Public Hearing: PCC 10-08; Consideration of a Conditional Use Permit to establish and operate a fast-food restaurant with drive- through including 24 hour operation and signage at 919-945 Otay Lakes Road -Jack-In-The-Box. , Background: Jeff Steichen, project manager, reported that the proposal is a request by Jack-In-The-Box for a Conditional Use Permit to allow for the construction of a 2,491 sf fast- food restaurant with 24-hr drive-thru service and associated signage, The proposal is on a site within an existing commercial center, Previously approved at this site in September 2007 was a Et Pollo Loco restaurant. The Design Review Board approved the design and architecture for this project on May 17, 2010. Circulation improvements over the former EI Pollo Loco project are that the entrance to the drive-thru is 5 feet further to the east and the two closest parking spaces to the southerly driveway were eliminated to help reduce the possibility of vehicle conflicts with cars backing out of spaces and other vehicles entering the driveway , Planning Commission Minutes - 2 - June 9, 2010 The CN (Neighborhood/Commercial) zone only allows one freestanding sign for the entire center Due to the unique site characteristics and location of the restaurant the applicant is requesting approval of a sign program incorporating an 8-foot high monument sign midpoint between the central and southerly driveways. Staff Recommendation: That the Planning Commission adopt Resolution PCC 10-08 considering the addendum to Mitigated Negative Declaration and the Mitigation Monitoring and Reporting Program, IS 07-06 and approve Conditional Use Permit based on the findings and subject to the conditions contained in therein. Public Hearing Opened: Sharon Douglas representing Jack-In-The-Box stated she had nothing further to add and was available to answer questions of the Commission Public Hearing Closed: l Cmr. Spethman encouraged the applicant to explore the possibility of utilizing the existing tenant monument sign If they maintain that it does not meet their needs, then he'd recommend they redesigning and reduce the bulk and mass of the proposed monument sign, Cmr. Tripp stated he believes the applicant missed an opportunity to deviate from the cookie-cutter corporate design models and propose an enhanced design, as has been done with other Jack-In-The-Box restaurants in other communities, He further stated that the ; proposed sign is excessive and not in scale with the surrounding area and commercial center. ~I Cmr, Felber stated he agrees the sign as proposed is excessive in size and would concur with Cmr Spethman's recommendation to have the applicant work with staff and reduce the size of the sign, Cmr. Liuag stated he shares the same concerns previously expressed regarding the size of the proposed sign. Additionally, since this is a congested center, he is concerned with the loss of parking spaces during the construction phase 6:42:25 PM MSC (Felber/Liuag) (4-1-0-2) That the Planning Commission adopt Resolution PCC ~ 10-08 considering the addendum to Mitigated Negative Declaration and the Mitigation Monitoring and Reporting Program, IS 07-06 and approve Conditional Use Permit based on the findings and subject to the conditions contained in therein, with the following recommends: • that the applicant work with staff to scale down the sign and look into the possibility of incorporating other businesses on their monument sign, and • develop acirculation/parking plan to mitigate impacts on loss of parking spaces during the construction phase„ 1 Motion carried with Cmr'..
