SUMMARY
In 2006, the City received approval for a Federal Department of Housing and Urban
Development (HUD) Section 108 Loan to install public street improvements in the Castle Pazk
Neighborhood Area. These funds must be expended by June 2013 or the balance returned to
HUD. The last and final street improvement projects are currently underway within Alpine and
Twin Oaks Avenues, between Emerson and Oxford Streets (STL379 & STL386), under a
contract awarded to Tri-Group Construction, Inc. (Tri-Group) by Resolution No. 2012-196.
Staff estimates that, upon completion of this contract work by Tri-Group and financial closure of
CIP Projects STL380, and STL385, approximately $100,000 in HUD Section 108 Loan funds
will remain unexpended. Therefore, staff developed a list of eligible improvement work within
the Castle Park Neighborhood area to expend these funds and received a quote of $98,726 from
Tri-Group to complete this work as a change order to their contract. This change order requires
City Council approval.

ENVIRONMENTAL REVIEW
The Development Services Director has reviewed the proposed project for compliance with the
California Environmental Quality Act (CEQA) and has determined that the project qualifies for a
Class 1 categorical exemption pursuant to Section 15301 (Existing Facilities) of the State CEQA
Guidelines because the proposed street reconstruction and improvements involve negligible or
no expansion of an existing use. Thus, no further CEQA environmental review is required.
Additionally, because the proposed project will be utilizing federal Community Development
Block Grant (CDBG) funds, the Development Services Director has also reviewed the project
proposal for compliance with the National Environmental Policy Act (NEPA) as implemented by
the U.S. Department of Housing and Urban Development (HUD) Environmental Guidelines.
The Development Services Director has determined that the project proposal qualifies for a
previously certified Categorical Exclusion (subject to 58.5) pursuant to Code of Federal
Regulations (CFR) Title 24, Section 58.35(a). Thus, no further NEPP. environmental review or
determination is required
RECOMMENDATION
Council adopt the resolutions.

DISCUSSION
On September of 2006, the Department of Housing and Urban Development (HUD) approved a
$9.5 Million Loan ("Section 108 Loan") for needed street improvements in the Castle Pazk
Neighborhood in Western Chula Vista. The City has until June 2013 to expend Section 108 loan
funds or return the unexpended balance to HUD.
Staff has determined that approximately $100,000 will be unexpended upon completion of Tri-
Group's contract work and financial closure of projects STL380 and STL385. Therefore, staff
developed a list of eligible work within the Castle Pazk Neighborhood azea and requested a quote
from Tri-Group to complete this work by change order. The general scope of the additional
eligible work involves construction of pedestrian ramps, truncated domes, driveways, curb,
gutter and sidewalk, safety gates and chain link fence at storm drain channels, and pavement
striping and marking, all within the public right-of--way. Tri-Group submitted a cost proposal of
$98,726 for this additional work.
The proposed change involves a change in contract scope (i.e., beyond the limits of the Alpine
Avenue/Twin Oak Avenue project) and exceeds the Director of Public Works' change order
authority under Resolution No. 2012-196 and Council Policy No. 574-01.
A change order with Tri-Group for additional work, as opposed to a new contract for work, is
necessary and appropriate because (1) Tri-Group is already working in the area on similar work
which creates economies and efficiencies in construction staging, and reduces the cost to the
City for such work; and (2) the time required for a new contract process would put the available
108 loan program funding for the project in serious jeopardy.

DECISION MAKER CONFLICT
Staff has reviewed the property holdings of the City Council and has found no property holdings
within 500 feet of the boundaries of the property which is the subject of this action. Staff is not
independently aware, nor has staff been informed by any City Council member, of any other fact
that may constitute a basis for a decision maker conflict of interest in this matter.
CURRENT YEAR FISCAL IMPACT
The proposed improvements to be constructed by contract change order with Tri-Group will be
paid for out of HUD Section 108 Loan funds. Sufficient funds will be available in the STL379
project account upon inter-project transfers totaling $94,593 from projects STL380 and STL385
to project STL379. Therefore, there is no direct impact to the General Fund.
ONGOING FISCAL IMPACT
Upon completion of the proposed work, the improvements will require routine maintenance.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista (1) approves a change order to the contract with Tri-Group Construction, Inc. for the
"Alpine Avenue Improvements from Emerson Street to Oxford Street (STL379) and Twin Oaks
Avenue Improvements from Emerson Street to Oxford Street (STL386)" Project in the amount
of $98,726 to perform additional eligible work. in the castle park neighborhood area under the
Section 108 Loan Program; (2) finds that the change order (as opposed to a new contract) is
necessary, appropriate and urgent in order to reduce project costs and preserve available funding;
and (3) reduces the STL380 budget by $41,593 and the STL385 budget by $53,000 and
appropriates the equivalent amount to STL379.
