until December 31, 201]. The deferral program was extended additional yeaz, to December 31,
201 Z, with adoption of Ordinance 3220. This Ordinance extends the program one more year to
December 31, 2013.
ENVIRONMENTAL REVIEW
The Environmental Review Coordinator has reviewed the proposed activity for compliance with the
California Environmental Quality Act (CEQA) and has determined that the activity is not a
"Project'.'- as defined under Section 15378 of the State CEQA Guidelines because the proposal
consists of a fiscal action that -will not result in a potentially significant physical impact on the
environment Therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines the activity
is not subject to CEQA. Thus, no environmental review is necessary.
RECOMMENDATION
Council approve the Ordinance to take effect and be in full force 30 days after the second

Date of Termination of this Ordinance
The deferral program has been proposed in light of the current period of economic downturn in
order to stimulate development. As such, the deferral program is temporary in nature. The
applicability of this ordinance will be limited to the anticipated period of the current market
slump and will expire on December 31, 2013.
llECISION MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that it is not site
specific and consequently the 500 foot rule found in California Code of Regulations section
18704.2(a)(1) is not applicable.
CURRENT YEAR FISCAL IMPACT
Approval of this ordinance has no General Fund ImpacC. The net effect due to time value of
money issues (the City receives firnds later than traditional) should be of£--set by the fact the fees
will be priced at the time of payment, not the time of building permit issuance, which for
inflation indexed fees, typically means a higher amount.
ONGOING FISCAL IMPACT
The effect of this ordinance in the medium to long term should be negligible given that the
program expires at the end of 2013.
