HomeMy WebLinkAboutReso 1965-3669 RESOLUTION N0. 3669 .'~ RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND THE CITY OF NATIONAL CITY PROVIDING FOR THE USE OF THE POUND FACILITIES AND SERVICES OF THE CITY OF CHULA VISTA The City Council of the City of Chula Vista does hereby resolve as follows: That that certain agreement between the City of Chula Vista, a municipal corporation, and the City of National City, a municipal corporation, dated the 6th day of April , 1965, a copy of which is attached hereto and incorporated herein, 'the same as though fully set forth herein be, and the same is hereby approved. BE IT FURTHER RESOLVED that the Mayor of the City of Chula Vista be, and he is hereby authorized and directed to execute same for and on behalf of said City. DATED: City Clerk CC 652 AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND THE CITY OF NATIONAL CITY, PROVIDIP'G FOR THE USE OF CHULA VISTA'S POUND FACILITIES AND SERVICES THIS AGREEMENT, made and entered into this 6th day of April , 1965, by and between the CITY OF CHULA VISTA, a municipal corporation, hereinafter called "Chula Vista," and the CITY OF NATIONAL CITY, a municipal corporation, hereinafter called `!National City," W I T N E S S E T H WHEREAS, the City of National City desires to use the pound facilities of the City of Chula Vista as a shelter for the impounding and disposing of dogs and small animals, and WHEREAS, the City of Chula Vista has pound facilities adequate to serve the needs of the City of National City in addition to the present use by the City of Chula Vista. NOW,THER.EFORE, IT IS AGREED by and between Chula Vista and National City that the terms of this agreement shall be as follows: 1. Chula Vista agrees to permit -the City of National City to utilize pound facilities owned and operated by the City of Chula Vista as shelters for the impounding and disposal of dogs and small animals subject to the provisions of Ordinance No. 82$ of the City of National City, which dogs and small animals may be collected within the following described area of National City, to wit: All that portion of the incorporated territory of the City of National City. 2. Chula Vista agrees to perform all normal pound services, including among other things, the following: a. Confinement, feeding, destruction and disposal (other than by sale) of dogs and small animals. b. Reservation of not more than ten (10) kennels and three (3) quarantine cages, for the use of the City of National City. c. Use of the carbon monoxide chamber and/or the incinerator chamber for disposal of animals. d. Reasonable use of the Animal Shelter office and r facilities, ~' r~'~ ~~~ ~~~~~ ~~ . ~_~~ -1- 3. Chula Vista agrees to provide pound facilities and services at the Animal Shelter located at 875 G Street during the hours of 8:00 a.m. to 4:00 p.m. for the purpose of receiving animals from officials of the City of National City and for the redemption by owners authorized by the City of National City, provided that owners present acceptable authorization far release. Said receipt and redemption of animals shall be limited to all weekdays from Monday through Friday, except the following legal holidays: January 1 First Monday in September February 12 September 9 February 22 October 12 May 30 November 11 July 4 Last Thursday in November December 25 4. Chula Vista agrees to accept dogs or small animals from bonified residents of National City without charge to such persons, but with a disposal charge to the City. of National City of fifty cents (50~) for each such animal delivered. The hours for acceptance of such animals shall be as follows: a. Dogs: Between the hours of 8:00 a.m. and 4:00 p.m. on the days set forth in Section. 3. b. Cats: Between the hours of 8:00 a.m. and 2:00 p.m. on the days set forth in Section 3. 5. National City shall deliver all dogs and small animals to the Chula Vista Pound, and the Chula Vista Pound personnel shall accept said dogs and small animals and perform all pound services normally provided as set forth hereinabove pursuant to Ordinance No. 82$ of the City of National City. 6. National City agrees to pay to the City of Chula Vista the following sums in consideration for the use of the aforementioned services and facilities: a. Thirty-°~iVe:.dollars (35.00) per month for use of facilities and services set forth in this agreement. -2d ~' b. One dollar ($1.00) per day per dog for boarding and feeding said dog. c. Fifty cents (50~) per day per cat for boarding and feeding said cat. Said payment for services rendered by the City of Chula Vista to the City of National City shall be computed and paid quarterly. 7. Chula Vista shall not be responsible to any resident of National City, or to the City of National City, because of the destruction of any animal delivered to and accepted by the pound facilities pursuant to this agreement. IT IS FURTHER AGREED that this agreement shall tal{e effect and be ire full force on the 15t day of JuIY 1965, and shall terminate on the 3pth day of June , 1°_66_; provided, however, that either party may terminate this agreement at any time by giving to the other party written notice of intention to terminate ninety (90) days following said notice. IN WITNESS WHEREOF this agreement is executed by the City of Chula Vista acting by and through its Mayor pursuant to Resolution No. 36:69, and ~y the City of National City acting by and through its Mayor, the day and year first hereinabove written.
