SUMMARY
Four positions are requested to be added to the authorized count of the Police Grant Fund
to support the San Diego Law Enforcement Coordination Center (SDLECC). These four
positions are fully reimbursed by grant funds, along with a 4% administrative fee for acting
as the fiscal agent.
ENVIRONMENTAL REVIEW
This proposed activity has been reviewed for compliance with the California
Environmental Quality Act (CEQA) and it has been determined that the activity is not a
"Project" as defined under Section 15378 of the State CEQA Guidelines because it will not
result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3)
of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no
environmental review is necessary.

DISCUSSION
The Police Department acts as the fiscal agent for various law enforcement programs
which are funded through various State and Federal agencies. As the fiscal agent, the
Police Department hires and provides salary and benefits for positions which are normally
considered separate from existing City staffing. These positions are designated as "FA"
(Fiscal Agent) in the title description.
Four positions are requested to be added to the authorized count of the Police Grant Fund
to support the San Diego Law Enforcement Coordination Center (SDLECC). The
SDLECC serves as the regional intelligence fusion center for San Diego and Imperial
counties. Fusion Centers are focal points for the receipt, analysis, gathering, and sharing
of threat-related information between the federal government and state, local, tribal, and
private sector partners. These four new positions (FA Director of SD LECC, FA LECC IT
Manager and 2 FA Analysts) are fully reimbursed by grant funds, along with a 4%
administrative fee for acting as the fiscal agent.
FA Director of SD LECC
The FA Director of SDLECC provides expert guidance and assistance in planning,
directing and coordinating overall intelligence programs, employing extensive specialized
training, experience and knowledge in the field of criminal investigation and an expert
knowledge of intelligence systems, dissemination and techniques. This position evaluates
and analyzes the SDLECC progress toward meeting identified objectives, and establishes
guidelines, priorities, and management systems for the day-to-day administration and
operations of the center. hi addition, the SDLECC Director participates in the
development, implementation, and evaluation of strategic and operational plans; and serves
as liaison to, and maintains effective working relationships with, Federal, State and local
law enforcement and prosecutorial agencies. This position is funded by High Intensity
Drug Trafficking Area (HIDTA) grant funds.
FA LECC IT Manager
The FA LECC IT Manager manages the Information Technology (IT) unit of the
SDLECC. This position executes the information technology strategies and policies and
ensures proper functioning of the center's network and related information processing
systems. The LECC IT Manager determines systems needs and any hardware/software
acquisitions required to accomplish business objectives. This position is funded by the
Homeland Security Grant Program (HSGP).
FA Analysts
Two FA Analyst positions are requested to be added to support SDLECC operations. The
SDLECC is increasing the level of analytical support to local, state, and federal law

enforcement agencies by approximately 20% annually and requires these additional
analysts to insure continued improvement of services. The analysts will be collecting and
analyzing narcotic and other crimes intelligence information using various databases, in
order to assist local, state, and federal law enforcement officers in their criminal
investigations. These two analyst positions are funded by the Homeland Security Grant
Program (HSGP).
DECISION MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that it is
not site specific and consequently the 500-foot rule found in California Code of
Regulations section 18704.2(a)(1) is not applicable to this decision. Staff is not
independently aware, nor has staff been informed by any City Councilmember, of any
other fact that may constitute a basis for a decision maker conflict of interest in this matter.
CURRENT YEAR FISCAL IMPACT
Approval of Resolution A will result in the amendment of the compensation schedule and
classification plan to reflect the title change of the CBAG Director of SDLECC to FA
Director of SDLECC and the change in annual compensation for the FA Director of
SDLECC to $140,225 at E Step. Per HIDTA (High Intensity Drug Trafficking Area)
policy, this position is tied to the Federal General Schedule (GS) Salary Table.
Additionally, approval of Resolution A will result in the amendment of the compensation
schedule and classification plan to add the classification of FA LECC IT Manager. This
new classification is an at-will position and will be eliminated if grant funding ends. The
FA LECC IT Manager will be assigned to the Mid-Manager Unclassified (MMUC) group.
The E-Step bi-weekly salary for the FA LECC IT Manager will be $3,740.02.
Approval of Resolution B will result in the appropriation of $169,950 to the personnel
services category of the Police Grant Fund budget for the addition of one FA Director of
SDLECC, one FA LECC IT Manager, and two FA Analysts to the authorized position
count of the Police Grant Fund. The Department anticipates filling these positions in
February 2013. These personnel costs are fully reimbursed by HIDTA and homeland
security grant funds, and the City receives a 4% administrative fee for acting as the fiscal
intermediary for these positions. Because of the 4% administrative fee, there is a positive
impact of $6,798 to the General Fund this fiscal year.
Approval of the Ordinance will amend Chula Vista Municipal Code 2.05.010 to reflect the
title change of CBAG Director of SDLECC to FA Director of SDLECC and the addition of
FA LECC IT Manager.
ONGOING FISCAL IMPACT
The ongoing annual costs for the four positions are approximately $482,000. These
personnel costs are fully reimbursed by the HIDTA and homeland security grant funds,
and the City receives a 4% administrative fee for acting as the fiscal intermediary for these
positions. Because of the 4% administrative fee, there will be a positive impact of
approximately $19,280 to the General Fund each fiscal year. If HIDTA or homeland
security grants no longer fund these positions, then they will be eliminated.

ORDINANCE NO.
ORDINANCE OF THE CITY OF CHULA VISTA AMENDING
CHULA VISTA MUNICIPAL CODE SECTION 2.05.010
RELATING TO THE ESTABLISHMENT OF UNCLASSIFIED
POSITIONS
WHEREAS, the Human Resources Department has created new classifications to better
reflect the needs of the City's workforce; and
WHEREAS, Chula Vista City Charter Section 500(a) requires that all new unclassified
management level positions be adopted by ordinance and afour-fifths vote of the Council.
NOW THEREFORE the City Council of the City of Chula Vista does ordain as follows:
Section I. That Section 2.05.010 of the Chula Vista Municipal Code is hereby
amended to read as follows:
2.05.10 Unclassified positions established.
In addition to those unclassified positions specifically delineated in Section 500 of the Charter of
the Ciry, there are established the unclassified positions entitled: Administrative Services
Manager, Advanced Planning Manager, Animal Care Facility Manager, Assistant Chief of
Police, Assistant Director of Development. Services, Assistant Director of Engineering, Assistant

Section II. Severability
If any portion of this Ordinance, or its application to any person or circumstance, is for
any reason held to be invalid, unenforceable or unconstitutional, by a court of competent
jurisdiction, that portion shall be deemed severable, and such invalidity, unenforceability or

unconstitutionality shall not affect the validity or enforceability of the remaining portions of the
Ordinance, or its application to any other person or circumstance. The City Council of the City of
Chula Vista hereby declares that it would have adopted each section, sentence, clause or phrase
of this Ordinance, irrespective of the fact that any one or more other sections, sentences, clauses
or phrases of the Ordinance be declared invalid, unenforceable or unconstitutional.
Section III. Construction
The City Council of the City of Chula Vista intends this Ordinance to supplement, not to
duplicate or contradict, applicable state and federal law and this Ordinance shall be construed in
light of that intent.
Section IV. Effective Date
This Ordinance shall take effect and be in force on the thirtieth day after its final passage.
Section V. Publication
The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause
the same to be published or posted according to law.
