SECOND READING ORDINANCE OF THE CITY OF CHULA VISTA AMENDING CHULA VISTA MUNICIPAL CODE SECTION 2.05.010 TO ADD THE FOLLOWING POSITIONS INTO THE UNCLASSIFIED SERVICE: (1) ASSISTANT DIRECTOR OF HUMAN RESOURCES, (2) ASSISTANT DIRECTOR OF INFORMATION TECHNOLOGY, AND (3) ASSISTANT TO THE CITY MANAGER/CONTINUOUS IMPROVEMENT MANAGER [4/Sths VOTE REQUIRED] AND ADOPTION WHEREAS, the City Manager, pursuant to Charter section 501, has conducted a reorganization of various positions within the City's management to reflect current and new management and supervisory duties and has added Assistant Director and Assistant to City Manager positions; and WHEREAS, such positions specifically include: (1) Assistant Director of Human Resources; (2) Assistant Director of Information Technology; and (3) Assistant to the City Manager/Continuous Improvement Manager; and WHEREAS, Charter section 701 provides that the City of Chula Vista may place assistant deparhnent heads and assistants into the unclassified service by 4/5ths vote of the City Council. NOW THEREFORE the City Council of the City of Chula Vista does ordain as follows: Section I. That Section 2.05.010 of the Chula .Vista Municipal Code is hereby amended to read as follows: 2.05.10 Unclassified positions established. In addition to those unclassified positions specifically delineated in Section 500 of the Charter of the City, there are established the unclassified positions entitled: Administrative Services Manager, Advanced Planning Manager, Animal Care Facility Manager, Assistant Chief of Police, Assistant Director of Development Services, Assistant Director of Engineering, Assistant Director of Human Resources Assistant Director of Information Technology, Assistant Director of Finance, Assistant Director of Public Works, Assistant Director of Recreation, Assistant to the Citv Manager/Continuous Improvement Manager, Budget and Analysis Manager, Building Official/Code Enforcement Manager, California Border Alliance Group (CBAG) Deputy Executive Director, CBAG Director - IV LECC, CBAG Director - SD LECC, CBAG Accounting Technician, CBAG Administrative Analyst I, CBAG Administrative Analyst II, CBAG Analyst, CBAG Executive Assistant, CBAG Executive Director, CBAG Graphics Designer/Webmaster, CBAG Management Assistant, CBAG Microcomputer Specialist, CBAG ~ This Ordinance has been amended to reflect typographical/clerical errors contained in the version of the Ordinance passed by the City Council on December 11, 2012, as authorized by City Charter Section 311(a). The Ordinance contained language made by a similar action changing the title of positions at the same meeting (Item No. 21(C)). 3-1 Ordinance Page 2 Network Administrator I, CBAG Network Administrator II, CBAG Network Manager, CBAG Program Analyst, CBAG Program Manager, CBAG Public Safety Analyst, CBAG Regional Computer Forensic Laboratory Network Engineer, CBAG Senior Public Safety Analyst, Chief Service Officer, City Engineer, Constituent Services Manager, Deputy City Manager, Deputy Fire Chief, Development Services Department Director, n'~~~~~~ "~°~°~°~, Director of Conservation and Environmental Services, Director of Economic Development, Fire Division Chief, Fiscal Operations Manager, Human Resources Operations Manager, Information Technology Manager, Law Office Manager, Office Specialist (Mayor's Office), Police Captain, Purchasing Agent, Real Property Manager, Redevelopment and Housing Manager, Risk Manager, Senior Council Assistant, Traffic Engineer, Transit Coordinator, Transit Manager, and Treasury Manager. Section II. Severability If any portion of this Ordinance, or its application to any person or circumstance, is for any reason held to be invalid, unenforceable or unconstitutional, by a court of competent jurisdiction, that portion shall be deemed severable, and such invalidity, unenforceability or unconstitutionality shall not affect the validity or enforceability of the remaining portions of the Ordinance, or its application to any other person or circumstance. The City Council of the City of Chula Vista hereby declares that it would have adopted each section, sentence, clause or phrase of this Ordinance, irrespective of the fact that any one or more other sections, sentences, clauses or phrases of the Ordinance be declared invalid, unenforceable or unconstitutional. Section III. Construction The City Council of the City of Chula Vista intends this Ordinance to supplement, not to duplicate or contradict, applicable state and federal law and this Ordinance shall be construed in light of that intent. Section IV. Effective Date This Ordinance shall take effect and be in force on the thirtieth day after its final passage. Section V. Publication The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be published or posted according to law.
