MEETING CALL TO ORDER - by Chair Floros at 5:32 p.m.

3. APPROVAL OF MINUTES: Regular Meeting of January 7, 2010

B. Civil Service Rules
City Attorney Silva explained that discussion of the Civil Service Rules must take place in open session to
comply with the Brown Act provision for labor negotiations. The discussion could only take place in closed
session if the Commission previously designated an individual to act as negotiator with the bargaining groups.
Mr. Silva advised that the Commission could designate staff as negotiators on any points that are not agreed
upon at the meeting.
Director Bacon advised that City staff met with each of the bargaining groups to discuss any concerns they had
after the initial review by the City and the Commission. The bargaining groups provided proposals on changes
and staff met with the bargaining groups to discuss each point. There were at least 73 proposals, which Mr.
Silva summarized to ensure the changes were consistent and accurate. The list was then incorporated into the
rules that were provided to the Commission for consideration. The City and bargaining groups agreed on most
of the concerns.
The items not agreed upon included
1. Item 1.08 on page 29, regarding violation of any department rule, regulation, or policy. Bargaining
groups opposed language in this rule.
2. Item 2.02 on page 48, regarding sick leave and bereavement. The rule stated that only sick leave
• could be used for sickness or injury. The proposal from bargaining groups was that employees could
use any type of leave, such as vacation, in lieu of sick leave.
3. Item 1.09 on page 40, regarding point calculation for employee bumping in the event of a layoff
situation. A proposal submitted by WCE allowed greater points to persons who moved from a higher
classification to a lower classification during his or her tenure at the City. It was discussed that the

proposed number calculation would significantly impact CVEA employees, as well as those
represented by other bargaining units to a lesser degree. Since the full extent of the impact was
unknown, it was requested that additional time be provided for more research. Mr. Silva suggested
that the Commission consider appointing staff to negotiate with the bargaining groups on this issue.
The bargaining groups and commissioners discussed the proposed changes in the Civil Service Rules and
agreed that most of the items were more appropriately addressed through MOUs between the individual groups
and the City. The labor group representatives agreed with this determination, with the exception of the
language in item 1.08 and point calculation in item 1.09 (as described below).
MSC: (Stevenson/Marrufo) 5-0-0 to adopt the rules in the 1/29/10 revision of the Civil Service Rules as
presented in strike-out version with the following stipulations:
1. 1.08, A, the introductory paragraph will be amended to add language to the effect that in addition to
suspension, demotion, termination, or reduction in pay, a lesser discipline may be administered as
appropriate; and
2. 1.09 regarding point calculation has not been agreed upon. Kelley Bacon, Irene Mosley, and Simon
Silva will be directed to act as negotiators for the purposes of the Meyers-Milias-Brown Act and the
Ralph M. Brown Act to discuss item 1.09 regarding the points assigned in a layoff situation for an
employee who has moved from a higher classification to a lower one in his or her employment at the
City. This item will be brought back for approval by the Commission once staff and the bargaining
groups have discussed further.
Motion passed unanimously.
