HomeMy WebLinkAboutcc min 2012/11/01MINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA November 1, 2012 6:00 p.m. A Special Meeting of the City Council of the City of Chula Vista was called to order at 6:27 p.m. in the Council Chambers, located in City Hall, 276 Fourth Avenue, Chula Vista, California. ROLL CALL PRESENT: Councilmembers Aguilar, Bensoussan, Ramirez, and Mayor Cox ABSENT: Councilmember Castaneda ALSO PRESENT: City Attorney Googins, City Manager Sandoval, City Clerk Norris, Senior Deputy City Clerk Bigelow PLEDGE OF ALLEGIANCE Mayor Cox led the Pledge of Allegiance. ACTION ITEMS L CONSIDERATION OF ORDINANCES OF THE CITY OF CHULA VISTA RELATING TO THE LICENSING AND OPERATIONS STANDARD FOR SEXUALLY ORIENTED BUSINESSES Deborah Fox, partner in the law firm of Meyers Nave, presented an extensive report on the proposed ordinance regulating the licensing and operational standazds for sexually oriented businesses and performers. She made reference to the studies and other information contained in the staff report and the ordinance itself regarding the adverse secondary effects of sexually oriented businesses. She noted that nine large binders containing this evidence were available for review at the City Clerk's station on the dais. Ms. Fox and City Attorney Googins presented some proposed minor changes to the proposed urgency and non-urgency ordinances and indicated that staff s recommendation included those changes. Chief Bejarano provided additional information on his experience with sexually oriented businesses, particularly during his tenure with the City of San Diego Police Department, and the secondary effects that such businesses cause. In response to a question from Mayor Cox, Ms. Fox stated that the Council could change the recommended provisions to require security to be present 30 minutes prior to sunset. Page 1 ~ Council Minutes November 1, 2012 Lany Breitfelder-Navas, Chula Vista resident, spoke in support of an investigation of procedures regazding the approval of sexually oriented businesses in Chula Vista. City Attorney Googins stated that the proposed ordinances would apply to all existing and future sexually oriented businesses in Chula Vista. He reported that as a courtesy, the agenda and a copy of the item was provided to legal counsel for the Eye Candy Showgirls operation, Mr. Roger Jon Diamond, as well as delivered to Mr. Welty at the premises. He stated Mr. Diamond confirmed the notice was received and that he requested the Council postpone the meeting to allow him to appear. In light of the urgent nature of the item, City Attorney Googins recommended that the urgency ordinance be adopted and the ordinance be placed on first reading. A. AN URGENCY ORDINANCE NO. 3239 OF THE CITY OF CHULA VISTA AMENDING THE CHULA VISTA MUNICIPAL CODE BY AMENDING CHAPTER 9.13 REGULATING THE LICENSING AND OPERATIONS STANDARD FOR SEXUALLY ORIENTED BUSINESSES AND REPEALING CHAPTER 9.22 (4/STHS VOTE REQUIRED) ACTION: Councilmember Ramirez moved to adopt urgency Ordinance No. 3239, heading read, text waived. Councilmember Bensoussan seconded the motion, and it carried 4-0. B. AN ORDINANCE OF THE CITY OF CHULA VISTA AMENDING THE CHULA VISTA MUNICIPAL CODE BY AMENDING CHAPTER 9.13 REGULATING THE LICENSING AND OPERATIONS STANDARD FOR SEXUALLY ORIENTED BUSINESSES AND REPEALING CHAPTER 9.22 (FIRST READING) ACTION: Mayor Cox moved to place the ordinance on first reading, heading read, text waived. Councilmember Bensoussan seconded the motion, and it carried 4-0. ADJOURNMENT At 7:10 p.m., Mayor Cox adjourned the meeting to the next Regulaz City Council Meeting on November 6, 2012, at 2:00 p.m., in the Council Chambers.
