HomeMy WebLinkAboutReso 1998-19224 RESOLUTION NO. 19224 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA, CALIFORNIA MAKING APPOINTMENTS IN PROPOSED COMMUNITY FACILITIES DISTRICT NO. 97-3 (MCMILLIN OTAY RANCH SPA ONE) WHEREAS, the City Council, desires to initiate proceedings to create a Community Facilities District pursuant to the terms provisions of the "Mello-Roos Community Facilities Act of 1982," being Chapter 2.5, Part 1, Division 2, Title 5 of the Government Code of the State of California (the "Act") and the City of Chula Vista Community Facilities District Ordinance enacted pursuant to the powers reserved by the City of Chula Vista under Sections 3, 5 and 7 of Article XI of the Constitution of the State of California (the "Ordinance") (the Act and the Ordinance may be referred to collectively as the "Community Facilities District Law"). This Community Facilities District shall hereinafter be designated as COMMUNITY FACILITIES DISTRICT NO. 97-3 (MCMILLIN OTAY RANCH SPA ONE) (the "District"); and WHEREAS, at this time, the legislative body desires to appoint and designate itself as the legislative body of the District, in order to allow the proceedings to go forward to completion in accordance with the provisions of law. NOW, THEREFORE IT IS HEREBY RESOLVED: SECTION 1. The above recitals are all true and correct. SECTION 2. Throughout the course of these formation proceedings and following the formation thereof, the City Council of the City will be acting as the legislative body of proposed Community Facilities District No. 97-3 (MCMILLIN OTAY RANCH SPA ONE), which shall upon the formation thereof be a legally constituted governmental entity as defined by Section 53317 of the Government Code of the State of California. SECTION 3. All applicable regulatory rules of the City, including date, time, and place of meetings, as well as notice requirements shall be applicable for all proceedings conducted by this legislative body as the governing body of the Community Facilities District. SECTION 4. The "Star-News," or another newspaper of general circulation, is hereby designated as the newspaper for all publications as required by law and as necessary for completion of this District.
