SUMMARY
On December 19, 2012, the Director of Public Works received six (6) sealed bids for the
"Montgomery Elementary School Pedestrian Improvements [CIP No. STL375; State Project No.
SR2SL-5203(033)]" Project. The project will provide a safer street crossing for the elementary
school and consists of the installation of enhanced crosswalk improvements, including curb
extensions, pedestrian ramps, pedestrian actuated traffic signal and traffic signage at the front
entrance of the school on Fourth Avenue. The proposed resolution, if approved, would accept
the bids, award the contract to Just Construction, Inc. in the amount of $110,000, waive City
Council Policy 574-01, and authorize the expenditure of all available contingency funds in an
amount not to exceed $15,000.
ENVIRONMENTAL REVIEW
The Development Services Director has reviewed the proposed project for compliance with the
California Environmental Quality Act (CEQA) and has determined that the project qualifies for a
Class 3 categorical exemption pursuant to Section 15303 [New Construction or Conversion of
Small Structures] of the State CEQA Guidelines because the proposed street improvements
consist of small new pedestrian features to be constructed within existing public street right-of-
way. Thus, no further environmental review is required.

DISCUSSION
The primary pti~rpose of the State Safe Routes 2 School (SR2S) Program is to provide safer street
crossings for children and families walking to schools. The "Montgomery Elementary School
Pedestrian Improvement" project consists of the installation of enhanced crosswalk
improvements, including curb extensions, pedestrian ramps, pedestrian actuated traffic signal
and traffic signage, all designed to increase safety for children and families at the front entrance
of Montgomery Elementary School on Fourth Avenue.
On December 19, 2012, the Director of Pablic Works received six (6) sealed bids. The
following bids were received:

6. Jayeor Construction Technologies, Inc. -Santee, CA $160,067.40
The low bid submitted by Just Construction, Inc. is below the Engineer's Estimate of
$132,000.00 by $22,000 (20% below the Engineer's estimate); much of this differeuce can be
attributed to the high degree of competition currently within the construction market.
Engineering staff has verified the references provided by the contractor and has determined that
the contractor has performed satisfactorily for those references. The Contractors License No.
968910 is current and active.
The proposed resolution would also authorize the Director of Public Works to approve change
orders over and above existing policy limits. Under City Council Policy No. 574-01, if an
individual change order causes the cumulative increase in change orders to exceed the Director's
authority ("Maximum Aggregate Increase in Change Orders"), then City Council approval is
required. The corresponding maximum aggregate contract increase that may be approved by the
Director of Public Works under Policy No. 574-01 is $10,700. Approval of the resolution
would increase the Director of Public Works' authority to approve change orders, as necessary,
up to the contingency amount of $15,000, an increase of $4,300 over Policy No. 574-01.
Increasing the contingency funds will allow staff to continue the project without delay should
unforeseen circumstances resulting in increased project costs arise during the course of
construction, as well as make adjustments to bid item quaxuities. Unforeseen conditions include

such items as utility conflicts, hazardous materials, unexpected underground conflicts, etc. If the
contingency funds are not used, then they will be returned to the project fund balance.
Disclosure Statement
Attached is a copy of the contractor's Disclosure Statement as Attachment 1.
Wage Statement
The sources of funding for this project are a grant from the State Safe Routes 2 School (SR2S)
Program and TransNet (grant match). Contractors bidding tlvs project are required to pay State
of California general prevailing wages to persons employed by them for the work wtder this
project.
DECISION MAKER CONFLICT
Staff has reviewed the property holdings of the City Council and has found no property holdings
within 500 feet of the boundaries of the property which is the subject of this action. Statl is not
independently aware, nor has staff been informed by any City Council member, of any other fact
that may constitute a basis for a decision maker conflict of interest in this matter.
CURRENT YEAR FISCAL IMPACT
A breakdown of the project construction costs is as follows:

There is no direct fiscal impact to the General Fund in the current fiscal year related to awarding
the construction contract.
ONGOING FISCAL IMPACT
Upon completion of the project, the improvements will require routine maintenance and
operation of the street facilities and traffic signal equipment.

WHEREAS, staff has verified the references provided by the contractor and has
determined that the contractor has performed satisfactorily for those references; and
WHEREAS, staff has reviewed the low bid and recommends awarding the contract to
Just Construction, Inc. of San Diego, California.
WHEREAS, in order to approve change orders as necessary, staff is requesting City
Council waive Council -Policy No. 574-01.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby accepts bids and awards the contract for the "Montgomery Elementary School
Pedestrian Improvements - CIP No. STL375" Project, State Project Number: SR2SL-5203(033)"
Project to Just Construction, Inc. in the amount of $110,000.00.
BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista does
hereby waive Council Policy 574-01 and authorize the director of Public Works o approve
change orders, as necessary, up to the contingency amount of $15,000 and expend'al available
