ORDINANCE OF THE CITY OF CHULA VISTA AMENDING CHULA VISTA MUNICIPAL CODE SECTION 2.05.010 RELATING TO THE ESTABLISHNJ,~NT OF UNCLASSIFIED POSITIONS SUBMITTED BY: CHIEF OF POLICE ~~ REVIEWED BY: CITY MANAGER ~~ 4/STHS VOTE: YES X NO SUMMARY One FA Geospatial Intelligence Analyst is requested to be added to the authorized count of the Police Grant Fund to support the San Diego Law Enforcement Coordination Center (SDLECC). This position is fully reimbursed by grant funds, along with a 4% administrative fee for acting as the fiscal agent. ENVIRONMENTAL REVIEW This proposed activity has been reviewed for compliance with the California Environmental Quality Act (CEQA) and it has been determined that the activity is not a "Project" as defined under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is necessary. 7-1 05/07/2013 Item Page 2 of 3 RECOMMENDATION Council adopt the resolutions and approve the ordinance. BOARDS/COMMISSION RECOMMENDATION Not Applicable. DISCUSSION The Police Deparhnent acts as the fiscal agent for various law enforcement programs which are funded through vazious State and Federal agencies. As the fiscal agent, the Police Department hires and provides salazy and benefits for positions which aze normally considered separate from existing City staffing. These positions aze designated as "FA" (Fiscal Agent) in the title description. One FA Geospatial Intelligence Analyst is requested to be added to the authorized count of the Police Grant Fund to support the San Diego Law Enforcement- Coordination Center (SDLECC). The SDLECC serves as the regional intelligence fusion center for San Diego and Imperial counties. Fusion Centers aze focal points for the receipt, analysis, gathering, and sharing of threat-related information between the federal government and state, local, tribal, and private sector partners. This new position is fully reimbursed by grant funds, along with a 4% administrative fee for acting as the fiscal agent. FA Geosnatial Intelligence Analvst The FA Geospatial Intelligence Analyst conducts research and evaluates technical and all- source intelligence with specific emphasis on supporting regional law enforcement intelligence priorities. This position produces cutting edge, innovative and thoroughly- vetted finished products including trend analysis, case support, tactical field intelligence and presentations to regional law enforcement partners. The FA Geospatial Intelligence Analyst develops analytical products by fusing all-source intelligence and interfaces with external partners, including law enforcement, intelligence community and private sector organizations. This position is funded by the Homeland Security Grant Program (HSGP). DECISION MAKER CONFLICT Staff has reviewed the decision contemplated by this action and has determined that it is not site specific and consequently the 500-foot rule found in California Code of Regulations section 18704.2(a)(1) is not applicable to this decision. Staff is not independently awaze, nor has staff been informed by any City Councilmember, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter. CURRENT YEAR FISCAL IMPACT Approval of Resolution A will result in the amendment of the compensation schedule and classification plan to add the classification of FA Geospatial Intelligence Analyst. This new classification is an at-will position and will be eliminated if grant funding ends. The FA Geospatial Intelligence Analyst will be assigned to the Professional Unclassified (PRUC) group. The E-Step bi-weekly salary for this position will be $3,506.27. Approval of Resolution B will result in the appropriation of $15,553 to the personnel services category of the Police Grant Fund budget for the addition of one FA Geospatial 7-2 05/07/2013 Item Page 3 of 3 Intelligence Analyst to the authorized position count of the Police Grant Fund. The Department anticipates filling this position this month. These personnel costs are fully reimbursed by homeland security grant funds, and the City receives a 4% administrative fee for acting as the fiscal intermediary for these positions. Because of the 4% administrative fee, there is a positive impact of $622 to the General Fund this fiscal year. Approval of the Ordinance will amend Chula Vista Municipal Code 2.05.010 to reflect the addition of FA Geospatial Intelligence Analyst. ONGOING FISCAL IMPACT The ongoing annual cost for this position is approximately $130,000. The personnel costs are fully reimbursed by homeland security grant funds, and the City receives a 4% administrative fee for acting as the fiscal intermediary for this position. Because of the 4% administrative fee, there will be a positive impact of approximately $5,200 to the General Fund each fiscal year. If homeland security grants no longer fund this position, then it will be eliminated. ATTACHMENTS None. ORDINANCE OF THE CITY OF CHULA VISTA AMENDING CHULA VISTA MUNICIPAL CODE SECTION 2.05.010 RELATING TO THE ESTABLISHMENT OF UNCLASSIFIED POSITIONS WHEREAS, the Human Resources Department has created new classifications to better reflect the needs of the City's workforce; and WHEREAS, Chula Vista City Charter Section 500(a) requires that all new unclassified management level positions be adopted by ordinance and afour-fifths vote of the Council. NOW THEREFORE the City Council of the City of Chula Vista does ordain as follows: Section I. That Section 2.05.010 of the Chula Vista Municipal Code is hereby amended to read as follows: 2.05.10 Unclassified positions established. Section II. Severability If any portion of this Ordinance, or its application to any person or circumstance, is for any reason held to be invalid, unenforceable or unconstitutional, by a court of competent jurisdiction, that portion shall be deemed severable, and such invalidity, unenforceability or 7-6 Ordinance Page 2 unconstitutionality shall not affect the validity or enforceability of the remaining portions of the Ordinance, or its application to any other person or circumstance. The City Council of the City of Chula Vista hereby declares that it would have adopted each section, sentence, clause or phrase of this Ordinance, irrespective of the fact that any one or more other sections, sentences, clauses or phrases of the Ordinance be declared invalid, unenforceable or unconstitutional. Section III. Construction The City Council of the City of Chula Vista intends this Ordinance to supplement, not to duplicate or contradict, applicable state and federal law and this Ordinance shall be construed in light of that intent. Section IV. Effective Date This Ordinance shall take effect and be in force on the thirtieth day after its final passage. Section V. Publication The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be published or posted according to law.
