RESOLUTION OF THE CITY OF CHL'LA VISTA PLANNING
COMMISSION RECOMMENDING THAT THE CITY COUNCIL
ADOPT MITIGATED NEGATIVE DECLARATION AND
MITIGATION MONITORIlVG AND REPORTING PROGRAM IS-
12-01,ADOPT TENTATIVE MAP PCS-12-01, AND ADOPT AN
ORDINANCE AMENDING THE ZONING MAPS ESTABLISHED
BY MUNICIPAL CODE SECTION l 9.18.010 BY REZONING THE
PARCEL LOCATED AT 35 TAMARINDO WAY FROM R1-7P TO
Rl -SP AND ADOPTING PRECISE PLAN STANDARDS FOR THE
PARCEL
WHEREAS, the area of land, which is the subject of this ordinance is diagrammatically j
represented in Exhibit "A" which is incorporated into the ordinance by this reference, and for the
purpose of general description consists of a 2.32-acre parcel located at 35 Tamarindo Way ("Project
Site"); and

WHEREAS, on January 26, 2012, Rezone, Precise Plan, Tentative Parcel Map, and Initial I
Study applications were filed by Mr. J.P. Mariscal on behalf of 35 Tamarindo, Li.C
("Owner/Applicant") with the Development Services Departrnent of the City of ChLda Vista
requesting a rezone of the Project Site from the Rl-7P Zone to the Rl-SP Zone, adopting Precise i
Plan standards for the Project Site, and proposing to subdivide the 2.32-acre Project Site into 16 lots
for the construction of single-family houses- ("Project"); and
WHEREAS, the Development Services Director has reviewed the proposed Project for
compliance with the California Environmental Quality Act and has conducted an Initial Study, IS-12- `
O1 in accordance with the California Environmental Quality Act, and based upon the results of the
Initial Study, the Development Services Director has determined that the project could result in I
significant effects on the environment. However, revisions to the project made by or agreed to by
the Applicant would avoid the effects or mitigate the effects to a' point where clearly no significant
effects would occur; therefore, the Development Services Director has prepared a Mitigated Negative ~
Declaration and Mitigation Monitoring and Reporting Program, IS-12-01; and .
WHEREAS, the Planning Commission finds that the Mitigated Negative Declaration and
Mitigation Monitoring Program (IS-12-O1), has been prepared in accordance with requirements of
CEQA, the State CEQA Guidelines and the Environmental Review Procedures of the City of Chula
Vista; and
WHEREAS, the Development Services Director set the time and place for a hearing by the
City of Chula Vista Planning Commission on the Project, and notice of said hearing, together with its
purpose, was given by its publication in a newspaper of general circulation in the city and its mailing
to property owners within 500 feet of the exterior boundaries ofthe property, at least 10 days prior to
the hearing; and,
WHEREAS, the hearing was held at the time and place as advertised, namely 6:00 p.m.,
November 14, 2012, in the Council Chambers, 276 Fourth Avenue, before the Planning Commission
and said hearing was thereafter closed.

NOW, THEREFORE, BE IT RESOLVED THAT THE PLANNING COMMISSION
recommends that the City Council adopt the attached draft resolution adopting Mitigated Negative
Declaration and Mitigation Monitoring and Reporting Program, IS-12-O1, and approving Tentative i
Map PCS-12-O1 subject to the conditions listed in Exhibit B, based on the findings contained in the
draft resolution.
BE IT FURTHER RESOLVED THAT THE PLANING COMMISSION recommends that
the City Council adopt the attached ordinance rezoning the Project Site from Rl-7P to R 1-SP and
adopting Precise Plan standards based on the findings and subject to the conditions contained in the ~I
attached Draft City Council Ordinance.
BE IT FURTHER RESOLVED THAT a copy of this resolution be transmitted to the City
Council.
