HomeMy WebLinkAboutReso 2013-035RESOLUTION NO. 2013-035 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING A CHANGE ORDER TO THE CONTRACT WITH TRI-GROUP CONSTRUCTION, INC. FOR THE "ALPINE AVENUE IMPROVEMENTS FROM EMERSON STREET TO OXFORD STREET (STL379) AND TWIN OAKS AVENUE IMPROVEMENTS FROM EMERSON STREET TO OXFORD STREET (STL386)" PROJECT IN THE AMOUNT OF $98,726 TO PERFORM ADDITIONAL ELIGIBLE WORK IN THE CASTLE PARK NEIGHBORHOOD AREA UNDER THE SECTION 108 LOAN PROGRAM; REDUCING THE STL380 BUDGET BY $41,593 AND THE STL385 BUDGET BY $53,000 AND APPROPRIATING THE EQUIVALENT AMOUNT TO STL379 WHEREAS, in 2006, the City received approval for a Federal Department of Housing and Urban Development (HUD) Section 108 Loan to install public street improvements in the Castle Park neighborhood area; and WHEREAS, the Section 108 Loan funds must be expended by June 2013 or the balance returned to HUD; and WHEREAS, the last and final street improvement projects are currently underway within Alpine and Twin Oaks Avenues, between Emerson and Oxford Streets (STL379 & STL386), under a contract awarded to Tri-Group Construction, Ina (Tri-Group) by Resolution No. 2012- 196; and WHEREAS, staff estimates that, upon completion of this contract work by Tri-Group and financial closure of CIP Projects STL380 and STL385, approximately $100,000 in HUD Section 108 Loan funds will remain unexpended; and WHEREAS, staff developed a list of eligible improvement work within the Castle Park Neighborhood azea to expend these funds and received a quote of $98,726 from Tri-Group to complete this work as a change order to their contract. This change order requires City Council approval; and WHEREAS, a change order with Tri-Group for additional work, as opposed to a new contract for work, is necessary and appropriate because (1) Tri-Group is already working in the azea on similar work which creates economies and efficiencies in construction staging, and reduces the cost to the City for such work; and (2) the time required for a new contract process would put the available 108 loan program funding for the project in serious jeopazdy. Resolution No. 2013-035 Page No. 2 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista (1) approve a change order to the contract with Tri-Group Construction, Inc. for the "Alpine Avenue Improvements from Emerson Street to Oxford Street (STL379) and Twin Oaks Avenue Improvements from Emerson Street to Oxford Street (STL386)" Project in the amount of $98,726 to perform additional eligible work in the Castle Park neighborhood azea under the Section 108 Loan Program; (2) find that the change order (as opposed to a new contract) is necessazy, appropriate and urgent in order to reduce project costs and preserve available funding; and (3) reduce the STL380 budget by $41,593 and the STL385 budget by $53,000 and appropriate the equivalent amount to STL379.
