Although my client is not named specifically in any of the materials you sent to me it is obvious that my client is the target of the proposed urgency ordinance and the regular ordinance being proposed. There is no urgency. Since it is clear that my client is the target I protest the lack of adequate notice. I have glanced through the 120 pages that are part of the Agenda and proposed urgency ordinance and proposed regular ordinance. Even if I were available tonight I would not be in a position to respond. It is fundamentally unfair and a violation of Due Process to set this complicated matter up with no more than 10 hours notice ?????notice when there is no urgency. My office is located in Santa Monica. I am about 3 hours from Chula Vista. I cannot be at the meeting tonight. Please notify the City Council and aks that the meeting be postponed. As far as I can determine my client is operating on property that is zoned correctly for an adult use. My client is exercising rights under the First Amendment to the United States Constitution. I respectfully request that the City Council defer a decision on the urgency ordinance and on the regular ordinance. As far as I can determine the City has no evidence of any improper conduct of my client. It would seem that this would be an important fact. In any event, please contact me immediately so I can discuss with you an appropriate day and time for the City Council to meet and consider the matter. Twenty-four hours is not adequate.
