RESOLUTION N0. 3491
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA ACCEPTING GRANT OF EASEMENT FOR
DRAINAGE AND SEWER PURPOSES FROM UNITED
ENTERPRISES, INC.
The Council of the City of Chula Vista hereby resolves
as follows:
1. That certain. conveyance and instrument dated August
10, 196, executed by UNITED ENTERPRISES, INC., a Delaware
Corporation, and signed by STEPHEN BIRCH, JR., President,
and ROBERT NEWELL, Secretary, granting to the City of Chula
Vista an easement and right-of-way for drainage and sewer
purposes and appurtenant structures is hereby accepted and
approved and the Clerk is authorized to record the same with
the County Recorder of San Diego County.
2. A true copy of said document is attached hereto and
incorporated herein by this reference thereto.
ADOPTED AND APPROVED by the CITY COUNCIL of the
CITY OF CHULA VISTA, CALIFORNIA, thislst day of September ,
19 64 , by the following vote, to-wit:

Grantor, for a valuable consideration, receipt of which ie hereby
acknowledged, does hereby ;rant and convey. to Grantee the permanent right of
way and easement for the sole purpose of making cut or fill and layin;,
relaying, constructing and reconstructing, maintaininb, repairing, using and
operating a sanitary secrer line and work incidental thereto in, upon, over
and across that certain real property situated in the County of San Dieoo,
State of California, and more particularly described as follows:
Those portions of -the following described parcels of land in the
Rancho de la Nacion, County of San Dieoo, State cf California,
according to Map thereof No. 166 by 'S(orrill, filed in the Office
of the County Recorder of San Die,ro County .May 11, 1&69.
A strip of land 12 feet in :vi ltli in the Northeast Quarter of
Quarter Section 95 and the Southeast Quarter of Quarter Section
c. ~` 96, `the center Iii:e of said easement being 3escribed as follows:
Beginning at the Southwest corner of the Southeast Quarter of said
Quarter Section 96; thence alaug the Southerly line thereof
North 71°50'3C" Fast 268.91 feet; thence North lt~°09'30" best 177
feet to THE TRUE POINT CF BEGINNING; thence parall::l with said
Southerly Iine North 71°50'30" East 395 feet; thence South 18°09'30"
Fast 289.78 feet to a tangent 400 feet Radius CLrve concave lYesterly;
thence Southerly along said curve 246.35 feet through an angle of

The side l..ines of said easement shall be shortened or prolonged to
terminate on said curve.
EXCEPTING therefrom any portion not o;rned by the Grantor herein.
Together With the right and privile~e,'to extend and maintain embaulcment
slopes of a grade not to exceed 2.0 feet horizontal to 1.0 foot vertical
on the Grantor's land lying adjacent to tl:e easement above described.
Also the Zrivilege and right to plant and maintain grass, plants and
trees on said slopes for the prutnction and beautification of sage;
RESERVING B0IYEVER, unto the owner of the land under :which sueb slope
rights extend, the right at any time to remove such elopes or portions
thereof anon removing the necessity for maintaininn such slopes or portion
thereof or upon providing in. place thereof other adelluate lateral suhn~rt,
the desiern and construction of which shall he first approved by the City
Council'of the City of Chula Vista.

And in addition Grantor does hereby grant and convey to
Grantee, sn ease>3ent for drainage purposes only, 12 feet in ~:idth
in the P.ortheast Quarter of Quarter Section 98 of Rancho de la hacion,
lying 3 feet on each side of the following described center line:
Beginning at the Southwest corner of said Ncrt.:east Quarter;
thence along the Southerly line thereof North 71°~t7'3L`" East
_ 79.69 feet; thence 27crth 18°12';:0" ~Yest 40 feet to TIIE TRUE
POINT OF BEGINNING of said center Line; thence continuing North
18°1'30" West 4:1 feet to the end of said.easenent.
It is understood and agreed by the Parties hereto, that the
Grantee shall have their insurance carrier issue a certificate of
insurance, naming Grantor as au additional assured under their policy
of public liability and property damage insurance and said certificate
shall be a part of this "Grant of Easement".
