FOR SAID EMERGENCY REPAIR DIRECTOR OF PUBLIC WORKS , ASSISTANT DIRECTOR OF ENG RING ' ~M.~/ CITY MANAGER S T~ `' S ASSISTANT CITY MANAGER S l 4/STHS VOTE: YES ^ NO SUMMARY In accordance with the emergency provisions of Section 1009 of the City Charter, City staff contracted the services of TC Construction Company, Ina (General Engineering Contractor License No. 402459) for the repair of storm drain facilities located at Lansley Way and at Mendocino Drive. Repair work was completed on February 7, 2011. This report presents the total expenditures for the emergency repair work. The proposed action would accept the final report of expenditures for the "Emergency Storm Drain Repairs at Lansley Way & Mendocino Drive (DR180F)", make a finding that an emergency existed, and ratify the contract with TC Construction Company, Inc. for said emergency repair work. ENVIRONMENTAL REVIEW The Development Services Director has reviewed the proposed activity consisting of accepting the final report of expenditures and making a finding that an emergency existed and ratifying the contract with a construction company for said emergency repair for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a "Project" as defined under Section 15378 of the State CEQA Guidelines because it involves a governmental fiscal/administrative action that will not result in direct or indirect physical changes to the environment. Therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines the activity is not subject to CEQA. DISCUSSION Severely deteriorated corrugated metal pipe ("CMP") at the Mendocino Drive location and damaged reinforced concrete pipe ("RCP") at 173-179 Lansley Way were discovered by City staff using closed circuit television (CCTV) inspection on April 2010. Because failure had already occurred within each of the systems and the failures were in close proximity to residential structures, immediate action was required to avoid damage to City and private property. Each of these storm drain failures, if not repaired, posed imminent threats to public safety and private property due to the high potential for severe slope erosion and development of sinkholes. Therefore, the emergency repairs needed to be undertaken to protect life and property and were funded using TransNet Funds set aside in the Capital Improvement Program budget for such purposes. The Director of Public Works and the City Manager agreed with the recommendation of staff on the necessity of proceeding with the emergency repairs at these two locations under the provisions specified in Section 1009 of the City Charter. In accordance with City Charter Section 1009, and based upon the urgent necessity for the preservation of life, health and property, City staff solicited three informal bids and contracted the services of the lowest responsive bidder, TC Construction Company, Inc., to repair the storm drain facilities. The approval of the resolution would: (1) accept the final report of expenditures for the "Emergency Storm Drain Repairs at Lansley Way & Mendocino Drive (DR180F)", (2) make a finding that an emergency existed, and (3) ratify the contract with TC Construction Company, Inc for said emergency repair work. A breakdown of the total costs is provided under Current Year Fiscal Impact. Contractor Selection Process Staff prepared and solicited three informal bids from qualified contractors that had previously worked for the City of Chula Vista. On November 30, 2010 the City received three proposals. The Contractors were ranked as follows: Contractor Pro osal Amount Contractor Rankin TC Construction Co., Inc. $ 70,980 First Negotiation Preference Arrieta Construction Ina $ 87,798 Second Negotiation Preference Cass Construction Co., Inc. $ 89,860 Third Ne otiation Preference 18-2 11/20/12, Item ~~ Page 3 of 3 DECISION MAKER CONFLICT Staff has reviewed the property holdings of the City Council and has found no property holdings within 500 feet of the boundaries of the property which is the subject of this action. Staff is not independently aware, nor has staff been informed by any City Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter. CURRENT YEAR FISCAL IMPACT There is no impact to the General Fund as there are sufficient TransNet funds in the existing CIP DR180 necessary to fund the project. DR180 project was established in the FY 2009-10 CIP budget for emergency replacement of failed stone drains, primarily corrugated metal pipes, throughout the City. NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Chula Vista does hereby accept the final report of expenditures for the "Emergency Storm Drain Repairs at Lansley Way & Mendocino Drive (DR180F)", make a finding that an emergency existed and ratify the Contract with TC Construction Company, Inc for said emergency repair work.
