RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA
VISTA APPROPRIATING FUNDS FROM THE OTAY VALLEY
ROAD ASSESSMENT DISTRICT 90-2 CONSTRUCTION FUND TO
THE OTAY VALLEY ROAD WIDENING CAPITAL PROJECT FOR
PROJECT RELATED COSTS
WHEREAS, the City Council approved the formation of Assessment District 90-2 (Otay
Valley Road) on June 23, 1992, for the purpose of funding the road widening and other
improvements from 1-805 to 1,200 feet east of Nirvana Avenue; and
WHEREAS, the construction work was completed a few years ago; however, the
contractor on the project, Granite Construction, sued the City and the settlement was reached
in December, 1998; and
WHEREAS, $400,000 was paid from funds remaining in the road widening capital
project balance, including Assessment District funds, and those funds had been set aside for
the implementation of environmental mitigation requirements including the purchase of 6.6
acres of wetlands, for a total of 12.66 acres of mitigation property; and
WHEREAS, it is proposed that District funds can be used to reimburse the General Fund
for staff costs associated with the lawsuit and pay the settlement cost.
NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Chula Vista does
hereby appropriate ~619,655.12 from the available balance in the Otay Valley Road 90-2
Construction Fund to the Otay Valley Road CIP Project, including $450,000 for environmental
mitigation costs; ~92,900.27 for settlement costs; and ~76,854.85 to reimburse the General
Fund for staff and associated costs.
