The project was included in the annual Public Works Street Maintenance budget to remove and replace curbs, gutters, sidewalks, and driveways displaced by street trees on various City streets as listed in Attachment L The proposed resolution, if approved, would reject the bid of the first apparent low bidder as non-responsive, accept remaining bids, award the contract for this project to Portillo Concrete, Inc. in the amount of $115,667, waive Council Policy 574-O1, and authorize the expenditure of all available contingency funds in an amount not to exceed $24,333. ENVIRONMENTAL REVIEW The Development Services Director has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Class 1(c) categorical exemption pursuant to Section 15301 [Existing Facilities] of the State CEQA Guidelines because the capital improvement project consists of removal and replacement of existing curbs, gutters, sidewalks, asphaltlconcrete pavement and driveways displaced due to the overgrowth of tree roots. All proposed repair work to be done within existing street right-of- way. Thus, no further environmental review is necessary 5-1 2/26/13, Item `~ Page 2 of 4 RECOMMENDATION Council adopt the resolution. BOARDS/COMMISSION RECOMMENDATION Not applicable. DISCUSSION The annual Public Works Street Maintenance sidewalk replacement project is funded in the fiscal year 2012-2013 operating budget. Project design staff prepared specifications and location plats and advertised the project on January 18, 2013. On February 6, 2013, the Director of Public Works received eight (8)-bids as follows: CONTRACTOR BID 1 Palm Engineering Construction Company, Inc. -San Diego, CA $113,749.00 2 Portillo Concrete, Inc. -Lemon Grove, CA $115,667.00 3 El Camino Construction and Engineering Corporation -Long Beach, CA $129,938.00 4 Just Construction, Inc. -San Diego, CA $137,992.25 5 Crest Equipment, Inc. - El Cajon, CA $140,249.25 6 Ramona Paving and Construction Corporation -Ramona, CA $145,161.50 7 Tri-Group Construction and Development, Inc. -San Diego, CA $155,097.00 8 HTA Engineering & Construction, Inc. -San Diego, CA $162,227.00 Staff reviewed the apparent lowest bid submitted by Palm Engineering Construction Company, Inc., and determined that the bid is non-responsive because the Contractor did not include the "Individual, or Co-Partnership, or Corporation letter authorizing capacity(ies) for signature" form in his bid proposal package. Staff then reviewed the second lowest bid submitted by Portillo Concrete, Inc. and determined that the bid package is complete, with no errors or omissions. Therefore, staff recommends awarding a construction contract to Portillo Concrete, Inc. in the amount of $115,667. The bid submitted by Portillo Concrete, Inc. is below the Engineer's estimate of $127,275 by $11,608 (approximately 9% below the Engineer's estimate). Portillo Concrete, Inc. has satisfactorily performed construction projects of similar scope for the City in the past. Portillo Concrete, Inc. is a licensed General Engineering Contractor, General Building Contractor, and Concrete Contractor. Their License No. 680144 is current and active. 5-2 2/26113, Item ~ Page 3 of 4 The proposed resolution would also authorize the Director of Public Works to approve change orders over and above existing policy limits. Under City Council Policy No. 574-01, if an individual change order causes the cumulative increase in change orders to exceed the Director's authority ("Maximum Aggregate Increase in Change Orders"), then City Council approval is required. The corresponding maximum aggregate contract increase that may be approved by the Director of Public Works under Policy No. 574-01 is $18,097. Approval of the proposed resolution would increase the Director of Public Works' authority to approve change orders, as necessary, up to the contingency amount of $24,333, an increase of $6,236 over Policy No. 574- 01. Increasing the contingency funds will allow staff to continue the project without delay should unforeseen circumstances resulting in increased project costs arise during the course of construction, as well as make adjustments to bid item quantities. Unforeseen conditions include such items as utility conflicts, hazazdous materials, unexpected underground conflicts, etc. If the contingency funds are not used, then they will be returned to the project fund balance. Further, because the contractor's bid is lower than the Engineer's estimate, some of the supplemental locations listed in Attachment 1 will be completed using contingency funds. The proposed resolution, if approved, would reject the bid of the first apparent low bidder as non-responsive, accept remaining bids, awazd the contract for this project to Portillo Concrete, Inc. in the amount of $115,667, waive Council Policy 574-01, and authorize the expenditure of all available contingency funds in an amount not to exceed $24,333. Wage Statement The contractors who bid on this project are not required to pay prevailing wages to persons ,~ employed by them for the work performed under this project. However, a Notice to Contractors" was sent to various trade publications in order to encourage disadvantaged business enterprises (DBEs) to bid on the project. Disclosure Statement Attachment 2 is a copy of the Contractor's Disclosure Statement. DECISION MAKER CONFLICT Staff has reviewed the decision contemplated by this action and has determined that it is not site specific and consequently, the 500-foot rule found in California Code of Regulations section 18704.2(a)(1) is not applicable to this decision. Staff is not independently aware, nor has staff been informed by any City Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter. CURRENT YEAR FISCAL IMPACT FUNDS RE UIRED FOR CONSTRUCTION A. Contract Amount $ 115,667 B. Contingencies $ 24,333 TOTAL FUNDS REQUIRED FOR CONSTRUCTION $ 140,000 5-3 2/26/13, Item ~ Page 4 of 4 Sufficient funds have been budgeted in the Public Works Operating Budget for this contract. The contract amount of $115,667 plus the contingencies and remaining funds in the project results in a total construction cost of $140,000. ONGOING FISCAL IMPACT Upon completion of the project and one-year contractor maintenance period, the improvements will require only routine normal maintenance of the street facilities. ATTACHMENTS 1. Joe 5-9 RESOLUTION NO.2013- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA REJECTING TAE BID OF THE FIRST APPARENT LOW BIDDER AS NON-RESPONSIVE, ACCEPTING REMAINING BIDS, AWARDING THE CONTRACT FOR THE "SIDEWALK REPLACEMENT FY2012-2013 AT VARIOUS LOCATIONS IN THE CITY OF CHULA VISTA, CA (JY065S)" PROJECT TO PORTILLO CONCRETE, INC, IN THE AMOUNT OF $115,667, WAIVING COUNCIL POLICY 574-01, AND AUTHORIZING THE EXPENDITURE OF ALL AVAILABLE CONTINGENCY FUNDS IN AN AMOUNT NOT TO EXCEED $24,333 WHEREAS, the annual Public Works Street Maintenance sidewalk replacement project is funded in the fiscal year 2012-2013 operating budget; and WHEREAS, on February 6, 2013, the Director of Public Works received eight (8) sealed bids for the "Sidewalk Replacement FY2012-2013 at Various Locations (JY065S)" Project; and WHEREAS, the City received bids from eight (8) contractors as follows: CONTRACTOR BID 1 Palm Engineering Construction Company, Inc. -San Diego, CA $113,749.00 2 Portillo Concrete, Inc. -Lemon Grove, CA $115,667.00 3 El Camino Construction and Engineering Corporation -Long Beach, CA $129,938.00 4 Just Construction, Inc. -San Diego, CA $137,992.25 5 Crest Equipment, Inc. - El Cajon, CA $140,249.25 6 Ramona Paving and Construction Corporation -Ramona, CA $145,161.50 7 Tri-Group Construction and Development, Inc. -San Diego, CA $155,097.00 8 HTA Engineering & Construction, Inc. -San Diego, CA $162,227.00 WHEREAS, Staff reviewed the apparent lowest bid submitted by Palm Engineering Construction Company, Inc., and determined that the bid is non-responsive because the Contractor did not include the "Individual, or Co-Partnership, or Corporation letter authorizing capacity(ies) for signature" form in his bid proposal package; and WHEREAS, Staff then reviewed the second lowest bid submitted by Portillo Concrete, Inc. and determined that the bid package is complete, with no errors or omissions; and WHEREAS, the bid submitted by Portillo Concrete, Inc. is below the Engineer's estimate of $127,275 by $11,608 (approximately 9% below the Engineer's estimate); and 5-10 Resolution No. 2013- Page 2 WHEREAS, Portillo Concrete, Inc. has performed similar work for the City satisfactorily; and WHEREAS, in order to approve change orders as necessazy, staff is requesting City Council waive Council Policy No. 574-01; and WHEREAS, the contract amount of $115,667.00 plus the contingencies and remaining funds in the project results in a total construction cost of $140,000, which is budgeted in the Street Maintenance budget; and WHEREAS, sufficient funds are budgeted for staff costs for design and inspections, estimated at $20,000 in the Department of Public Works operating budget. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby reject the bid of the first apparent low bidder as non-responsive, accept remaining bids, and award the contract for this project to Portillo Concrete, Inc. in the amount of $115,667. BE IT FURTHER RESOLVED that the City Council of the City of Chula Vista does hereby waive Council Policy No. 574-01 and authorize the expenditure of all available contingency funds in an amount not to exceed $24,~~~ Presented by Richard A.
