SUMMARY
On April 23, 2012, Caltrans announced a combined call for Highway Safety Improvement
Program (HSIP) and HSIP and High Risk Rural Roads (HR3) Program R3 projects based upon
anticipated federal safety funding in the upcoming 2013 FSTIP starting in October 2012. On
July 10, 2012, by Resolution 2012-137, Council authorized staff to submit applications for two
projects. The State recently notified staff that the City has been awarded two grants totaling
$586,300 for Moss Street corridor improvements between Third and Fourth Avenues Project,
and Traffic Signal Modifications at the intersections of Third Avenue/"J" Street and Third
Avenue/ Naples Street Project.

ENVIRONMENTAL REVIEW
The Development Services Director has reviewed the proposed action, consisting of the
acceptance and appropriation of State grant funds for two city projects for compliance with the
California Environmental Quality Act (CEQA) and has determined that said action qualifies for a
Class 3 categorical exemption pursuant to Section 15303 [New Construction or Conversion of
Small Structures] of the State CEQA Guidelines because the projects consist of installation of
minor new street improvements within existing street right-of--way including the upgrade and
modifying of two existing traffic signals with ancillazy improvements. Thus no further
environmental review is required.
RECOMMENDATION
Council adopt the resolution.

Not applicable.
DISCUSSION
Section 1401 of the Safe, Accountable, Flexible, Efficient, Transportation, and Equity Act -
Legacy for Users (SAFETEA-LU) amended Section 148 of Title 23 to create a new, core
Highway Safety Improvement Program (HSIP). Additionally, SAFETEA-LU introduced a new
set-aside provision known as the High Risk Rural Roads (HR3) Program, codified as 23 U.S.C.
§148(f). On April 23, 2012, Caltrans announced a combined call for HSIP and HR3 projects
based upon anticipated approximately $100 million for HSIP and $15 million for HR3 in their
respective 4 year plans.
On July 10, 2012, Council approved Resolution 2010-163 (Attachment # 1), which authorized
staff to submit grant applications for HSIP Grant Program funding for improvements for two
projects. Individual CIP projects were not created at that time; since it was not known which
projects would receive grant funding. However, it was recommended that the matching funds
would be provided from the City's TransNet allocation.
The Director of Public Works received a letter from Caltrans dated October 26, 2012
(Attachment # 2), stating that the City of Chula Vista had been awazded a total amount of
$586,300 in HSIP funds out of the FY 2012/2013 allocation for the following two projects:
Project No. 1 (STL394)
Moss Street corridor improvements between Third Avenue & Fourth Avenue (300 block).
The $300,000 project scope consists of upgrading the traffic signals to provide for the
installation of protected left turn lane phasing at the intersection of Third Avenue/Moss Street,
traffic signal pedestrian improvements at Fourth Avenue/Moss Street intersection, and the
installation of missing sidewalks within project limit. The project location is along Moss Street
between Third Avenue and Fourth Avenue (300 block), that lacks sidewalks, curb and gutters,
and ADA compliant pedestrian ramps. Also, the work consists of installing Portland Cement
Concrete monolithic curb, gutter, and sidewalks, ADA pedestrian ramps, asphalt concrete
pavement, and other miscellaneous items of work necessary for the project. This project will

serve Harborside and Rice Elementary Schools, Chula Vista Adult School, and the single and
multi residential properties along both sides of Moss Street.
There is approximately 400 L.F. of work needed along the north side of this block. The Moss
Street corridor was rated as priority #21 of the top 30 priority corridors recommended for
pedestrian improvements under the City Adopted "2010 Pedestrian Master Plan".
The awarded grant amount for this project is $267,800 (90%). The grant also requires a local
match of 10 percent for total amount of $26,780 (10%), which will come from TransNet Funds
transferred from CIP TF382.
Project No. 2 (TF382)
Traffic Signal Modifications at the intersections of Third Avenue/"J" Street & Third
Avenue/ Naples Street.
This $355,000 project is to upgrade and modify two existing traffic signals at the intersections of
Third Avenue /"J" Street and Third Avenue/Naples Street. The proposed protected left-turn only
phase movement is targeted at reducing the frequency of collisions resulting from conflicts
associated with left-turn maneuvers and opposing through vehicles. Also, as part of the
improvement is the installation of ADA compliant push buttons with 4-part crossing instruction
signs, installation of loop detectors, re-wiring the intersection, minor sidewalk improvements,
construction of ADA compliant pedestrian ramps, enhanced re-striping and signage, and other
required traffic control devices.
The awarded grant amount for this project is $318,500 (90%). The grant also requires a local
match of 10 percent for total amount of $31,850 (10%), which is coming from TransNet Funds
already budgeted in the CIP.
There is $191,370 in TransNet funds remaining in CIP Project TF382 that will be programmed
and appropriated in FY 2013/2014 as part of the CIP process. On December 4`h, Council
approved an amendment to the TransNet Regional Transportation Improvement Plan (RTIP) that
authorized the TransNet revisions to some City CIP projects, but it is necessary to accept the
HSIP funds and program these grant funds into the current year CIP Program. A condition of the
grant is that work commences within 6 months of the authorization to proceed.
DECISION MAKER CONFLICT
Staff has reviewed the property holdings of the City Council and has found no property holdings
within 500 feet of the boundaries of the properties that are the subject of this action. Staff is not
independently aware, nor has staff been infomted by any City Councilmember, of any other fact
that may constitute a basis for a decision maker conflict of interest in this matter.
CURRENT YEAR FISCAL IMPACT
There is no direct fiscal impact to the City General Fund as project and staff costs are covered by
a combination of HSIP grant funds and TransNet Funds.

ONGOING FISCAL IMPACT
There is no ongoing fiscal impact at this time. The improvements will require only routine City
maintenance.

FISCAL YEAR 2012/2013 HIGHWAY SAFETY
IMPROVEMENT PROGRAM CYCLE 5 GRANT
APPLICATIONS AND COMMITTING MATCHING FUNDS
THEREFOR
WHEREAS, Section 1401 of the Safe, Accountable, Flexible, Efficient, Transportation,
and Equity Act -Legacy for Users (SAFETEA-LU) amended Section 148 of Title 23 to create a
new, core Highway Safety Improvement Program (HSIP); and
WHEREAS, on April 23, 2012, Caltrans announced a call for HSIP projects based upon
anticipated Federal safety funding in the 2012/2013 Federal Fiscal Yeaz (FFY} which began
October 2012; and
WHEREAS, this call for projects is through its competitive Highway Safety
Improvement Program (HSIP) grant program; and
WHEREAS, Caltrans expects the HSIP Cycle 5 funding apportioned to local agencies to
be approximately $100 million; and
WHEREAS, for a project to be eligible a specific problem must be identified for
correction and the proposed countermeasure must correct or substantially improve the condition;
and
WHEREAS, City staff recommends applying for HSIP grant funds and has identified the
following two different types of projects:
• Modify an existing traffic signal at an intersection and install missing infrastructure, such
as sidewalks, curbs, gutters and pedestrian ramps
• Modify an existing traffic signal at an intersection to reduce the accident rate; and
WHEREAS, the projects aze:
1. Moss Street corridor improvements between Third and Fourth Avenues.
2. Traffic Signal Modifications at the intersections of Third Avenue/"J" Street and Third
Avenue/Naples Street.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby authorize submittal of Federal Fiscal Yeaz 2012/2013 Highway Safety
Improvement Program Cycle 5 grant applications and commit matching funds therefor.

221 projects were se]ected from a candidate pool of 276 applications. The selected HSIP and
High Risk Rural Roads (HR3) projects, totaling $111 million, will utilize the available HSIP
programming capacity in the 2013 Federal Statewide Transportation Improvement Plan (FSTIP).
All projects competed on the basis of their Benefit Cost Ratio.
With this notification that the City's projects have been approved for HSIP/HR3 funding;
Caltrans now expects the City to expedite the delivery of these safety projects wherever
practical.

For all HSIP and HR3 projects, Caltrans requires agencies to meet delivery deadlines for three
key milestones. The three milestones and delivery deadlines are as follows:
1. Request for Authorization to Proceed with Preliminary Engineering (PE) within 6 months
after the project is amended into the FSTIP. Note: For agencies that do not need an
Authorization to Proceed >nrith PE because they are not using federal funds for this phase,
the agency will only be held to requesting Construction Authorization within 30 months
after the project is amended into the FSTIP.
2. Request for Authorization to Proceed with Construction (CON) within 30 months (2 '/z
years) after the project is amended into the FSTIP.
3. Complete constriction and close out project within 54 months (4 '/z years) after the
project is aniended into the FSTIP.
Caltrans will track the delivery of these selected HSIP and HR3 projects and prepare a quarterly
report showing the delivery performance of each project. The quarterly report link is:

Projects that miss milestones per the HSIP/HR3 guidelines will be flagged in these reports.
Caltrans will not accept HSIP/HR3 applications from agencies that have flagged projects during
future open `call for projects' cycles.
Caltrans reserves the right to re-program the unobligated federal funds for projects that do not
meet these delivery milestone requirements and become flagged. Any unobligated federal funds
may be re-programmed to outside of the active 4-year element of the FSTIP. By reserving the
right to re-program the unobligated federal funds for projects that do not meet the delivery
requirements, Caltrans expects to maintain programming flexibility for our safety programs and
effectively manage the programming capacity. Iu addition, airy agency that has not initiated their
project by the first milestone date will be required to submit status and justification for the
project to remain in the program. These updated Project Delivery Requirements have been
posted at the delivery status website referenced above.

The San Diego Association of Governments (SANDAG) will be informed of each project being
approved for funding. Caltrans Headquarters staff will work with SANDAG to include each
project in their next FSTIP Amendment. immediately after the FSTIP Amendment has been
approved by the Federal Highway Administration (FHWA), the City will be notified of its
approval and may then submit a request for authorization (RFA) to begin reimbursable work on
the project in accordance with federal-aid project implementation procedures.

The City is encouraged to complete non-reimbursable activities and prepare documents required
for the initial RFA to proceed with PE, ROW, or CON, whichever phase is appropriate for the
project. These efforts can and should begin now in anticipation of the City's projects being
approved in the FSTIP. Please contact Erwin Isidro at (619) 220-5309, or at
erwin_isidro@dot.ca.gov, to arrange for an on-site field review to evaluate and assess the entire
scope of the safety projects. Afield review form can be found in the Local Assistance Procedures
Manual or at the Local Programs website: http://www.dot.ca.gov/hq/LocalPrograms/lam/lapm.htm.
Given that HSIP/HR3 safety projects are lump-sum programmed in the FSTIP, it can be
expected that one or more phases of a project's delivery schedule will not match the FFY in the
FSTIP. When this occurs, local agencies will use the Expedited Project Selection Procedure
(EPSP) in conjunction with their RFA. More information on when local agencies are expected to
use EPSP on HISP/HR3 projects and the procedures to follow can be found at the above.

Modifications at the intersections of Third Avenue/"J" street and Third Avenue/Naples Street";
amend the FY 2012/2013 CIP program budget and appropriate HSIP Funds to the Other
Transportation Programs Fund in the amount of $267,800 for STL394 and $318,500 for TF382;
transfer $26,780 in TransNet Funds from CIP TF382 to CIP STL394; and further reducing
TransNet funding in CIP TF382 by $191,370.
