RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA ACCEPTING BIDS, AWARDING THE
CONTRACT FOR THE "CORRAL COURT PUMP STATION
REHABILITATION IMPROVEMENTS (CIP NO. SW264)"
PROJECT TO T.C. CONSTRUCTION CO. IN THE AMOUNT
OF $616,780, APPROPRIATING FUNDS IN THE AMOUNT OF
$470,000 FROM THE AVAILABLE SEWER FACILITY
REPLACEMENT FUND BALANCE, WAIVING CITY
COUNCIL POLICY NO. 574-01, AND AUTHORIZING THE
EXPENDITURE OF ALL AVAILABLE CONTINGENCY
FUNDS IN AN AMOUNT NOT TO EXCEED $92,220
WHEREAS, the Corral Court Pump Station Improvement project involves the removal
and disposal of existing sewage lift station improvements and the abandonment of an existing
force main, construction of a new sewage pump station, including a concrete block building
enclosure and dual force main; and
WHEREAS, on January 23, 2013, the Director of Public Works received six (6) sealed
bids for "Corral Court Pump Station Rehabilitation Improvements (CIP No. SW264)" Project;
and
WHEREAS, the Director of Public Works received six (6) bids as follows:

1. T.C. Construction Co. -Santee, CA $616,780.00
2. RMV Construction Inc. -San Diego, CA $622,250.00
3. Alvand Construction Ina -Poway, CA $634,285.00
4. Arrieta Construction, Inc. - El Cajon, CA $663,890.00
S. Tharsos Construction - La Mesa, CA $719,214.00
6. Newest Construction Company Inc. -San Diego, CA $766,960.00
WHEREAS, the low bid submitted by T.C. Construction Co. is above the Engineer's
Estimate of $550,000 by $66,780 (12% above the Engineer's estimate); much of this difference
can be amibuted to the large number of specialty items within the project scope of work for
which the unit costs are highly variable; and
WHEREAS, T.C. Construction, Co. has satisfactorily performed construction projects of
similar scope for the City in the past; and
WHEREAS, the Contractor's License No. 402459 is current and active; and

WHEREAS, staff reviewed the contractor's bid package and determined that the
contractor bid package is complete, with no errors or omissions, and recommends awarding the
contract to T.C. Construction Co. in the amount of $616,780; and
WHEREAS, staff is requesting additional funds needed to complete the project totaling
$470,000 from the available Sewer Facility Replacement Fund balance; and
WHEREAS, the additional project cost is due to unanticipated construction costs
associated with site constraints and are related to the implementation of new City design
standazds and policies with regard to such facilities; and
WHEREAS, these design standazds and policies include a building enclosure to assure
worker safety during routine maintenance and emergencies in all weather conditions and to
protect mechanical and electrical equipment, dual force mains and other redundancies to reduce
the risk of accidental sewage dischazge to receiving waters, and enhanced remote communication
systems to diagnose and monitor the station's operations and respond rapidly to alarms, failures,
and malfunctions; and
WHEREAS, in order to approve change orders as necessary, staff is requesting City
Council waive Council Policy No. 574-01.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby accept bids, awazd the contract for the "Corral Court Pump Station
Rehabilitation Improvements (CIP No. SW264)" Project to the lowest responsible bidder, T.C.
Construction Co. in the amount of $616,780, and appropriate funds in the amount of $470,000
from the available Sewer Facility Replacement Fund balance.
BE IT FURTHER RESOLVED that, with respect to this contract, the City Council of the
City of Chula Vista does hereby waive Council Policy No. 574-01 and authorize the expenditure
of all available contingency funds in an amount not to exceed $92,220.
BE IT FURTHER RESOLVED that the Public Works Director is authorized to
implement this contract awazd through the prepazation and execution of the City's standazd form
contract in a final form approved by the City Attorney.
