 8-1 05/07/2013 Item~_ Page 2 of4 DISCUSSION Over the last year, the Police Department has been actively recruiting entry-level and experienced (lateral) peace officers. During this time, it has been exceedingly difficult to attract qualified candidates. With 15 current vacancies, and with a high number of retirements expected within the next nine months, the Department has concentrated on hiring lateral peace officers as they already have completed a POST training academy, and can be ready for full- dutywithin afew months (rather than a year and a half for an entry level officer). Police agencies in the County are in competition for qualified candidates at the entry and lateral-officer levels. The City of San Diego and the County of San Diego are hiring at least 50 officers each per year, and most of the other cities in the County of San Diego are also actively recruiting peace officers. In an effort to lure qualified lateral peace officers, the Department is proposing a "blew Hire Lateral Incentive Pay". This incentive would compensate qualified lateral officers up to $1,000 a year, for each year of experience they have as California peace officers. The County of San Diego Sheriff s Office is also offering a similaz incentive. New Hire Lateral Incentive Pay -Details New hires who come into the Chula Vista Police Department from another public law enforcement agency on or after April 10, 2013 with external law enforcement experience, will receive lateral incentive pay of $1000 for each full year of external experience brought to the City for up to five (5) years of experience or a maximum of $5,000. The external law enforcement experience shall consist of full time (not reserve) POST certified (not limited police powers) employment as a police officer, sheriff's deputy, or California Highway Patrol Officer. Credit will only be given for full years of service. There shall be no credit for partial yeazs of service and there will be no round up of number of years. Thus, for example, if a lateral has 1 year and 3 months experience, they have one full year of service and shall get $1000. If a lateral has 1 year and 11 months experience, they have one full year of experience and shall get $1000. Lateral incentive pay for each full year of qualifying external law enforcement experience will be paid at the following intervals until the incentive is paid in full: $1,000--Upon completion ofthe hiring process $1,000--At the successful completion of the City probationazy period (one yeaz) $1,000--Every yeaz thereafter on the employee's anniversary date, up to the $5,000 maximum. In no event will an employee receive more than the maximum of $5,000 lateral incentive pay. This New Hire Lateral Incentive pay is of limited duration and the City may end this incentive pay, in its sole and unfettered discretion, at any time and for any reason by providing CVPOA written notice of its intent to terminate this incentive pay and an effective date of such termination. The New Hire Lateral Incentive pay provisions have been presented to the CVPOA, and was approved by a vote of their members. 8-2 OS/07/2013Item Page 3 of 4 DECISION MAKER CONFLICT Staff has reviewed the decision contemplated by this action and has determined that it is not site specific and consequently, the 500-foot rule found in California Code of Regulations section 18704.2(a)(1) is not applicable to this decision. Staff is not independently aware, nor has staff been informed by any City Councilmember, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter. CURRENT YEAR FISCAL IMPACT Approval of this resolution will implement the changes to the Chula Vista Police Officers Association Memorandum of Understanding to include Article 2.16 -New Hire Lateral Incentive Pay. The Department is estimating that it will hire five lateral candidates this fiscal year which will mean a maximum impact of $5,000 (depending on actual number of hires) to the Genera] Fund this fiscal year. The Department will utilize salary savings to fund the incentives; therefore no additional appropriations are required. The Lateral Hiring Incentive is not PERS reportable compensation. ONGOING FISCAL IMPACT Because of the dynamic properties of the hiring incentive, it is extremely difficult to predict the on-going impact of this incentive pay. A realistic estimate would be that the department hires five lateral candidates in fiscal year 2013 and then another 20 lateral candidates in fiscal year 2014. Given those hiring estimates, and assuming each candidate could receive the maximum incentive pay, the on-going impact is detailed below. ~ Assumes 5 lateral hires, each with 5 years+ qualifying experience z Assumes 5 lateral hires from FY2013, plus 20 lateral hires with 5 years+ qualifying experience Assumes 5 lateral hires from FY 2013, 20 lateral hires from FY 2014 a Assumes 20 lateral hires from FY 2014 8-3 _ __ The Department will utilize salary savings each fiscal year to fund the incentives, therefor no additional appropriations will be required. These estimates are at the maximum value of the incentive, and could be lower depending upon the qualifications of the lateral officers at date of hire.
