CITY STAFF PRESENT: Building Official Brad Remp, Deputy Building Official Lou EI-Khazen, Senior Code Enforcement Officer Don Nelson, Code Enforcement Officer Joan Schmid, Deputy City Attorney Dave Hanson, Fire Inspector Gary Edmonds, Secretary Bell OTHERS PRESENT: Alan R. Alvord, Administrative Hearing Officer, Attorney James C. Stevens, Heribierto Gutierrez, Victor Villegas CALL MEETING TO ORDER: Chairman Romo called the meeting to order at 5:17 p.m. ROLL CALL: Members present constituted a quorum. 1. DECLARATION OF EXCUSED/UNEXCUSED ABSENTEEISM: None 2. APPROVAL OF MINUTES: MSUC Monaghan/Snider (7-0) to approve the minutes of June 14, 2004. 3. NEW BUSINESS: A. Appeal of Notice and Order to Abate: ETC Motel (and Eddie's Tires Mufflers & Auto Repair Center), 2681 Main Street, Chula Vista, CA 91911 Alan R. Alvord, Administrative Hearing Officer, guided the proceedings. Dave Hansen, Deputy City Attorney appeared on behalf of the Planning & Building Department. Joan Schmid, Code Enforcement Officer and Gary Edmonds, Fire Inspector, testified far the Department. James C. Stevens, Attorney at Law, gave testimony on behalf of his client, Heriberto Gutierrez. Mr. Gutierrez and Victor Villegas also gave testimony. Documents and pictures from both sides were presented to the Board as evidence. The Board upheld and sustained the Notice and Order to Abate dated September 8, 2004 directed to Heriberto Gutierrez for the property located at 2681 Main Street, Chula Vista, CA. 4. CHAIRMAN'S COMMENTS/REPORT: None 5. BUILDING OFFICIAL'S COMMENTS/REPORT: None 6. COMMUNICATIONS (PUBLIC REMARKS/WRITTEN CORRESPONDENCE): None Board of Appeals and Advisors 2 November 8, 2004 7.
