Adoption of the various 2001 Editions of the California Codes is a routine action undertaken by the Planning
and Building Department every three years in response to newly published Codes. The adoption of these
Codes is in conformance with City Council Policy 500-04 as adopted by Resolution 5656 which endorses the
establishment and maintenance of uniform building regulations within the jurisdictions of the County of San
Diego.

Jurisdictions within San Diego County have met collectively to discuss suggested modifications to the codes
during monthly meetings of the San Diego Area Chapter of the International Conference of Building Officials.
As such, this process recognizes and promotes code uniformity throughout the jurisdictions within the County
creating a positive professional environment among all code users.

THE CITY COUNCIL OF THE CITY OF CHULA VISTA DOES ORDAIN AS FOLLOWS:

There is hereby adopted by reference the California Building Code, known as the Califomia Code of
. Regulations, Title 24 part 2 ,and Appendix Chapter 3,
Division II; Appendix Chapter 15; ;Appendix Chapter 31, Division II and Division
III of that certain document as copyrighted by the International Conference of Building Officials, and the
California Building Standards Commission. Chapter 11, Accessibility is hereby exempted. Said document is
hereby adopted as the Building Code of the City of Chula Vista for regulating the erection, constmction,
enlargement, alteration, repair, moving, demolition, conversion, occupancy, use, height, and area of all
buildings and stmctures in the City. Providing for the issuance of pernuts and collection of fees therefor and
each and all such regulations, provisions, penalties, conditions and terms of the Uniferni California Building
Code, -19}7 2001 Edition, and Appendix Chapter 3, Division R; Appendix Chapter 15; Appendix Table A-29-
A; Appendix Chapter 31, Division II and Division III are hereby referred to, adopted, and made a part hereof
as though fully set forth herein, excepting such portions as are hereinafter deleted, modified, or amended.

Subsection Seetiea 104.2.1 of the i33ci€erm Califomia Building Code, as it applies in the City of Chula
Vista, is hereby amended to read as follows:
Subsection Seetian 104.2.1 General. The building official is hereby authorized and directed to enforce
all the provisions of this code. For such purposes the building official shall have the powers of a law
enforcement officer.
The building official shall have the power to render interpretarions of this code and to adopt and
enforce rules and regulafions supplemental to this code as may be deemed necessary in order to clarify the
application of the provisions of this code. Such interpretations, roles and regulations shall be in conformity
with the intent and purpose of this code. The building official shall be the assistant director of planning and
building.
15.08.030 Subsection 105.1 -Board of Appeals and Advisors Gaon-?0~? amended to confer

Subsection $eetien 105.1 of the F3ni€enn California Building Code, as it applies in the City of Chula
Vista, is hereby amended to read as follows:
Subsection Seetien 105.1 Board of Appeals and Advisors. To determine the suitability of alternate
materials, methods of constrncrion and to provide for reasonable interpretation of the provisions of this code,
there shall be and is hereby created a Board of Appeals and Advisors consisting of seven members who are
qualified by experience and training to pass upon matters pertaining to building constmction. The building
official shall be an ex-officio member who shall not be entitled to vote and who shall act as Secretary to the
Board. The Board of Appeals and Advisors shall be appointed by the Mayor and confirmed by the City
Council. The Board shall render all decisions and fmdings in writing to the building official with a duplicate
copy to the appellant. The decision of the Board is final. The Boazd of Appeals and Advisors shall
recommend to the City Council such new legislation deemed necessary to govern construction hr the City of
Chula Vista.

15.08.040 Exempted Work-Section 106.2 is amended to delete exemptions for certain types of
construction from the requirement to obtain a building permit.
Subsection Seetien 106.2 of the 13rv€er~rrt California Building Code as it applies in Chula Vista shall
read as follows:
Subsecton Seetiea 106.2 EXEMPTED WORK. No person, firm, or corporation shall erect, constmct,
enlarge, alter, repair, move, improve, remove, convert, or demolish any building or structure in the city of
Chula Vista or.cause the same to be done without first obtaining a sepazate building permit for each such
building or stucture from the building official except as follows:

A. Fences up to seventy-two inches and free standing masonry walls up to forty-eight inches in height
above the highest adjacent grade.
B. Detached patio covers, not exceeding twelve feet in height, with a projected roof area not to exceed
one-hundred forty-four square feet and at least six feet from any building or stmcture on the same
property.
C. One-story detached accessory buildings, not exceeding twelve feet in height used as tool and storage
sheds, playhouses and similar uses, provided the floor area does not exceed one-hundred forty-four
square feet and are located so as to comply with the provisions of Chula Vista Municipal Code, Section
19.58.020.
D. Oil demcks.
E. Movable cases, counters, and partitions not over five feet, nine inches in height.
F. Retaining walls which are not over three feet in height measured from the top of the footing to the top
of the wall, unless supporting a surcharge or impounding flammable liquids.
G. Television and radio antennas less thanthirty-five feet in height.
H. Awnings projecting not more than fifty-four inches and attached to, and supported by, the exterior
walls of buildings of Group R-3, Division 3 or U Occupancy.
I. Platforms, walks and driveways not more than thirty inches above grade and not over any basement or
story below.
J. Temporary motion picture, television and theater stage sets and scenery.
K. Prefabricated swimming pools accessory to a Group R, Division 3 Occupancy in which the pool walls
aze entirely above the adjacent grade and if the capacity does not exceed five-thousand gallons.
L. Fish ponds, reflective pools or other decorative water containers with a wet surface area ofone-hundred
squaze feet or less and a maximum depth of eighteen inches to the flood rim.
M. Repairs which involve only the replacement of component parts of existing work with similar materials
for the purpose of maintenance, and which do not aggregate over $500.00 in valuation in any twelve-
month period, and do not affect any electrical, plumbing or mechanical installations. Repairs exempt
from pemut requirements shall not include any addition, change, or modification in construction, exit
facilities, or permanent fixtures or equipment.
Specifically exempted from permit requirements without limit to valuation are:
1. Painting, papering, decorating and sixnilaz work.
2. Installafion of floor covering.
3. Cabinet work.
4. Outside paving of R-3 and U Occupancies parking surfaces. (CCR Title 24 Disabled Access
Required.)
5. Re-roofmg buildings of Group R and U Occupancies of less than five-hundred squaze feet or less
than fifty percent of roof covering replacement.

This section shall not be constmed to require separate building pernuts for dwelling and accessory
buildings or stmctures on the same property which are described in the building pemut application, plot plan
and other drawings.
Exemption from the permit requirements of this code shall not be deemed to grant authorization for any
work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of
the City of Chula Vista.
15.08.041 Subsection 107.2 amended -Permit fees.

Subsection 107.2 Pem~it Fees. Pemut fees shall be as svecified in the Master Fee Schedule of the
City of Chula Vista.

Subsection Seeaor~304(ej 107.3 Plan Review Fees. When a plan or other data are required to be
submitted by Seeavw02~j Subsection 106.3.2, a plan review fee shall be paid at the time of submitting
plans and specification for review. Said plan review shall be as specified in the Master Fee Schedule.

inspections.

as it applies in Chula Vista, and said subsection (h) shall read as follows:
Subsection Seetian 198,1:1- 108.1.2 Compliance Survey Inspection. Upon receipt of a written request
for a compliance survey from the owner and payment of the fee specified in the master fee schedule, the
building official may inspect an existing stmcture to ascertain its compliance with the provisions of this code
and other applicable laws and ordinances, and report findings in writing to the owner.

15.08.070 Subsection 709.4.1 amended to add an exception to the requirement for parapets. -
Exception 6 is hereby added to oaf Subsecfion 709.4.1 of the 8ui€eau California Building
Code, as it applies in Chula Vista, which EXCEPTION 6 shall read as follows:
Excepfion 6. Conversion of existing Group R occupancies to offices.
15.08.080 Subsection 904.2.1 amended to require installation of automatic fire-extinguishing system in
buildings greater than certain height.
Subsection 904.2.1 of the ~3ni€ertu California Building Code is hereby amended, as it applies in Chula
Vista, by the addition of the following:
In every building regardless of occupancy, group or type of constmction, when such building is more
than forty feet or four stories or more in height.
15.08.090 Section 1503 amended to provide for more restrictive roof coverings.
Section 1503 of the F}ai€a~tn California Building Code as it applied in Chula Vista is amended as
follows:
Section 1503. The roof covering on any structure regulated by this code shall be as specified in Table
No. 15-A and as classified in Section 1504. Wood shingles and wood shakes shall have a minimum Class "C"
fne-resistive rating.
15.08.100 Subsection 1511.5 added to Section 1511 to require equipment enclosures on roofs.
Subsection 1511.5 is hereby added to Section 1511 of the 8ni€ean California Building Code, as it
applies in Chula Vista, which subsection 1511.5 shall read as follows:
Subsection $eetiea 1511.5 Equipment Enclosure. Operating equipment, including piping and ducts
located on the roof of a building, shall be shielded from view from public thoroughfares, private and public
parking lots. Equipment enclosures shall not be constructed so as to trap flammable or combustible vapors.
Exception: Solar collectors. Does not include stmctural supporting members.
SECTION II. FINDINGS AND DECLARATION
The City Council of the City of Chula Vista specifically and expressly fords and declares that each of the
amendments noted above to the 2001 Edition of the California Building Code is necessary due to local
climatic, geological and topographical conditions.
SECTION III. ENVIRONMENTAL IMPACT.
The Environmental Review Coordinator has reviewed the proposed activity for compliance with the
California Environmental Quality Act (CEQA) and has determined that the activity is not a "Project" as
defined under Section 15378 of the State CEQA Guidelines; therefore, pursuant to Section 15060(c)(3) of
the State CEQA Guidelines the activity is not subject to CEQA. Thus, no environmental review is
necessary.

SECTION IV. EFFECTIVE DATE.
This ordinance will take effect and be in force on November 1, 2002.

Electrical Code, 199& 2001 Edition, known as the California Code of Regulations Title 24, Part 3, and

inekrding the Uniform Administrative Code Provisions for the Naflonal Electrical Code, 1996 Edition as
published by the International Conference of Buildmg Officials. Said documents are hereby adopted as the
Electrical Code of the City of Chula Vista, California regulating the installation, repair, operation and
maintenance of all electrical wiring and electrical apparatus of any nature whatsoever, whether inside or
outside of any building, and issuance of permits and providing for the inspecfion thereof.
15.24.015 Subsection 283Ex) 203.1 of the Uniform Administrative Code Provisions for the National
Electrical Code amended -Board of Appeals and Advisors.
Subsection (a} of Seefien 2&3 203.1 of the Uniform Administrative Code Provisions for the National
Elechical Code is amended to designate the Board of Appeals and Advisors as the Boazd of Appeals.
In order to hear and decide appeals of orders, decisions or detemrina6ons made by the Building Official
relative to the application and interpretations of this code, there shall be and is hereby created a Board of
Appeals and Advisors consisting of seven members who aze qualified by experience and training to pass upon
matters pertaining to electrical aspects of constmction. The building official shall be an ex-officio member
who shall not be entitled to vote and who shall act as secretary to the Boazd. The Board of Appeals and
Advisors shall be appointed by the city council from the qualified electors of the City in accordance with the
provisions of Section 600 et seq. of the Charter. The Board shall render all decisions and fmdings in writing
to the building official with a duplicate copy to the appellant. The decision of the Boazd is fmal. The Boazd
of Appeals and Advisors shall recommend to the city council such new legislation deemed necessary to
govern electrical aspects of construction in the City of Chula Vista.
15.24.020 Subsection 281{aj 201.1 of the Uniform Administrative Code Provisions for the National
Electrical Code amended -Enforcement authority- Powers and duties of the Building
Official.

Electrical Code amended as it applies in Chula Vista shall read as follows:
Subsection Sys°~Ohaj 201.1- General. It shall be the duty of the building official to enforce the
provisions of this code. The building official shall be the Assistant Director of Planning and Building. For
such purposes, the Building Official shall have the powers of a law enforcement officer.
The Buildine Official shall have the power to render interpretations of this code and to adopt and
enforce rules and reeulations supplemental to this code as may be deemed necessary in order to clarify the
application of the provisions of this code. Such interpretatons, rules and reQUlations shall be in confomuty
with the intent and puumose of this code.

Subsection 304(aj 304.1 of Section 304, Fees, of the Uniform Administrative Code Provisions for the
National Electrical Code, as it applies in Chula Vista, shall read as follows:

15.24.035 Previously used materials.
Previously used materials shall not be reused in any work without approval by the building official or
an authorized deputy.
15.24.045 Distribution panels -Separate required when.
Each store in a store building, each flat in a flat building, and each building used as a dwelling shall be
so wired that each store, apartment, flat or dwelling shall have separate lighting and/or power distribution
panels. Such panels shall not serve other portions of the building. Hotels, motels, hotel apartments and
similar types of buildings may be wired from one or more distribution panels.
15.24.050 Circuit cards to be posted when.
When requested by the building official, a complete schedule of circuits showing the number, Mnd and
capacity of each outlet on each circuit shall be posted on each job prior to rough inspection.
15.24.055 Electric fences - Detined -Prohibited.
A. As used herein, the term elechic fence includes all fences which in any way use electrical energy as an
additional deterrent or have wires charged with electricity which .are not covered with adequate
insulation to protect persons and animals coming in contact therewith.
B. No electric fence maybe constructed, maintained or operated within the city.
15.24.060 Phase Arrangement -Amended.
Section 384-3(f) of the '
^^-~~~ra:a~l California Electrical Code is hereby amended to read:
Phase Arrangement. The phase arrangement on three-phase buses shall be A, B, C from front to back,
top to bottom, or left to right, as viewed from the front of the switchboard or panelboazd. The C phase shall
be that phase having the higher voltage ground on three-phase, four-wire delta-connected systems. Other
busbaz arrangements may be permitted for additions to existing installations and shall be marked.
SECTION II. FINDINGS AND DECLARATION
The City Council of the City of Chula Vista specifically and expressly fords and declazes that each of the
amendments noted above to the 2001 Edition of the California Electrical Code is necessary due to local

California Environmental Quality Act (CEQA) and has detemuned that the activity is not a "Project' as
defined under Section 15378 of the State CEQA Guidelines; therefore, pursuant to Section 15060(c)(3) of the
State CEQA Guidelines the activity is not subject to CEQA. Thus, no environmental review is necessary.
SECTION III. EFFECTIVE DATE.

15.16.020 Subsection Seetian 108.1 amended to designate building official.
Subsection Seetiea 108.1 of the F3aifexn California Mechanical Code, as it applies in Chula Vista,
shall read as follows:
Subsection Seetien 108.1 -General. The building official is hereby authorized and drrected to enforce
all the provisions of this code. For such purposes the building official shall have the powers of a law
enforcement officer.
The building official shall have the power to render interpretations of this code and to adopt and
enforce rules and regulations supplemental to this code as may be deemed necessary in order to clarify the
application of the provisions of this code. Such interpretations, rules and regulations shall be in confomrity
with the intent and purpose of this code. The building official, herein referenced, shall be the assistant director
of planning and building.
15.16.030 Subsection Seetien 110.1 amended to confer suitability of alternate materials jurisdiction on
board of appeals.
Subsection Seetien 110.1 of the I3nifernt California Mechanical Code, as it applies in Chula Vista,
shall read as follows:
Subsection Seetien 110.1 -Board of Appeals and Advisors. To determine the suitability of alternate
materials, methods of constrnction and to provide for reasonable interpretation of the provisions of this code,
there shall be and is hereby created a board of appeals and advisors consisting of seven members who are
qualified by experience and training to pass upon matters pertaining to mechanical design, constmc5on and
maintenance and the public health aspects of mechanical systems and who are not employees of the
jurisdiction. The building official shall be an ex-officio member who shall not be entitled to vote and who
shall act as secretary to the board. The board shall be appointed by the mayor and confirmed by the city
council. The board shall render all decisions and findings in writing to the building official a duplicate copy
to the appellant. The decision of the board is final.
15.16.040 Subsection 115.1 amended to specify local fee structure.
Subsection 115.1 of Section 115 of the ~ California Mechanical Code, as it applies in Chula

Subsection $eetien 103.4.4 Investigation Fees.
Subsection 103.4.4.1 Whenever any work for which a pemut is required by this code has been
commenced without fast obtaining said pemrit, a special investigation shall be made before a pernut
maybe issued for such work.
Subsection 103.4.4.2 An investigation fee, in addiflon to the permit fee, shall be collected
whether or not a permit is then or subsequently issued. The investigation fee shall be equal to the
amount of the permit fee that would be required by this code if a permit were to be issued. The
payment of such investigation fee shall not exempt any person from compliance with all other
provisions of this code, nor from any penalty prescribed by law.
Subsection 103.4.4.3 This provision shall not apply to emergency work when it shall be proven
to the satisfaction of the administrative authority that such work was urgently necessary and that it was
not practical to obtain a pemut before commencement of the work. In all such cases, a permit must be
obtained as soon as it is practical to do so, and if there be an unreasonable delay in obtaining such
pemrit, the investigation fee as herein provided for shall be charged.
15.28.050 Subsection Seetien 103.5.6 amended to reference the city's master fee schedule.
Section 103.5.6 of the 4S r Califomia Plumbine Code, as it applies in Chula Vista, shall read as
follows:
Subsection $eetiett 103.5.6 Reinspections. A reinspection fee may be assessed for each
inspection or reinspection when such portion of work for which inspection is called is not completed or
when required corrections have not been made.
This provision is not to be interpreted as requiring reinspection fees the first time a job is rejected
for failure to comply with the requirements of this code, but as controlling the practice of calling for
inspections before the job is ready for inspection or reinspection.
Reinspection fees may be assessed when the approved plans are not readily available to the
inspector, for failure to provide access on the date for which the inspection is required, or for deviating
from plans requiring the approval of the administrative authority.
To obtain a re-inspection, the applicant shall file an application in writing upon the form famished -
for that propose and pay the re-inspection fee in accordance with the master fee schedule of the city of
Chula Vista.
In instances where reinspection fees have been assessed, no additional inspection of the work will
be pexforxned until the required fees have been paid.
15.28.060 Subsection 413.01 added to specify types of facilities mandated by State law to comply with
the requirements of Section 413.
Subsecton 413.01 of the California Plumbing Code, as it applies in Chula Vista, shall read as follows:
Subsection 413.01 The requirements of Section 413 shall apuly to the followine types of facilities as listed
below:
a. Facilities where the public conereeates such as stadiums, convention centers, community and
commercial halls, sports and entertainment arenas, specialty event centers, amusement facilities and
other similar facilities shall comply only with the requirements of Table 4-1.
b. Facilities under the authority of the Office of Statewide Health Plannin¢ and Development (OSHPD 3),
Licensed Clinics, that are reeulated by the local authority shall comply with Subsections adopted by
OSHPD3.
c. Fox all other types of facilities, the requirements of Section 413 do not apply. Such facilities must
comply with the requirements of Chapter 29 of the California Buildine Code and local health codes.
SECTION II. FINDINGS AND DECLARATION
The City Council of the City of Chula Vista specifically and expressly fmds and declares that each of the
amendments noted above to the 2001 Edition of the California Plumbing Code is necessary due to local
climatic, geological and topographical conditions.

Election of officers was deferred until end of meeting.
4. CHAIRMAN'S COMMENTS/REPORT:
A. Landscaping Inspections on Commercial Projects
Chairman O'Neill asked if a landscape architect does final inspections on
commercial projects. Asst. Director Remp informed him that building inspectors
do not do the inspections. His understanding is that the landscape planner
accepts a certificate from the landscape architect who designed it to confirm that
it was done. The building inspector sends a notice to planning five days in
advance of the anticipated final inspection to give the landscape planner the
opportunity to confirm that the landscaping has been done.
5. BUILDING OFFICIAL'S COMMENTS/REPORT: +
A. Code Adoption Schedule
Asst. Director Remp introduced Deputy Building Official Lou EI-Khazen, who is
heading up the code adoption process. DBO EI-Khazen stated that the effective
date for the new code adoption is November 2, 2002. He went over the
deadlines for various staff members for the code adoption process. The draft
agenda packet will be available for the Board of Appeals members at the August
12 meeting for endorsement. The first Council hearing will be September 10.
Board Member Ehm asked if the board members could have the packet prior to
the August 12 meeting so they would have time to review it prior to the meeting.
It was agreed that the packet. would be available to the Board Members
approximately two weeks prior to the August 12 meeting.
B. Code Enforcement Program Update
Asst. Director Remp introduced CE Manager Gray. Code Enforcement is
reinstituting the- housing program. It has been on hold for approximately three
years, and prior to that was done on a minimal level. The policies and
I procedures on the program have been rewritten. The housing program covers
apartments with three or more units, hotels, and motels. A housing permit fee is
collected and inspections are done on those properties. The plan is to inspect
every housing complex within three to five years and continue to follow up on
complaints received on individual units.

The first round of inspections will be exterior only unless the City has received
numerous complaints on a property. Hotel/motel spot checks of interior rooms
will be done. One staff person has been transferred from our general code
enforcement complaints to the housing program. This person will also be
participating in the Community Oriented Policing and Problem Solving (COPPS)
hotel/motel program. The Broadway revitalization plan by Community
Development will also influence, to an extent, what is done in the housing
program.
The code enforcement staffing will then consist of one person doing the housing
program, one person doing Abandoned Vehicle Abatement, and two staff
members covering the rest of the city for complaints.
C. PEX Piping Continued Approval
Building Standards Commission adopted the plumbing code but did not include
PEX piping. PEX did not get approved at the state level, but it was made clear
that local jurisdictions could continue to approve it as an alternate method and
material. This board approved it in 1999, and it has been trouble free since then.
The state has approved its use in all manufactured housing since 1996 or before.
It is our plan to continue to approve it under the action taken by this board in
1999.
D. General Plan Update
Chula Vista Vision 2020 kick-off was about six weeks ago. All Boards and
Commissions were asked to be aware of it and participate. The City is asking for
input from the community. There are questionnaires available to fill out.
E. Monthly Activity Reports
The May activity reports were distributed to the members at the beginning of the
meeting. All indications are that the Building Division will come very close to our
anticipated revenues and activity levels for this fiscal year.
