RESOLUTION N0. 3784
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
MODIFYING THE TERMS OF ORDINANCE NO. 670, WITH RESPECT
-„TO"ENCLOSING THE SWIMMING POCL LOCATED AT THE APARTMENT
. COMPLEX AT. 280 "K" STREET
The City Council of the City of Chula Vista does hereby
resolve as follows:.
WHEREAS',.Secticn 6 of Ordinance No. 670 gives the City '
Council authority to provide for specific modifications of the terms
of said ordinance, with ,'respect to the enclosing~of,swimming pools
upon the "finding of certain facts, and ,
;.. ,
WHEREAS`; Frark ~L. Wh'ittington has made application to the
City Council for modification'of the terms of said ordinance, .,pith
respect to.the swimming pool located at the Apartment Complex at
280 °Y." Street for'the reasons set,'forth in said application.
NOW, THEREFORE, the City Council.of the City of Chula Vista
~ does hereby find as follows:.
1. That strict compliahce with the terms of said~crdinance
v;ill not materially benefit or safeguard the public because the
swimming pool is located in an apartment complex which will'be, .
completely enclosed by a six-foot high fence with the exception of
a 73'foot opening on "K°' Street.
2. 'TYiat the location of one of the a"partment buildings will
~{ prevent the .pool being seen from.°K°' Street.
I 3: That the pool is located 320 feet from the "K" Street .
k opening and. is compl"etely surrounded by buildings, and is therefore
reasonably protected, and that the installation of fencing as required
in Section 29.2 of the City Code will not substantially increase the
protection which is the purpose of said section but would require a

substantial and unnecessary expenditure by the applicant.
NOW,"THEREFORE, IIE IT. RESOLVED by the City Council of the
City of Chula Vista that the fencing requirements as set, forth in
Section 29.2 of the Chula Vista City Code be, and they are hereby..
waived insofar as an enclosure three feet six inches hiah completely
'surrounding the pool•:,is thereby required.
