CALL MEETING TO ORDER: Chairman Monaghan called the meeting to order at 5:17
p. m.

Assistant Director Remp introduced the items with the recommendation that the
Board of Appeals and Advisors endorse Council adoption of the above
referenced codes as amended. Mr. Remp advised the Board that this is a
process engaged in approximately once every three years and is a routine
adoption of the Codes as they come out.
Assistant Director Remp also expressed his appreciation to Deputy Building
Official EI-Khazen for his hard work in preparing the items for Council approval
and submittal to the State.
Proposed ordinance changes were discussed. Suggestions for language
changes were noted. Changes will be made.
MSUC RomolWest (5-O) to accept Staff's recommendation and approve the
adoption of the above referenced codes as amended.

5. BUILDING OFFICIAL'S COMMENTS/REPORT:
A. Presentation of Award for Board Member Ty Compton
Assistant Director Remp expressed his appreciation to Board Member Compton
for serving on the Board. Assistant Director Remp also extended the invitation to
Board Member Compton to continue serving until such time as a replacement is
found.

PURPOSE:
The purpose of this procedure is to outline the steps and responsibilities of each
discipline when plan checking, processing and inspecting projects requiring special
inspection.
Note: Throughout this procedure, HERS (Home Energy Rating System) raters are to be
considered special inspectors and the procedures outlined below apply to HERS
raters as they apply to special inspectors unless noted otherwise.
PROCEDURES:
California Building Code, Section 1701, and California Energy Efficiency Standards,
require special inspection for the following types of work:

Special inspection may not be required when the work requiring special inspection is
performed on the premises of an approved fabricator and the procedure for "Shop
Fabrication" is complied with. See Items F (a) and (b) under "Inspection."
During Plan Check:
On projects where the Plans Examiner identifies work requiring special inspection
and/or shop fabrication; the Plans Examiner shall do the following:

A. Identify all work requiring special inspection and request that the designer shows
the information in one location on the plans (i.e. Title/Cover Sheet, S-1 Sheet -
Special Inspection Table/Schedule.)
B. Insert a comment in the correction list stating that the attached "Property
Owner/Contractor Agreement Form" to be completed and signed prior to permit
issuance.
C. Attach the applicable special inspection forms to the correction list (for HERS,
"Property Owner/Contractor Agreement Form" and energy compliance forms CF-
4R and CF-6R.)
D. Complete the "Special Inspection" screen in Permits Plus.
At Building Counter:
The Development Services Technicians (DST's) will hand over or fax to the applicant
the special inspection forms that are attached to the correction lists generated by the
plans examiners.
At time of permit issuance, the DST must collect a completed "Property
Owner/Contractor Agreement Form" and attach it to the Permit Application.
Inspection:
Prior to the first day a special inspector is scheduled to be on the job site, he/she must
do the following:
1. Notify the Inspection Section of the permit number, project address, date and
approximate time he/she is scheduled to be on the job site, and a phone number
that he/she can be reached at (preferably his/her cell phone.) This can be
accomplished by either calling in the information or completing Form 4545 and faxing it
to the Inspection Section.
2. Fax a copy of his/her qualifications, experience and driver license/photo ID to the
Inspection Section.

The two requirements shown above are also required when a replacement special
inspector, other than the originally approved special inspector, takes over the project on
a temporary or permanent basis.
Special inspectors can notify the Inspection Section by phone (619) 409-5868 or Fax
(619) 216-7306.
The following are the steps taken by the Inspection Section staff:
A. Staff receives a call or a fax from a special inspector or Inspection Agency
identifying the permit number, project address, date and time the special
inspector's first day on site.
B. The Office Specialist or Development Services Technician enters the information
on the "Special Inspection" screen in Permits Plus.
C. The Office Specialist or Development Services Technician forwards the
information collected under item (A) above to the Building Inspector (BI) assigned
to the project.
D. The BI incorporates the time into his daily schedule and meets the special
inspector at the job site to verify his/her qualifications, inform him/her of the City's
procedures and expectations and give him/her the "Special Inspection
Instructions To Special Inspectors/Inspection Agencies/Testing Labs/HERS
Raters."
Special Inspector Qualifications
Special inspectors shall have current copies of certificates or cards for work requiring
special inspection and a current driver license/photo ID.
Except for grading, smoke control, and other specialty inspections for which a
certification is not required by law, special inspectors must be certified in their areas of
expertise. The following table indicates required certification for each type of special
inspection:

1. The sails engineer or Geotechnical engineer of record may designate a qualified
individual as their agent to pertorm special inspection on grading, excavation and filling.
Note: Except for grading, smoke control, and other specialty inspections for
which a certification is not required by law, the fact that a person is the
architect or engineer of record should be no factor in determining whether the
person is qualified as a special inspector. If the architect or engineer is
qualified as a special inspector by demonstrating satisfactory competence in
a particular type of construction, it is acceptable for the architect or engineer
to perform special inspection for a project.
E. Special inspection reports and test results are to be reviewed by the BI assigned
to the project within two working days from the date of receipt of the report or test
results. Identified issues/concerns are to be communicated to the special
inspector or Testing Agency by the next working day from the date the
issue/concern is identified.

F. The BI shall collect the following forms, if applicable, at the stage of construction
as identified below:
a. "Application to Perform Off-Site Fabrication" -Form 4540: This application
shall be completed by the fabricator of building components when such
components are fabricated within the premises of the fabricator's shop.
This application must be submitted to the Inspection Section for approval
at least three business days prior to the scheduled start of fabrication. A
BI III (or Snr. BI) shall review the application within the next working day of
receipt for completeness and qualification. If the application is not
complete or the fabrication shop is not qualified, the BI III (or Snr. BI) shall
. immediately notify the fabrication shop and the contractor of the
requirements.
b. "Certificate of Compliance for Off-Site Fabrication" -Form 4541: This form
shall be completed by the fabricator of building components when such
components are fabricated within the premises of a fabricator's shop. This
form must be filed with the Inspection Section and approved prior to the
installation of the fabricated components.
c. "INSTALLATION CERTIFICATE" (CF-6R) and "CERTIFICATE OF FIELD
VERIFICATION AND DIAGNOSTIC TESTING" (CF-4R1: Form CF-6R to
be completed and signed by the installer and form CF-4R to be completed
and signed by the HERS rater. Both forms must be submitted to the
Inspection Section prior to "Final" inspection.
d. "Special Inspector/Inspection Agency/Testing Laboratory Final Report"-
Form 4543 (not applicable to HERS raters): This form shall be completed
by the special inspector and/or the special inspection agency and/or the
construction materials testing laboratory after all work requiring special
inspection or testing have been completed, and submitted to the
Inspection Section prior to final inspection.
e. "Property Owner's Final Report" -Form 4542: This report shall be
completed by the property owner orhis/her authorized agent of record or
the architect/engineer of record acting as the property owner's agent for
the types of work requiring special inspection, construction materials
testing or off-site fabrication. This form must be filed with the Inspection
Section prior to final inspection.

Prior to "Final", and only after the BI verifies that all required reports and forms have
been submitted and are in compliance, he/she must approve Item 4470, "Bldg. Special
Insp." in the Permits' Plus Inspection Module.
Quality Control:
A. The BI shall visit the job site at least once a week to verify that the special
inspector is performing his/her duties while work requiring special inspection is in
progress.. The BI shall document his/her observation. If the Special Inspector is
not performing his/her duties while work requiring special inspection is in
progress, staff must follow the steps listed below under "B".
B. All corrective actions must be properly documented (ie: correction notice and
computer entry including verbal warnings). Staff must follow the steps listed
below in the order shown:
Step 1. First occurrence
Written Notice -Performed by BI.
Issued by the BI on site identifying the duties/responsibilities the Special
Inspector failed to comply with. The Notice must include a statement
informing the Special Inspector what are his/her duties/responsibilities as
it relates to the duty/responsibility he/she failed to comply with. A copy of
the notice shall be given to the Special Inspector, Inspection Agency (if
applicable), contractor and the owner/owner's agent.
Step 2. Second occurrence
Second Written Notice -Performed by BI.
Issued by the BI on site identifying the duties/responsibilities the Special
Inspector failed to comply with. The Notice must include a statement
informing the Special Inspector what are his/her duties/responsibilities as
it relates to the duty/responsibility he/she failed to comply with. A copy of
the notice shall be given to the Special Inspector, Inspection Agency (if
applicable), contractor and the owner/owner's agent.

Step 3. Third occurrence
Office Interview -Performed by Snr. Inspector.
Snr. Inspector meets with the Special Inspector to discuss his/her
performance, code requirements and City requirements, and inform
him/her of the potential dismissal from inspecting projects in the City if
he/she continues to be irresponsible.
Step 4.. Fourth occurrence
Dismissal -Performed by the Building Official or the Deputy Building
Official.
The Building Official or the Deputy Building Official, with the assistance of
the City Attorney's Office, notifies the Special Inspector and/or Inspection
Agency, in writing, that the Special Inspector is no longer authorized to
perform special inspection on projects in the City Of Chula Vista. The
special inspector or inspection agency may appeal the decision of the
Building Official or the Deputy Building Official to the Board of Appeals
and Advisors.

1. PURPOSE:
The purpose of this document is to inform special inspectors, inspection agencies, material
testing labs and HERS raters hired for their services on building construction projects in the City
of Chula Vista of building code regulations and City requirements related to special inspection
and testing of construction material.

Prior to the first day a special inspector is scheduled to be on the job site, he/she must do the

NOTE: Design Professional of Record vs Special Inspector. Except for grading, smoke control,
and other specialty inspections for which a certification is not required by law, the fact that a
person is the architect or engineer of record should not be a factor in determining whether the
person is qualified as a Special Inspector. If the architect or engineer is qualified as a Special
Inspector by demonstrating satisfactory competence in a particular type of construction, it is
acceptable for that architect or engineer to perform special inspection on a project.
3. SCOPE OF AUTHORITY:
The special inspector's authority is limited to the extent of providing special inspections for the
types of work in the category in which he/she is certified for.
The special inspector is not authorized to:
A. Inspect or approve any work for which a building permit has not been issued.
B. Infer/inform others that the special inspection is in lieu of City inspection and approval.
C. Accept changes, revisions and substitutions to the approved permitted plans that have not
been approved in writing by the Building Division.
4. DUTIES AND RESPONSIBILITIES:
A. The special inspector shall observe the work assigned far conformance to the approved
permitted design drawings and specification.
B. The special inspector shall verify compliance with the requirements of the California Building
Code and other code related publications pertaining to special inspection. HERS raters shall
verify compliance with the requirements of the California Energy Efficiency Standards.
C. The special inspector shall bring all "discrepancies" to the immediate attention of the
contractor for correction, then if uncorrected, to the Building Inspection Section, the engineer
or architect of record, and the owner. The written report may be submitted by fax or delivered
in person.
D. The special inspector shall submit written inspection reports to the Building Inspection
Section, to the engineer or architect of record and to other designated person(s).
E. Prior to "Final" inspection, the special inspector shall stabmit to the Building Inspection Section
a final signed report (Form 4543 -Special Inspector/Inspection Agency/Testing Laboratory
Final Report) stating that the work requiring special inspection is, to the best of his
knowledge, in conformance to the approved plans and specifications and the applicable
workmanship provisions of the California Building Code.
F. Prior to "Final" inspection, HERS raters shall submit a completed and signed "CERTIFICATE
OF FIELD VERIFICATION AND DIAGNOSTIC TESTING" (CF-4R) to the Building Inspection
Section.

5. SPECIAL INSPECTION AND MATERIAL TEST REPORT
For writing and submitting special inspection reports and for construction materials testing
reports, the following information must be included (not applicable to HERS raters):
A. The building permit number.
B. Street Address
C. Scope ofi work Performed. The reports must clearly and legibly state the scope of work
performed. The reports must also define the area of work inspected/tested by physical
location and/or grid lines, stories, etc., and the type of special inspection/testing performed
at each location.
D. Statement of Compliance. The report must clearly state work performed "was in
compliance with the City approved permitted plans, details and specifications" or "was not
in compliance with the City approved permitted plans, details and specifications".
E. Date & Time. The reports must state the date of inspection and the time of arrival and
departure from the job site. Also the date the material was sampled and the date it was
tested.
F. Reports must be consecutively numbered.
G. Name & Signature with the certification number.
H. Report Submittal Date. The Building Inspection Section and the engineer/architect of
record must receive weekly inspection reports within five (5) calendar days after the date
when special inspection was performed.
The Building Inspection Section must receive material test reports within five (5) calendar
days after the date when testing was performed. A copy of material test reports shall also
be submitted to the architect engineer of record.
I. Deviations When the special inspector becomes aware of a deviation from the Building
Code, the City approved permitted plans and specifications, or the standard construction
practice, he/she shall bring this to the attention of the project superintendent and/or to the
attention of the person responsible for doing the work immediately for corrective action.
If no corrective action is taken the special inspector must report such deviations or non-
compliance to the Building Inspection Section no later than the next business day by
calling and submitting a written report. The written report may be submitted by fax or
delivered in person.
6. FIELD REPORT{S) SHOULD INCLUDE BUT NOT LIMITED TO (EXAMPLE OF DETAILED
REPORTS): (Not applicable to HERS raters)
A. Concrete - Rebar grade, mix design, location of placed concrete, yardage, quantity of

the manufacturers of the materials specified, unless specifically approved by the design
professional of record. Verify that the SFRM is as specified, verify that if primer is

G. High strength bolting -verify type of joint specified (i.e. slip critical, non-slip critical)
bolts, nuts and washers are in compliance to project specifications, installation procedures
meet minimum bolt tensions required by code, faying surfaces are free from dirt. When
applicable, verify bolt tensioning torque with a tensioning device such as the skidmore
Wilhelm at least once a day, once a shift and each time a new batch is opened. Bolts

7. SUB-CONTRACTING AND TESTING:
A. Special inspectors are strictly prohibited from employing, delegating and/or sub-
contracting their services to another special inspector after having been approved by the
Building Inspection Section to work on a project. Substitute Special Inspectors, temporary
or permanent, must be approved by the Building Inspection Section prior to performing
special"inspection.
B. Concrete cylinder test specimen sampling slump test and other field related work
associated with the concrete at the point of truck delivery may be preformed by an ACI-
GRADE 1 field technician, provided: the approved special inspector for concrete is on the
job site when the concrete truck arrives "and" the field technician's work is performed
under supervision of the approved concrete special inspector.
C. All construction materials and test specimen shall be tested by a testing laboratory listed
on the City of San Diego or the City of Los Angeles most current list of approved testing
laboratories. Testing laboratories are permitted to employ, delegate to and or sub-

contract their material testing services to another approved construction materials testing
laboratory.
D. Non-destructive testing of materials are considered to be testing and shall be performed
by qualified/certified technicians employed by and under the approved construction
materials testing laboratories supervision. Laboratories shall be on a current approved list
from the City of San Diego or the City of Los Angeles.
E. Special inspectors are strictly prohibited from performing non-destructive testing or testing
of construction material or assemblies unless they are employed by an approved
construction materials testing laboratory and are properly certified/qualified to perform
such testing:
F. The soils engineer or engineering geologist of record is deemed qualified as a special
inspector for excavation and filling. As an alternative, the soils engineer or engineering
geologist of record may designate another soils engineer or engineering geologist, or a
certified grading inspector, to be the special inspector.
8. CONTINUOUS vs. PERIODIC SPECIAL INSPECTION:
Continuous Special Inspection:
Continuous special inspection means that the special inspector is on site at all times observing
the work requiring special inspection.
Periodic Special Inspection:
Some inspections may be made on a periodic basis and satisfy the requirements of continuous
inspection, provided the periodic scheduled inspection is performed as outlined in the project
plans and specifications and approved by the Building Official.
NOTES:
A. If there is no periodic inspection schedule outlined on the project permitted plans, Special
inspections are required to be performed on a continuous basis.
B. Periodic special inspection will only be permitted to be performed for the types of work
which are allowed by the Building Code to be performed on a periodic basis in lieu of
continuous basis.
C. Periodic special inspections must include initial inspections, inspections of work in
progress in accordance with the schedule outlined in the project plans and final
inspections.
9. SUSPEND OR TERMINATE:
The Building Official or the Deputy Building Official may disqualify a special inspector, inspection
agency, testing lab or HERS rater from working on projects in the City Of Chula Vista when
he/she determines that the special inspector, inspection agency, testing lab or HERS rater is
incompetent or in violation of building code regulations and/or City requirements. A special
inspector, inspection agency, testing lab or HERS rater may appeal the decision of the Building
Official or the Deputy Building Official to the Board of Appeals and Advisors.

I. PROPERTY OWNER'S RESPONSJBILITJES:
The property owner orhis/her authorized agent of record or the architect/eneineer of record acting as the property owner's
agent shall:
1. Complete, sign and execute the 'PROPERTY OWNER/CONTRACTOR AGREEiMENT' form for the special
inspection, off-site fabrication or construction materials testing and submit it to the Planning and Buildino
Department at time of permit issuance. -
2. Employ one or more special inspectors who shall provide inspections during ccnstruction and fabrication of the
types of work requiring special inspection listed under California Building Cade (in the case of HERS raters.
California Enerav Efficiencv Standards) as adopted by the City of Chula Vista, Sec. 1701.5 and listed in the
approved plans/specifications and as required by product manufacturer's approval repcrts. These inspections are
in addition to and not a substitution for the required City inspections.
NOTE: The special inspection shall be performed by a special inspector certified in their areas of expertise.
The construction materials testing shall be performed by a testing laboratory listed on the City of San Diego or the
City of Los Angeles most current list of approved materials testing laboratories.
The same special inspector(s) and the construction materials testing laboratory shall be employed during the
construction of the permitted building/structure to the extent that is possible.
3. Complete, sign, execute the 'PROPERTY OWNER'S FINAL REPORT FOR SPECIAL INSPECTION, AND
CONSTRUCTION MATERIALS TESTING' form and submit it to the Building Inspection Section prior to
requesting a final inspection.
This final report states that all work requiring special inspection, testing, or off-site fabrication was to the best of
his/her knowledge, performed in accordance with the approved plans, specifications and the applicable
workmanship provisions of the California Building Cede (in the case of HERS raters California Enerav Efficiencv
Standards) as adopted by the City of Chula Vista
4. Remove and replace, repair, test and inspect all non-conforming work as proposed by the architect/engineer of
record and as approved by the City of Chula Vista without any cost to this jurisdiction.

3. Make available to the special inspector(s) and the testine acency access to the acprcved plans and specfications

NOTE: The fabricator of the building components shall be currently certified by ICBO, AISC, ACI, PCI, PTI cr
other recognized and approved certirying agencies. For non-certified fabricators, or when required per the
approved permitted plans and or specifications, one or more approved certified special inspectors shall be
assigned by the building owner when approved by the City of Chula Vista
8. Furnish the 'Certificate of Compliance for Off-Site Fabrica'tion' form to the fabricatcr(s) of buildine components to
be completed and submitted to the Building Inspection Section.
9. Keep a copy of all special inspection/test reports submitted by the special inspector and/the construction materials
testing laboratory at the job site. A copy of such reports shall be submitted to the Building Division Inspection
Section.
10. Correct all deficient and/ornon-conforming work as noted by the special inspector/construction materials testing
laboratory in accordance with the approved permitted plans and specifications.

Subject: Code Enforcement Strategic Plan Summary
The following is a summary of the major findings and recommendations from the
Department of Planning and Building's internal Code Enforcement Strategic Plan.
INTRODUCTION:
The plan was developed in response to concerns expressed by residents, City Council and
members of various Boards and Commissions regarding a perceived lack of attention to
code enforcement throughout the City. While initially focused on the activities of the Code
Enforcement Section of the Building Division, it soon became apparent that a much more
comprehensive citywide team approach would be required in order to achieve any
significant improvements in this arena. The Plan was prepared in a traditional format that
included:
? mission and value statements
? a history of the program
? a review of the existing setting
? an analysis of the strengths, weaknesses, opportunities and threats associated
with the program
? comparisons with otherjurisdictions
? a summary of program improvements
? a propQSed organizational framework for the future
? a proposed code enforcement program action plan based on a "balanced
scorecard" approach
? a recommended action plan that phases in the addition of the new staff that will
be required to implement the proposed programs
MISSION AND VALUES:
The code enforcement program's mission is to protect the health, safety and property
values of our residences and businesses through the enforcement of codes and
regulations. The program focuses on voluntary compliance, however, when warranted,
formal enforcement action is taken as quickly as possible. Wherever possible, the

program's costs will be borne by the property owners who have created the code -
violations or have otherwise created the need for periodic inspections.
BACKGROUND:
The City's Code Enforcement Program has experienced many changes over the last
fifteen years. In the early 1990s the program included many proactive projects designed
to partner with the community to achieve long-term compliance. In the mid-1990s the
entire program was virtually disbanded due to required budget cuts. The program is now
back to a staffing level similar to 1990, however, since 1990 the City has added 60,000
residents and the quality of life in some of our older portions of the community has
suffered, at least partially, as a result of inadequate code enforcement attention during the
interim.
EXISTING SETTING:
Since the mid-1990s the Code Enforcement program has been nearly entirely based on
reacting to specific complaints from residents. A notable exception has been the highly
successful inoperable vehicle abatement program. This program abates approximately
1,000 vehicles per year from private property and is evenly split between proactive
enforcement and complaint responses. The other major components of our existing
reactive program include responding to complaints of Housing Code violations,
investigating Zoning violations, abating dangerous building, abating public nuisances and
resolving construction without permit violations.
Staff responds to complaints based on a priority system that reflects the seriousness of
the violation. Complaints regarding potentially serious health and life safety violations are
responded to as quickly as possible, while some other, less critical violations, may only
receive a letter urging compliance and no field investigation.
SITUATION ANALYSIS:
An evaluation of the program's strengths, weaknesses, opportunities and threats
revealed an overall picture that suggests the existing program is performing well underthe
circumstances, however, it is not meeting the community's expectations. Findings include:
? Current staff is highly motivated but lacks experience
? Staffing levels are significantly below comparable cities
? The existing Zoning Ordinance needs to be modified to facilitate enforcement
? The roles and responsibilities of key staff members need to be better defined
? The Permits Plus system can be better utilized to automate the enforcement
process
? Cost recovery opportunities are not being fully utilized
? Code Enforcement as a interdepartmental team approach is gaining support
? A proactive code enforcement program is a worthwhile goal
? Access to the General Fund for program enhancements may be very limited
? Community support for more aggressive enforcement needs to be confirmed

COMPARISONS WITH OTHER JURISDICTIONS:
The lack of proactive enforcement and failure to provide field responses to some types of
complaints has been criticized in the past as being inadequate to meet the community's
needs. As part of responding to this criticism, staff performed several comparison studies
of other jurisdictions throughout the country. The results of the studies revealed that
Chula Vista's program achieves above-average performance levels, however, the City's
program is funded and staffed at a level significantly below the average for communities
our size. The International City Managers Association (ICMA) study revealed our per
capita spending on code enforcement was $2.16 versus the average of $5.39 per capita
forjurisdictionsnur size. A staffing level comparison with similarjurisdictions in California
also indicted that Chula Vista's staffing ratio was significantly below comparable
jurisdictions. Chula Vista's staffing ratio of 4.2/100,000 population was compared to
jurisdictions such as Oceanside (7.9), Oxnard (7.8), Santa Ana (11.7) and Long Beach
(10.0). Adding the additional staff recommended in the Strategic Plan will increase Chula
Vista's staff ratio to a level of (7.7/100,000).
RECENT PROGRAM IMPROVEMENTS:
Staff has recently implemented several program changes in an effort to address known
deficiencies in the program. Examples of recent improvements include:
? Creation of a Code Enforcement Advisory Group consisting of top level
managers and staff from Building, Planning, Community Development, City
Attorney Office and the Police Department. The Group meets bi-monthly to
address both program and individual case issues.
? Creation of weekly status reports on high profile code enforcement cases.
These cases are subsequently discussed at the Advisory Group meetings and
copied to the Assistant City Manager.
? Formal procedures have been drafted to facilitate use of innovative code
enforcement methods and to achieve greater cost recovery.
? The Permits Plus system has been enhanced to provide detailed case tracking
information and to generate routine code enforcement correspondence.
? The role of code enforcement has been integrated into several citywide
programs including the Broadway Revitalization Program, Motel Inspection
Program, General Plan Update and special COPPS initiatives.
PROPOSED ORGANIZATIONAL FRAMEWORK
Developing the Code Enforcement Strategic Plan also revealed that many issues
previously identified as being primarily a code enforcement problem were, in fact, issues
that could only be resolved through a concentrated interdepartmental team effort.
Therefore the Plan also includes clarification of roles and responsibilities for staff within
both the Code Enforcement Division and other Departments. A key to the program's
success will be development of an annual Overall Work Program. Development of this

Program will be the responsibility of the Building Official. Responsibility for -
implementation of the Plan will primarily be assigned to the Code Enforcement Manager.
The Code Enforcement Manager, working with the two Sr. Code Enforcement Officers and
representatives from other Departments, will provide periodic status reports to the Code
Enforcement Advisory Group to help insure the Program is being implemented.
PROPOSED CODE ENFORCEMENT PROGRAM ACTION PLAN
Determining specific recommendations for inclusion in the action plan first required
establishing evaluation criteria. Staff selected a "Balanced Scorecard" approach that
evaluated the range of possible actions from four perspectives. This "Balanced
Scorecard" approach was chosen because it proved to be very useful in preparing the
recently completed Business Plan for the Department of Planning and Building. The four
perspectives evaluated for the Code Enforcement Action Plan included:
? Our community-at-large
? Our individual customers (focusing on both complainants and alleged violators)
? Our managers (focusing on internal processes); and
? Our employees.
Community-Oriented Initiatives
Community-Oriented Code Enforcement Program (Beat Program) -Modeled after other
successful programs, this program is based on assigning Code Enforcement Officers to
geographic areas (beats). The Program will encourage the Officers to interact with
residents and business owners in their assigned area to establish proactive code
enforcement programs that will be crafted to meet the specific. needs of the people with
that area.
Multi-family Housing and Motel Inspection Program -Preserving affordable housing is
critical in Chula Vista. The current program only responds to complaints, as such, it fails to
give the City an accurate picture of the actual condition of our apartments. Fear of
eviction in a tight rental market is often cited as the reason apartment tenants are reluctant
to file code enforcement complaints. This proposed program would establish a proactive
inspection program that will inspect each apartment or motel site approximately every
three years. The exterior of all sites will be inspected and approximately 10% of the units
will undergo an interior inspection. This program will help identify and correct those
properties where the units are not being maintained in compliance with the State Housing
Law.
Mobile Home Park "Title 25"Inspection Program -The City of Chula Vista has for many
years assumed responsibility for confirming compliance with the State's Mobile Home Park
Act (Title 25). For the last five years the City has only responded to specific complaints.
This new program will establish periodic inspections of all of the City's mobile home parks
(32 parks). Anew Senior Code Enforcement Officer has been hired to develop and
implement this program.

Mobile Home Park Rent Review Ordinance Inspection Program -This new program is in
response to recent action by Council. It is designed to insure that rent increases for
mobile home spaces do not exceed a designated threshold unless Code Enforcement
staff has confirmed that the park meets all minimum fire and life safety standards. This
program will also be under the supervision of the new Sr. Code Enforcement Officer.
Community Housing Improvement Program -This program is administered by Community
Development and is designed to assist individual homeowners in rehabilitating their
properties through grants and low-interest loans. The new Sr. Code Enforcement Officer
will provide technical field assistance to support this program.
Broadway Revitalization Program -The City has begun an effort to revitalize the Broadway
business corridor. Code Enforcement staff will be participants in the planning and
implementation of the redevelopment strategies for this program. The designated beat
officer for this area will be a key liaison with the community in soliciting suggestions and
establishing partnerships.
Community Oriented Policing and Problem Solving (COPPS) -For several years the
interdepartmental COPPS team has focused on developing innovative ways of
approaching major community problems. Code Enforcement staff has traditionally been a
contributor to the group's efforts, but limited staff resources have restricted Code
Enforcement's role in recent years. Increasing staff, as is being proposed in this plan, will
facilitate a much greater commitment to the goals of the COPPS program. Currently the
COPPS group is co-chaired by the Community Relations Police Sergeant and the Building
Official. The group's current areas of focus include the Motel Inspection Program and
enhancements to the Graffiti Abatement Program.
Community Education Program -Many of the violations observed by code enforcement
staff arise from property owner's lack of familiarity with Chula Vista's regulations. Most
code enforcement complaints are resolved voluntarily once the property owner has been
made aware of the City's requirements. Expanding the community education program will
acquaint more residents with our requirements and thereby help prevent future violations.
Converting existing educational materials into a Spanish format will be a very high priority
for this program.
Conditional Use Permit Inspection Program -Conditions imposed on use permits are
intended to reduce or eliminate situations that may adversely impact adjacent businesses
or the community-at-large. Current staff levels do not permit periodic inspection of sites
having CUPS and therefore compliance with the established conditions is not monitored.
This program will include an inspection component that verifies compliance with conditions
for all new CUPS.
Property Maintenance Program - Many of the complaints received by Code Enforcement
focus on property maintenance issues that are often not covered by existing language in
our Municipal Code. Examples include deteriorated paint or lack of landscaping. A long-

term goal is to review and potentially adopt a comprehensive property maintenance code. -
Adopting such a code would give staff the legal tools necessary to allow them to identify
and correct problems before they reach the status of a serious public nuisance.
New Business Inspection Program -Our existing Business License Program includes a
counter review of the application to confirm compatibility with Zoning requirements,
however, no field verification is performed. This program would include a field verification
inspection. Staff feels that many of the business related complaints they receive could
have been avoided if the business owner was made more fully aware of the City's
regulations at the time that they first opened.
Customer -Oriented Initiatives
Customer Service Policies and Procedures -Meeting customer expectations is critical to
the success of the overall program. To those filing complaints, they want to know that
their complaint is being treated seriously and that it will be addressed in a timely manner.
Alleged violators expect to be treated in a reasonable manner and that they will be
afforded all appropriate access to due process. Establishing comprehensive policies and
procedures will help insure that these customer expectations are met. Developing and
monitoring conformance with these policies and procedures will be the primary
responsibility of the Code Enforcement Manager and the first-line code enforcement
supervisors.
Mediation Program -Many of the complaints received by Code Enforcement begin as
neighbor disputes that have little citywide significance. These types of cases have
traditionally been extremely time-consuming for staff to resolve. Mediation is a method
that may assist all parties in resolving these types of complaints quickly and amicably.
The Plan proposes to expand the use of mediation as a code enforcement method and
identify the City as a sponsor of the mediation process.
Process-Oriented Initiatives
Workload Management System -Receiving thousands of complaints, scheduling
inspections, distributing correspondence, tracking case status, and monitoring cost
recovery efforts present significant workload management challenges. This program will
focus attention on developing a comprehensive workload management system that will
track time for cost recovery, report on compliance with established program performance
standards, and verify progress on achieving the goals identified in the annual Overall Work
Program.
Case Management and Tracking System -The Permits Plus System has proven to be a
very effective tool in managing the building permit process. While Code Enforcement is
also using the same system, it is being underutilized. This program will expand the use of
Permits Plus to automate existing processes and to initiate new programs. These new
programs would include the Housing Inspection Program, the Mobile Home Park
Inspection Program and the Business License Inspection Program. Eventuallythe system

will also be expanded to allow the Code Enforcement Officers to use handheld computers -
inthe field; a program similarto what is being used by building inspection staff atthis time.
Zoning Code Update -The City's Zoning Code is antiquated and difficult to enforce.
Partnering with Planning and the City Attorney, Code Enforcement will work to update the
provisions of the code to clarify intent and to eliminate outdated requirements. This
process typically takes several years and will likely not be initiated until the General Plan
Update is near completion.
Employee-Oriented Initiatives
CareerDevelopment and Staff Training Program -Attracting and retaining qualified code
enforcement staff has proven to be difficult over the last several years. This program is
intended to provide opportunities for existing staff in other sections and departments to
transfer or promote to positions in code enforcement. One of the ways in which this will be
accomplished it by creating a new classification, Code Enforcement Technician, that will
be a trainee position and have split duties between performing office research
assignments and field work on minor code enforcement violations. This program is also
intended to provide an attractive career ladder for current code enforcement staff as a way
of encouraging them to remain and advance within the program.
Staff Recognition Program -The Department will develop a program that recognizes the
significant accomplishments and excellent customer service provided by the Code
Enforcement Section.
ACTION PLAN
Revised FY 2002-03 Staff Plan
Since adoption of the current budget, Council has approved the addition of a Sr. Code
Enforcement Officer to supervise and implement the Mobile Home Park Inspection
programs and to assistwith the CHIPS program. The Department is also proposing to re-
institute aproactive Housing/Motel Inspection program. This change will result in a better
alignment of staff resources with the funding sources designated to support the program.
The change, however, will necessitate reassigning a Code Enforcement Officer from
general complaint response to primarily working on the Housing/Motel Inspection
Program. We anticipate this action will decrease the City's overall responsiveness to
general code enforcement complaints.
Phase 1 Enhancements
The first phase of the expanded code enforcement program consists of adding two (2)
Code Enforcement Officers and one (1) Code Enforcement Technician. One of these
additional positions will be assigned to the Housing Inspection Program in order to
increase the frequency of periodic inspections from approximately every 9 to 10 years to a
frequency of approximately every 3 years. The other positions will be assigned to respond

to general code enforcement complaints and will represent the initial step inestablishing a -
citywide "beat" program.
Phase 2 Enhancements
The second phase of the expanded code enforcement program will include adding two (2)
additional Code Enforcement Officers and two (2) Code Enforcement Technicians.
These new positions will be assigned responsibilities in the general code enforcement
"beat" program, developing the community education program, establishing a property
maintenance program, performing inspections on new businesses, developing the
mediation program and continuing to enhance our customer service policies and
procedures program.
The Department of Planning and Building is scheduled to present an overview ofthe Code
Enforcement Strategic Plan to City Council during a workshop tentatively scheduled for
January 16, 2003. Assuming City Council endorses the overall direction of the proposed
program, staff will prepare amid-year budget adjustment to reflect the Phase 1
enhancements, along with proposals for funding the additional positions. Phase 2
enhancements will be included in the Department's budget proposal for FY 2003-04.

Assistant Director Remp also expressed his appreciation to Deputy Building
Official EI-Khazen for his hard work in preparing the items for Council approval
and submittal to the State.
Proposed ordinance changes were discussed. Suggestions for language
changes were noted. Changes will be made.
