RESOLUTION N0. 3744
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
ESTABLISHING A POLICY FOR TAE PAYMENT OF COSTS INCURRED
FOR MEDICAL AND HOSPITAL TREATMENT OF PRISONERS
The City Council of the City of Chula Vista does hereby
resolve as follows:
WHEREAS, Sections 4011 and 4011.5 of the Penal Code of the
State of California set forth the responsibility of the City or the
County to provice necessary medical care to prisoners in the charge
of City or County law enforcement officials, and
WHEREAS, said code sections provide that prisoners requiring
hospital care and treatment shall r-eceive sucYi hospital care and
treatment subject to necessary control for the safekeeping of such
prisoners, and in the case of poor and indigent 'prisoners, the cost
of such medical services and such hospital care•and treatment shall
be paid from the appropriate general fund, depending upon which
local agency arrested the prisoner, and further provides that in
such cases where the prisoner is financially able to pay for his
care, special agreement for payment may be arranged, and
WHEREAS, it has been the general policy of the Chula Vista
Police Department that the City would pay from the general fund
for hospital care or medical services required for injuries or
illness arising subsequent to arrest, and that said costs for injuries
and illness occurring prior to or at the time of arrest, if such
injuries are not the result of the arrest, would be assumed by the
prisoner, and
WHEREAS, it is desirable to establish a policy in conformity
with the provisions of the Penal Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Chula Vista that i~'shall be the policy of the City of Chula
Vista to provide adequate medical services and hospital care and
treatment of prisoners in custody of the Chula Vista Police Department.
BE IT FURTHER RESOLVED that the City of Chula Vista will
assume the cost of such medical services and such hospital care and
treatment if the prisoner is poor and indigent and unable to pay for

such services, and in those cases where the prisoner is financially
able to bear such costs, the Finance Officer of the City, upon :'
receipt of a statement of such costs be, and he is hereby directed
to take all necessary steps to secure the payment of costs of
medical services and hospital care and treatment, regardless of
the time or place where the illness or injury was incurred by the
prisoner.
