BOARD OF APPEALS AND ADVISORS
CITY OF CHULA VISTA, CALIFORNIA
July 14, 2003 Conference Room No. 1 5:15 p.m.
MEMBERS PRESENT: Chairman Jim Monaghan, Vice-Chair Bryan Ehm, Board
Members Matt Flach, Edward Nagorski, Jose Romo, and
Ben West
MEMBERS ABSENT: Board Member Donald Snider
CITY STAFF PRESENT: Assistant Director Remp, Secretary Bottorff
CALL MEETING TO ORDER: Chairman Monaghan called the meeting to order at 5:14
p.m.
ROLL CALL: Members present constituted a quorum.
1. DECLARATION OF EXCUSED/UNEXCUSED ABSENTEEISM: MSUC Romo/Ehm
(6-0) to excuse the absence of Board Member Snider.
2. APPROVAL OF MINUTES: MSUC Ehm/Romo (6-0) to approve the minutes of
December 9, 2002.
3. NEW BUSINESS:
A. Election of Chair for FY 2003/2004
MSUC Monaghan/Romo (6-0) to elect Bryan Ehm as Chairman of the Board of
Appeals and Advisors for Fiscal Year 2003/2004.
B. Election of Vice-Chair for FY 2003/2004
Recommendation was made to postpone election of Vice-Chair until August
meeting.

MSUC Nagorski/Flach (6-0) to postpone until August meeting.
4. CHAIRMAN'S COMMENTS/REPORT:
A. Outgoing Chairman Monaghan stated that he enjoyed his last year as Chairman
of the Board of Appeals and Advisors.
5. BUILDING OFFICIAL'S COMMENTS/REPORT:
A. State Code Adoption Status Update
Building Standards Commission will be meeting on Wednesday, July 16, 2003, to
hear what they think is final discussion as to which building code and which fire
code should be the base code for the future California codes. Those competing
right now are the International Building Code, International Fire Code, and the
International Residential Code published by the ICC. The other group is a new
building code and a new fire code that was recently written by the National Fire
Protection Association. The local chapter building officials and the City of Chula
Vista has passed a resolution encouraging the Building Standards Commission
to endorse the adoption of the I-Codes.
What has occurred overthe last six months is, as you line up all of those groups,
organizations, jurisdictions that are endorsing the various codes, it is about 95%
forthe IBC, IRC, and the International Fire Code. However, the 5%orsothatare
endorsing the NFPA code have most of the appointees on the Building
Standards Commission.
It would be surprising if the Building Standards Commission follows the wishes of
most of the jurisdictions and the fire prevention officers and the building industry
and all those associated with the c odes a nd a ndorses t he I BC. T here a re
serious concerns with adopting the NFPA code. The code has never been
tested. It has only been adopted in one small jurisdiction in Texas. When the
agencies asked them about it, they didn't particularly feel they did it correctly or
that they could enforce it. The City of Phoenix is also in the process of adopting
it, but the size of the amendments that they had to incorporate into it doubled the
size of the code.
If the NFPA code is adopted, what that means is there are no certification
programs for building inspectors, the evaluation services doesn't exist in the
NFPA, there are no real instructors for this code because no one has ever used
it. The agencies have indicated if they are required to adopt it and modify the
code to meet minimum standards California is currently imposing, it is probably a
two-year process.

All indications are that the NFPA code will be adopted. Chula Vista is doing it's
part by passing a resolution encouraging us to take whatever action we can to try
to encourage the State to adopt the IBC, IRC, and International Fire Code.
B. PSB Remodel
The Planning and Building counters are being consolidated. There will be an
information kiosk in the front along with two self-help stations. The offices will be
shut down from July 11 through July 21 for the remodel. We will reopen for
business on July 22.
C. Code Enforcement Program
Our code enforcement program has been increased with the adoption of the new
budget. We are going to have three additional positions, two code enforcement
officers and one code enforcement technician.
Council, in the budget process, discussed priorities and established five major
areas that they wanted to focus on. The number one area was enhancing the
code enforcement program.
One of the outcomes of adding more staff and becoming more proactive is that
we anticipate more appeals. This could mean meeting more frequently and
hearing code enforcement appeals.

7. ADJOURNMENT: Chairman Monaghan adjourned the meeting at 5:54 p.m. to the next
regular meeting scheduled for August 11, 2003.
