RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA, ADOPTING A BOUNDARY MAP SHOWING THE
BOUNDARIES OF THE TERRITORY PROPOSED FOR THE
INCLUSION IN PROPOSED COMMUNITY FACILITIES DISTRICT
NO. 98-2 (INTERIM OPEN SPACE MAINTENANCE DISTRICT

WHEREAS, the City Council of the City of Chula Vista (hereinafter referred to as the
"legislative body of the local Agency"), desires to initiate proceedings to create a Community
Facilities District pursuant to the terms and provisions of the "Mello-Roos Community Facilities
Act of 1982", being Chapter 2.5, Part 1, Division 2, Title 5 of the Government Code of the
State of California (the "Act") and the City of Chula Vista Community Facilities District
Ordinance enacted pursuant to the powers reserved by the City of Chula Vista under Sections
3, 5 and 7 of Article XI of the Constitution of the State of California (the "Ordinance") (the
Act and the Ordinance may be referred to collectively as the "Community Facilities District
Law"). This Community Facilities District shall hereinafter be designated as Community
Facilities District No. 98-2 (Interim Open Space Maintenance District [McMillin - D. A.
American, Otay - SPA Two, Villages 6 & 7]) (hereinafter referred to as the "District"); and
WHEREAS, there has been submitted a map showing the boundaries of the territory
proposed for inclusion in the District including properties and parcels of land proposed to be
subject to the levy of a special tax by the District.
NOW, THEREFORE, IT IS HEREBY RESOLVED:
SECTION 1. The above recitals are all true and correct.
SECTION 2. The map designated as "Boundaries of Community Facilities District No.
98-2 (Interim Open Space Maintenance District [McMillin - D. A. America, Otay - SPA Two,
Villages 6 & 7])" showing the boundaries of the territory proposed for inclusion in the District
including properties and parcels of land proposed to be subject to the levy of a special tax by
the District is hereby adopted.
SECTION 3. A certificate shall be endorsed on the original and on at least one (1)
copy of the map of the District, evidencing the date and adoption of this Resolution, and
within fifteen (15) days after the adoption of the Resolution fixing the time and place of the
hearing on the formation or extent of such District, a copy of such map shall be filed with the
correct and proper endorsements thereon with the County Recorder, all in the manner and
form provided for in Sections 3110 and 3111 of the Streets and Highways Code of the State
of California.
