HomeMy WebLinkAbout2004/03/08 Board of Appeals & Advisors Minutes MINUTES OF A REGULAR MEETING BOARD OF APPEALS AND ADVISORS ' CITY OF CHULA VISTA, CALIFORNIA March 8, 2004 Conference Room No. 1 5:15 p.m. MEMBERS PRESENT: Chairman Bryan Ehm, Vice-Chair Jose Romo (arrived at 5:20 p.m.), Board Members Matt Flach, Jim Monaghan, Edward Nagorski, and Donald Snider MEMBERS ABSENT: Board Member Ben West CITY STAFF PRESENT: Assistant Director Remp, Deputy Building Official EI- Khazen, Code Enforcement Manager Bob Vacchi, and Secretary Bottorff CALL MEETING TO ORDER: Chairman Ehm called the meeting to order at 5:12 p.m. ROLL CALL: Members present constituted a quorum. 1. DECLARATION OF EXCUSED/UNEXCUSED ABSENTEEISM: MSUC Monaghan/Snider (5-0) to excuse the absence of Board Member West. 2. APPROVAL OF MINUTES: MSUC Nagorski/Flach (5-0) to approve the minutes of October 13, 2003. 3. NEW BUSINESS: None 4. CHAIRMAN'S COMMENTS/REPORT: None 5. BUILDING OFFICIAL'S COMMENTS/REPORT: A. Urban-Wildland Interface Code Update Board of Appeals & Advisors 2 March 8, 2004 The task force, which includes various city employees, is working on an effective way of enforcing the standards that are in the Urban-Wildland Interface Code. We have adopted this code but have not implemented the more rigorous aspects of it. In order to get to that point, we are going to be soliciting the help of an outside consultant to come in and help map those areas of our city that pose particular severe fire hazards. B. Code Enforcement Program Update Assistant Director Remp introduced Bob Vacchi as our new code enforcement manager. After introductions, Bob showed a PowerPoint presentation overview of the code enforcement program since the addition of new staff last fall. The presentation showed the progress and the on-going development of the program. C. State Code Adoption Process Update Much of the agenda for the CALBO annual conference will be dealing with the continued fight to turn around the decision that was made at the Building Standards Convention. Optimism is high that with the new governor and the proposed appointments to the Building Standards Commission, the decision may be turned around and not adopt the NFPA 5000 Building Code and instead adopt the International Building Code. There is also a recommendation to staywith the codes we're on and simply update the structural provisions to be more consistent with the new code requirements. D. Overview of Appeal Process In the case of building code requirements, typically alternate methods and materials, the applicant would go through plan check process, our plans examiners would identify what we believe is something that needs to be corrected, if the applicant doesn't agree with that or would like to propose an alternate and staff doesn't necessarily agree with the alternate, the applicant would come to the Board to present their case. The applicant is charged with the amount of staff time associated with putting together a staff report. Board members would review the staff report, the applicant presents their case, staff would be available to answer any questions, and the Board would make a decision. The decision would be recorded as a formal action of the Board of Appeals and Advisors. In the case of code enforcement, the procedure can be more specific based on the actual language that is in the ordinance. In most instances, the decision would be whether there is or is not a violation of the code. Challenging full cost recovery rates is not something that would necessarily be within the purview of the board. Board of Appeals & Advisors 3 March 8, 2004 - 6.
