HomeMy WebLinkAboutReso 1999-19654"' RESOLUTION NO. 19654 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA DECLARING CITY'S INTENTION TO UNDEP`GROUND OVERHEAD UTILITIES ALONG ORANGE AVENUE FROM FOURTH AVENUE TO PALOMAR STREET AND SETTING A PUBLIC HEARING FOR THE FORMATION OF UTILITY UNDEP`GP`OUND DISTP`ICT NUMBER 130 FOP, JANUARY 11, 2000, AT 6:00 P.M. WHEREAS, Chapter 15.32 of the Chula Vista Municipal Code establishes a procedure for the creation of underground utility districts and requires as the initial step in such procedure the holding of a public hearing to ascertain whether public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service in any such district; and WHEREAS, on June 8, 1999, an Underground Utility Advisory Committee (UUAC) meeting was held at the site to determine the proposed boundary of an underground utility district for the conversion of existing overhead utilities along Orange Avenue from Palomar Street to Fourth Avenue; and WHEREAS, it has been recommended that such an underground utility district, hereinafier called "District", be formed. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista as follows: 1. NOTICE IS HEREBY GIVEN that a public hearing will be held in the Council Chambers of the City of Chula Vista at 276 Fourth Avenue in said City on Tuesday, the 1 lth day of January, 2000, at the hour of 6:00 p.m., to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar associated service in the District hereinabove described. At such hearing, all persons interested shall be given an opportunity to be heard. Said hearing may be continued from time to time as may be determined by the City Council. 2. The City Clerk shall notify all affected property owners as shown on the last equalized assessment roll and utilities concerned of the time and place of such hearing by mailing a copy of this resolution to such property owners and utilities concerned at least fifteen days prior to the date thereo£ 3. The area proposed to be included in the District is as shown on Exhibit A attached hereto and made a part hereof by reference.
