SUMMARY
On January 23, 2013, the Director of Public Works received six (6) sealed bids for the "Corral
Court Pump Station Rehabilitation Improvements (CIP No. SW264)" Project. The work to be
done consists of the removal and disposal of existing improvements and construction of a sewage
pump station, including an enclosed building, and new dual force main. The proposed
resolution, if approved, would accept the bids, award the contract to TC Construction Co. in the
amount of $616,780, appropriate additional funds into the project, waive City Council Policy
574-01, and authorize the expenditure of all available contingency funds in an amount not to
exceed $92,220.
ENVIRONMENTAL REVIEW
The Development Services Director has reviewed the proposed activity for compliance with the
California Environmental Quality Act (CEQA) and has determined that the activity qualifies for
a Class 1 categorical exemption pursuant to Section 15301 [Existing Facilities] of the State
CEQA Guidelines because the activity consists of the reconstruction and rehabilitation of an
existing sewer pump station involving negligible or no expansion of an existing use. Thus, no
further environmental review is required.

DISCUSSION
The Corral Court Pump Station Improvement project involves the removal and disposal of
existing sewage lift station improvements and the abandonment of an existing force main,
construction of a new sewage pump station, including a concrete block building enclosure and
dual force main.
On January 23, 2013, the Director of Public Works received six (6) sealed bids. The following
bids were received:

2. RMV Construction Inc. -San Diego, CA $622,250.00
3. Alvand Construction Inc. -Poway, CA $634,285.00
4. Arrieta Construction, Ina - El Cajon, CA $663,890.00
S.Tharsos Construction - La Mesa, CA $719,214.00
6. Newest Construction Company Inc. -San Diego, CA $766,960.00
The low bid submitted by TC Construction Inc. is above the Engineer's Estimate of $550,000 by
$66,780 (12% above the Engineer's estimate); much of this difference can be attributed to the
large number of specialty items within the project scope of work for which the unit costs are
highly variably In addition, the tight site conditions present a challenge to the pump station
construction which also contributed to the higher costs. TC Construction, Inc. has satisfactorily
performed construction projects of similar scope for the City in the past. The Contractor's
License No. 402459 is current and active. Therefore, the proposed resolution would accept bids
and award a construction contract to T.C. Construction Company.
The proposed resolution would also appropriate additional funds needed to complete the project
totaling $470,000 from the available Sewer Facility Replacement Fund balance. Some of the
additional project cost is due to unanticipated construction costs associated with site constraints.
The remainder of the additional project costs are related to the implementation of new City
design standards and policies with regard to such facilities. These include a building enclosure
to assure worker safety during routine maintenance and emergencies in all weather conditions
and to protect mechanical and electrical equipment; dual force mains and other redundancies to
reduce the risk of accidental sewage discharge to receiving waters; and enhanced remote
communication systems to diagnose and monitor the station's operations and respond rapidly to
alarms, failures, and malfunctions.

Finally, the proposed resolution would authorize the Director of Public Works to approve change
orders over and above existing policy limits. Under City Council Policy No. 574-01, if an
individual change order causes the cumulative increase in change orders to exceed the Director's
authority ("Maximum Aggregate Increase in Change Orders"), then City Council approval is
required. The corresponding maximum aggregate contract increase that may be approved by the
Director of Public Works under Policy No. 574-01 is $46,175. Approval of the resolution
would increase the Director of Public Works' authority to approve change orders, as necessary,
up to the contingency amount of $92,220, an increase of $46,045 over Policy No. 574-01.
Increasing the contingency funds will allow staff to continue the project without delay should
unforeseen circumstances resulting in increased project costs arise during the course of
construction, as well as make adjustments to bid item quantities. Unforeseen conditions include
such items as utility conflicts, hazardous materials, unexpected underground conflicts, etc. If the
contingency funds are not used, then they will be returned to the project fund balance.
Disclosure Statement
Attached is a copy of the contractor's Disclosure Statement as Attachment 1.
Wage Statement
Contractors bidding on this project were not required to pay prevailing wages to person
employed by them for work under this project. No special minority or women owned business
requirements were necessary as part of the bid documents. However, the "Notice to Contractors"
was sent to vazious trade publications in order to encourage disadvantaged businesses to bid on
the project.
DECISION MAKER CONFLICT
Staff has reviewed the property holdings of the City Council and has found no property holdings
within 500 feet of the boundaries of the property which is the subject of this action. Staff is not
independently aware, nor has staff been informed by any City Council member, of any other fact
that may constitute a basis for a decision maker conflict of interest in this matter.
CURRENT YEAR FISCAL IMPACT
There is no impact to the General Fund as this project is funded by Sewer Facility Replacement
Fund. A breakdown of the project construction costs is as follows:

the project in accordance with current City design standazds and policies with regard to sewage
pump stations construction and operation.

ONGOING FISCAL IMPACT
Upon completion of the project, the improvements will require routine City maintenance.

WHEREAS, staff reviewed the contractor's bid package and determined that the
contractor bid package is complete, with no errors or omissions, and recommends awarding the
contract to TC Construction Co. in the amount of $616,780; and
WHEREAS, staff is requesting additional funds needed to complete the project totaling
$470,000 from the available Sewer Facility Replacement Fund balance; and
WHEREAS, the additional project cost is due to unanticipated construction costs
associated with site constraints and are related to the implementation of new City design
standards and policies with regard to such facilities; and
WHEREAS, these design standards and policies include a building enclosure to assure
worker safety during routine maintenance and emergencies in all weather conditions and to
protect mechanical and electrical equipment, dual force mains and other redundancies to reduce

WHEREAS, in order to approve change orders as necessary, staff is requesting City
Council waive Council Policy No. 574-01.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby accept bids, award the contract for the "Corral Court Pump Station
Rehabilitation Improvements (CIP No. SW264)" Project to the lowest responsible bidder, T.C.
Construction Co. in the amount of $616,780, and appropriate funds In the amount of $470,000
from the available Sewer Facility Replacement Fund balance.
BE IT FURTHER RESOLVED that, with respect to this contract, the City Council of the
City of Chula Vista does hereby waive Council Policy 574-01 and authorize the expenditure of
all available contingency funds in an amount not to exceed $92,220.
BE IT FURTHER RESOLVED that the Public Works Director is authorized to
implement this contract award through the preparation and execution of the City's standard form
contract in a final form approved by the City Attorney.
