HomeMy WebLinkAboutReso 1965-3755.,, • RESOLUTION NO. 3755 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA GRANTING THE APPEAL OF DR. AND MRS. JOSEPH A. CASEY FROM THE PLANNING COMMISSION DENIAL OF A REQUEST FOR A USE VARIANCE The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, the City Planning Commission has heretofore held a public hearing on May 3, 1965 to consider the request of Dr. and Mrs. Joseph A. Casey for a variance from the R-3 zone to permit the use of a house at Z88 Del Mar Avenue, Chula Vista, California, for an antique shop, and WHEREAS, the Planning Commission by a vote of 4 to 3 denied said request based upon the fact that no unnecessary hardship had been found, that it woul"d constitute an intrusion into a residential area, ,that parking problems would be created, and that it would deter proper redevelop- ment of the area, and• -> WHEREAS, Dr. and Mrs. Casey have appealed said denial to the•' City Council of the City of Chula Vista and the Council has held a public hearing on said appeal on June 15, 1965, and WHEREAS, the Council, after hearing all evidence presented at said public hearing and the report.of the City Planning Commission, does hereby make the following findings of fact: 1. That an unnecessary hardship exists by virtue of the particular location and size of said lot, imposing difficulties in the. utilizing of the existing structure for either R-1 use or R-3 use as permitted by the zone. 2. That in order to preserve a substantial property right of the owners the use as requested should be granted because none of the permitted uses are suitable to the structure or the area. 3. That such a use variance is not contrary to the intent or purpose of the ordinance but will permit a proper and sound interim use. 4. The use as requested will not be materially detrimental to the surrounding area. in that there will be no increased traffic or parking problems -1- and the particular use is compatible with residential development and would not constitute an intrusion of commercial activity into a residential area. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista as follows: That the appeal of Dr. and Mrs. Joseph A. Casey from the denial of a request for a variance for the use of a house at 288 Del Mar Avenue for an antique shop be, and the same is hereby granted, and the decision of the Planning Commission be, and it is hereby reversed.
