CONSENT AGENDA: None
ACTION ITEM:
1. Action Item: PCM 10-018: Resolution of the Planning Commission of
the City of Chula Vista recommending the City Council
approve the waiver of the applicable Residential.
Construction Tax for 28 affordable housing units within a
development to be located on Neighborhood R-30 in Otay
Ranch Village 2 in satisfaction of the City's Balanced
Communities Policy.. ;
Background: Mandy Mills, Housing Manager, reported that the proposal is to construct a
278 unit apartment complex known as the Rosina Vistas located in Village 2 of Otay Ranch,
designating 10% (28 units) as affordable rental housing, fulfilling the requirements of the
City's Balanced Community Policy.
In accordance with Chula Vista Municipal Code 3 32.050, the applicant has requested the
waiver of the Residential Construction Tax totaling approximately $11,250 for the 28
affordable rental units.
Staff Recommendation: That the Planning Commission approve resolution recommending
the City Council approve the waiver.

Cmr. Felber asked how often do developers ask for this waiver and what is the criteria used
to determine whether to grant the waiver
Leilani Hines responded that the request is seldom made and to-date, since she's been with
the City, there is only one other project in the Heritage Town Center known as Sunrise and
Harvest Ridge Apartments where the taxes were waived,
Ms. Hines and Mills stated that there are numerous variables a developer has in fulfilling
their inclusionary housing requirements, depending on the size of the project, incentivised
government funding sources, tax credits, assistance from the City, etc. A developer may
also choose to pay in lieu fees, however, the City would prefer the units be built now instead ,
of collecting fees to someday have enough money to go out and building an affordable
housing complex. The City also encourages inclusionary housing be disbursed throughout
the community as called for in the Balanced Community Policy. This particular developer is
not receiving any assistance from the City and is the sole owner of this parcel in Village 2
By designating 28 units, or 10% of his project as affordable units he is fulfilling his obligation.
MSC (Moctezuma/Felber) (7-0) to approve PCM 10-018. Motion carried unanimously.
Director' Report:
Director Halbert gave an update on the status of the General Fund budget.

Commission Comments:
Cmr. Felber stated he drove by the corner of Third Ave and E Street and was extremely
pleased with the clean-up job and fencing they did on that corner lot. He inquired what it
would take to get other vacant lots that are blighted to do the same.
Director Halbert responded that that particular lot is within the Redevelopment Area and as ;
such it was Agency monies that funded the clean-up. He further indicated that he would
relay to the CVRC at their next meeting that the Planning Commission inquired if there were
other opportunities to do the same with other lots within the Redevelopment Area
Additionally, for lots that are privately owned, it would have to be agreed upon by the owner i
to invest in the clean-up
