HomeMy WebLinkAboutReso 1998-19182 RESOLUTION NO. 19182 RESOLUTION OF THE CITY COUNCIL OF THE CITY OI= CHULA VISTA, CALIFORNIA, ORDERING CERTAIN CHANGES AND MODIFICATIONS IN THE BOUNDARIES OF ASSESSMENT DISTRICT NO. 97-2 (OTAY RANCH VILLAGE ONE) AND APPROVING AN AMENDED BOUNDARY MAP WHEREAS, the City Council of the City of Chula Vista, has previously initiated proceedings, held a public hearing and assessment ballot procedures pursuant to the terms and provisions of the "Municipal Improvement Act of 1913", being Division 12 of the Streets and Highways Code of the State of California (the "Improvement Act") and Article XIIID of the Constitution of the State of California ("Article XIIID") and the Proposition 218 Omnibus Implementation Act (Government Code Section 53750 and following) (the "Implementation Act") (the Improvement Act, Article XIIID and the Implementation Act are referred to collectively as the "Assessment Law") for an assessment district designated as ASSESSMENT DISTRICT NO. 97-2 (OTAY RANCH VILLAGE ONE) (the "Assessment District"); and WHEREAS, the owners of that property identified Assessment No. 12 and the owner of the property adjacent to the property identified as Assessment No. 12 have requested that the City approve a lot line adjustment which will result in an exchange of certain property between the property owners; and WHEREAS, such owners have requested changes in the boundaries of the Assessment District to reflect the property exchange; and WHEREAS, the Assessment Engineer, in anticipation of the above referenced lot line adjustment and property exchange, did in the proceedings to consider the formation of the Assessment District originally apportion the costs of the improvements and the special benefits therefrom to reflect the proposed property exchange; and WHEREAS, at this time it appears to this legislative body that certain changes and modifications in the boundaries of the Assessment District are necessary in order to add certain property to the Assessment District and to eliminate a portion of the Assessment District; and WHEREAS, such change and modification in the boundaries of the Assessment District will not result in an increase in the total amount of the assessment or increase the amount of any assessment by reason thereof. NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: SECTION 1. The above recitals are all true and correct. SECTION 2. The public interest, convenience and necessity requires, and this legislative body orders certain changes and modifications in the boundaries of the Assessment District as set forth in Amended Assessment Diagram Assessment District No. 97-2 (Otay Ranch Village One), a copy of which is on file in the office of the City Clerk. The City Clerk is hereby authorized and directed to cause a copy of such amended assessment diagram to be filed in the office of the County Recorder of the County of San Diego. Resolution 19182 Page 2 SECTION 3. The decision and determination of this City Council shall be final and conclusive upon all persons entitled to appeal thereupon to this City Council.
