The City of Chula Vista Municipal Code Section 2.56.270 and Council Resolution No. 6132 authorize the Purchasing Agent to participate in cooperative bids with other government agencies for the purchase of materials of common usage. The City has an opportunity to participate in a current National Joint Powers Authority (NJPA) bid on favorable terms and pricing. ENVIRONMENTAL REVIEW This proposed activity has been reviewed for compliance with the California Environmental Quality Act (CEQA) and it has been determined that the activity is not a "Project" as defined under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is necessary RECOMMENDATION Council adopt the resolution. BOARDS/COMMISSION RECOMMENDATION Not applicable. 7-1 2/26/13, Item Page 2 of 2 DISCUSSION The approved capital Equipment Replacement Fund budget for fiscal yeaz 2012/13 authorizes the replacement of seven police patrol vehicles, five of which have already been procured. The Fleet Manager, working with responsible staff in the Police Department, has obtained written quotes from the National Auto Fleet Group for the desired vehicles, on terms, conditions and pricing offered to the NJPA through competitive bidding for such vehicles. The result of this award will cause the City to expend in excess of $100,000 with this vendor in this fiscal yeaz. Purchasing regulations require such an expenditure be approved by the City Council. Staff recommends that National Auto Fleet Group, as the holder of a competitive bid contract issued by NJPA, be awarded this purchase agreement. Purchasing concurs in this assessment. DECISION MAKER CONFLICT Staff has reviewed the decision contemplated by this action and has determined that it is not site specific and consequently, the 500-foot rule found in California Code of Regulations section 18704.2(a)(1) is not applicable to this decision. Staff is not independently aware, nor has staff been informed by any City Councilmember, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter. CURRENT YEAR FISCAL IMPACT The net total cost including taxes is $49,457.50. Sufficient funds have been budgeted in the Equipment Replacement Fund. ONGOING FISCAL IMPACT Since these vehicles are replacement vehicles, and since an equal number of existing vehicles will be removed from the fleet, there is no ongoing additional fiscal impact. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby award a purchase agreement totaling $49,457.50 to National Auto Fleet Group for the purchase of two police patrol sedans in accordance with the terms and conditions of National Joint Powers Authority bid number 102811.
