CIVIL SERVICE COMMISSION CITY OF CHULA VISTA MINUTES February 5, 2009 HR Training Conference Room Thursday, 4:00 p.m. Public Services North 1. MEETING CALL TO ORDER 5:15 p.m. 2. MEMBERS PRESENT: Floros ©Saucedo ©Marrufo ©Stevenson ® Brannan Commissioners Stevenson and Brannan arrived at 4:25 p.m. 3. APPROVAL OF MINUTES: Regular meeting of October 2, 2008 Special Meeting of December 10, 2008 Special Meeting of December 17, 2008 Special meeting of January 13, 2009 MSC (SAUCEDO/MARRUFO) 3-0 To approve the Minutes as submitted. (STEVENSON/BRANNAN -Arrived late) 4. (STEVENSON/BRANNAN -Arrived late) 5. APPROVAL OF ELIGIBLE UST -None submitted 6. NEW BUSINESS - A. Request for merit increase for Brendan Reed submitted by Michael Meacham, Director of Conservation & Environmental Services. Michael Meacham, Director of Conservation& Environmental Services spoke highly of Mr. Reed. Mr. Meacham commended Mr. Reed for his leadership skills, ability to collaborate with others and his creative ways of funding programs. MSC (STEVENSON/MARRUFO) 5-0 To approve the Request for Merit increase for Brendan Reed. B. Request Extension of Temporary Appointment of Games Garcia submitted by Fire Chief Dave Hanneman. Fire Chief Hanneman provided information on the Fire department's budget and the re-organization that has taken place. Chief Hanneman explained that a temporary appointment was needed due to several projects that were in progress. Beginning in the next budget cycle, the department plans for a fully funded Deputy Chief position. Discussions to open the position within 30 days have been completed with the Human Resources Department. Fire Chief Hanneman stated that it was not the intent of the department to extend the temporary assignment but due to the appointment of a new Fire Chief, on-going projects, movement of Fire Administration and budgetary issues, the request was submitted. Marcia Raskin, Human Resources Director provided clarification regarding the position level, salary and • bargaining union placement. Civil Service Commission Minutes February 5, 2009 • Steve Miller, IAFF President stated that the IAFF Union has requested that the job announcement be completed in 30 days and that the recruitment process is to follow. This will ensure that the process will not be delayed. Local members have concerns that if the recruitment is not conducted in a timely manner, that there will bean unfair advantage to those employees that have not had the opportunity to work in the management arena. Marcia Raskin, Director of Human Resources commented that the assignment will be extended until June 30~'. She also stated that the department hopes to have the recruitment process completed by the end of the fiscal year. MSC (SAUCEDO/MARRUFO) 5-0 To approve the Request to extend the temporary assignment of James Garcia as submitted. Commission Stevenson voiced her concerns on how the temporary appointment rule was utilized in this manner. She does not believe that this was the intended use of the temporary appointment rule. The rule is intended for a position that exists and that it brings somebody from the outside to temporarily fill the position absent a process and until an eligible list is created. She also commented that it would have been preferable to use the interim or acting process. Ms. Stevenson hopes that this request or the use of the rule in this manner not come before the Commission again. Marcia Raskin, Director of Human Resources commented that in the 10 years that she has worked for the city, she does not believe that they have brought anything like this to the Commission. She commented that the intentions were in the right place and to compensate an employee appropriately for the work that they are doing. MSC (SAUCEDO/MARRUFO) 5-0 To approve the extension of the temporary assignment and the 30-day time • frame in which to start the process. C. Appeal of Termination. (CSC.050) The Commissioners checked calendars should it be necessary to continue this evening's hearing. D. Appeal of Termination. (CSC.051) Staff informed the Commission that the Appellant's Attomey has requested 10 evenings in which to hear the appeal. The Commissioners discussed dates with staff. Chair Floros commented that requesting 10 days to hear an appeal is excessive and asked what is the protocol to be able to discuss with those involved the length of a hearing. Marcia Raskin, Director of Human Resources said that she would work with the City Attorney's office to help discuss on how to expedite the appeal hearing process. Commissioner Brannan mentioned that if parties submit a witness list with an offer of proof as to what they are going to testify to, it would limit who Counsel brings in. She believes that the Commission can rule on whether that individuals could testify or not. She also believes that one witness testimony on an issue is sufficient. Marcia Raskin, Director of Human Resources stated that she would set up a meeting with the Chair, Ciry Attomey and possibly the Police Chief to discuss parameters. 7. OTHER BUSINESS - A. Chair's Comments Chair Floros stated that he appreciates everyone's service to the Commission. B. Commissioners' Comments -None C. Staff Comments Marcia Raskin, Director of Human Resources announced that she will be retiring and that Kelley Bacon, Assistant Director of Human Resources will be staffing the Commission. She also mentioned that changes that Ex-Chair Silva made to the Civil Service rules have been incorporated. The department is preparing a memo for distribution to the Bargaining Unions and Department Heads. D. Public Comments -None 9. ADJOURNMENT - The Civil Service Commission adjourned to the next regular scheduled meeting on Thursday, March 5, 2009, at 5:15 p.m., in the Conference Room 8129, Public Services North at City Hall, 276 Fourth Avenue, Chula Vista, CA 91910.
