RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AMENDING THE COMPENSATION SCHEDULE AND CLASSIFICATION PLAN TO REFLECT CHANGES IN TITLES FOR VARIOUS POSITIONS AND AMENDING THE FISCAL YEAR 2012/2013 POLICE GRANT FUND AUTHORIZED STAFFING LEVEL TO REFLECT THESE CHANGES B. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ADDING ONE FA NETWORK ENGINEER TO THE AUTHORIZED STAFFING LEVEL OF THE POLICE DEPARTMENT AND APPROPRIATING $10,051 TO THE FISCAL YEAR 2012/2013 BUDGET OF THE POLICE GRANT FUND C. ORDINANCE OF THE CITY OF CHULA VISTA AMENDING CHULA VISTA MUNICIPAL CODE SECTION 2.05.010 RELATING TO THE ESTABLISHT OF UNCLASSIFIED POSITIONS SUBMITTED BY: CHIEF OF POLICE REVIEWED BY: CITY MANAGE 4/STHS VOTE: YES X NO SUMMARY The proposed action would retitle positions with the "CBAG" header to that of "FA" (Fiscal Agent). This is being done to better designate positions in the classification and compensation plan which aze part of the Police Departments program to support various law enforcement programs which are funded from outside sources of revenue. This would also amend Chula Vista Municiple Code 2.05.010 to reflect the title changes. Additionally, the Police Department has an existing memorandum of understanding with the San Diego Regional Computer Forensics Laboratory (RCFL) to hire hourly RCFL Network Engineers. RCFL is requesting to hire one full-time permanent position instead of hourly personnel. These personnel costs are fully reimbursed by RCFL, along with a 4% administrative fee for acting as the fiscal agent. 21-1 12/1 V2012 Item ~w~ 1 Page 2 of 4 ENVIRONMENTAL REVIEW This proposed activity has been reviewed for compliance with the California Environmental Quality Act (CEQA) and it has been determined that the activity is not a "Project" as defined under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is necessary. RECOMMENDATION Council adopt the resolutions and approve the ordinance. BOARDS/COMMISSION RECOMMENDATION Not Applicable. DISCUSSION Title Changes The Police Department acts as the fiscal agent for various law enforcement programs which are funded through various State and Federal agencies. As the fiscal agent, the Police Department hires and provides salary and benefits for positions which are normally considered separate from existing City staffing. Until recently, the only program to which the Police Department is the fiscal agent for was the California Border Alliance Group (CBAG). The Department has expanded its role as a fiscal agent and has now included the Region Computer Forensics. Lab as well as other programs. Because of this, the Department is requesting retitling positions which have the word "CBAG" in the title to that of "FA" (Fiscal Agent). The City included the word "CBAG" in the item title (e. g. CBAG Public Safety Analyst) to delineate that position in out classification and compensation plan, thereby making it easier to track. these positions for budgetary and human resources purposes. As we've begun to add non CBAG positions, rather than having multiple titles for positions whose duties and salaries are the same, the Police Department is proposing changing all the CBAG titles to that of "FA" (e.g. Old -CBAG Network Engineer; New - FA Network Engineer). This will significantly enhance the City's ability to maintain a classification and compensation plan which is concise and allow the Finance Department, Human Resources and Police Departmenbto track these classifications more easily. Attachment "A" outlines the proposed title changes. RCFL Position In ?011, the San Diego Regional Computer Forensics Laboratory (RCFL) requested that the City of Chula Vista act as the fiscal agent for hiring hourly employees to work in the RCFL to conduct forensic criminal investigations of computer equipment that may hold evidence of crimiral activity. The San Diego RCFL is a one-stop, full service forensics laboratory and training center devoted entirely to the examination of digital evidence in support of criminal investigations. Its mission is to provide computer-related assistance to law enforcement agencies within San Diego and Imperial counties. Its facility has the distinction of being the first established FBI-sponsored RCFL in the country. Law enforcement agencies participate in the RCFL either by assigning full-time staff to the task force or by paying for forensic services on an as-needed basis. The funds collected by the RCFL 21-2 12/11/2012 Item ~~ Pale 3 of 4 for as-needed services will now pay for additional needed staff time and equipment/supplies required for these forensic examinations. The RCFL Director has asked the Police Department to hire orie full-time permanent FA Network Engineer instead of part-time hourly positions. This request requires adding one FA Network Engineer to the authorized staffing of the Police Department. This unclassified position will be fully reimbursed by RCFL and the City will receive a 4% administrative fee for acting as the fiscal agent. ,. DECISION MAKER CONFLICT Staff has reviewed the decision contemplated by this action and has determined that it is not site specific and consequently, the 500-foot rule found in California Code of Regulations section 18704.2(a)(1) is not applicable to this decision. Staff is not independently aware, nor has staff been informed by any City Councilmember, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter. CURRENT YEAR FISCAL IMPACT Approval of Resolution A will result in the amendment of the compensation schedule and classification plan and also to the fiscal year 2012/2013 Police Department Grant Fund to reflect the change in titles as noted in Attachment "A". There is no fiscal impact in making these title changes. Approval of Resolution B will result in the appropriation of $10,051 to the personnel services category of the Police Deparhnent fiscal year 2012/2013 budget for the addition of a FA Network Engineer to the authorized position count of the Police Department Grant Fund. This position was formerly an hourly position, so the only additional appropriations are for benefits. The Department anticipates filling this position in January 2013. These personnel costs are fully reimbursed by the Regional Computer Forensics Laboratory, and the Ciry. receives a 4% administrative fee for acting as the fiscal intermediary 'for RCFL. Because of the 4% administrative fee, there is a positive impact of $402 to the General Fund. Approval of the Ordinance will amend Chula Vista Municipal Code 2.05.010 to reflect the title changes. There is no fiscal impact in making these title changes ONGOING FISCAL IMPACT The ongoing annual costs for the FA Network Engineer in this proposal are approximately $114,000. These personnel costs are fully reimbursed by the Regional Computer Forensics Laboratory; and the City receives a 4% administrative fee for acting as the fiscal intermediary for RCFL. Because of the 4% administrative fee, there will be a positive impact of approximately $4,560 to the General Fund each fiscal year. If RCFL no longer funds the position, then it will be eliminated. ORDINANCE OF THE CITY OF CHULA VISTA AMENDNG CHULA VISTA MUNICIPAL CODE SECTION 2.05.010 RELATING TO TFIE ESTABLISHMENT OF UNCLASSIFIED POSITIONS WHEREAS, the Human Resotuces Department has created new classifications to better reflect the needs of the City's workforce; and WHEREAS, Chula Vista City Charter Section 500(a) requires that all new unclassified management level positions be adopted by ordinance and afoot-fifths vote of the Council. NOW THEREFORE the City Council of the City of Chula Vista does ordain as follows: Section L That Section 2.05.010 of the Chula Vista Municipal Code is hereby amended to read as follows: 2.05.10 Unclassified positions established. Severability If any portion of this Ordinance, or its application to any person or circumstance, is for any reason held to be invalid, unenforceable or unconstitutional, by a court of competent jurisdiction, that portion shall be deemed severable, and such invalidity,'unenforceabilitp or rmconstitutiionality shall not affect Che validity or enforceability of the remaining portions of the Ordinance, or its application to any other person or circumstance. The City Council of the City of Chula Vista hereby declares Chat it would have adopted each section, sentence, clause or phrase of this Ordinance, irrespective of the fact Chat any one or more other sections, sentences, clauses or phrases of the Ordinance be declared invalid, unenforceable or unconstitutional.
