ORDINANCE OF THE CITY COUNCIL OF CITY OF CHULA
VISTA APPROVING AMENDMENTS TO THE EASTLAKE III
PLANNED COMMUNITY DISTRICT REGULATIONS AND
LAND USE DISTRICTS MAP FOR 12.2 ACRES LOCATED ON
THE NORTH SIDE OF OLYMPIC PARKWAY, BETWEEN
OLYMPIC VISTA ROAD AND WUESTE ROAD/LAKE CREST
DRIVE
L RECITALS
A. Project Site
WHEREAS, the area of land which is the subject of this Ordinance is
diagrammatically represented in "Exhibit A" attached to and incorporated into this
Ordinance, and commonly known as Olympic Pointe, and for the purpose of general
description herein consists of 12.2 acres located on the north side of Olympic Parkway,
between Olympic Vista Drive and Wueste Road within the Eastlake III Planned Community
("Project Site"); and
B. Project; Application for Discretionary Approvals
WHEREAS, a duly verified application was filed with the City of Chula Vista
Development Services Department on September 30, 2010, by Integral Communities LLC
("Developer"), requesting approval of amendments to the Eastlake III Planned Community
District Regulations and Land Use Districts Map; and
C. Prior Discretionary Approvals
WHEREAS, development of the Project Site has been the subject matter of various
entitlements and agreements, including: 1) a General Plan Amendment, General
Development Plan and Sectional Planning Area Plan and associated Design Guidelines,
Public Facilities Financing Plan, Water Conservation Plan and Air Quality Improvement
Plan and Comprehensive Affordable Housing Plan previously approved by City Council
Resolution No. 2002-220 on July 17, 2001; and
D. Planning Commission Record of Application
WHEREAS, the Planning Commission set the time and place for a hearing on the
Project, and notice ofthe hearing, together with its purpose, was given by its publication in a
newspaper of general circulation in the City and its mailing to property owners within 500
feet of the exterior boundary of the Project, at least ten (10) days prior to the hearing; and
WHEREAS, the Planning Commission held an advertised public hearing on the Project on
the time and date advertised, namely September 12, 2012, and voted 4-2-0-0 to forward a

recommendation to the City Council on the Project; and
WHEREAS, the proceedings and all evidence introduced before the Planning
Commission at the public heazing on this project held on September 12, 2012, and the
minutes and resolution resulting therefrom, aze hereby incorporated into the record of this
proceeding; and
E. City Council Record of Application
WHEREAS, the City Clerk set the time and place for the hearing on the Project
application and notices of the hearing, together with its purpose, was given by its publication
in a newspaper of general circulation in the city and its mailing to property owners within
500 feet of the exterior boundaries of the Project at least ten (] 0) days prior to the hearing;
and
WHEREAS, the duly called and noticed public hearing on the Project was held
before the City Council of the City of Chula Vista on September 25, 2012, in the Council
Chambers in the City Hall, City of Chula Vista Civic Center, 276 Fourth Avenue, at 4:00
p.m. to receive the recommendations of the Planning Commission and to heaz public
testimony with regazd to the same; and
F. Discretionary Approvals Resolution and Ordinance
WHEREAS, at the same City Council hearing at which this Ordinance was
introduced for first reading on September 25, 2012, the City Council of the City of Chula
Vista approved Resolution No.2012-186, by which it approved amendments to the Eastlake
III Sectional Planning Area Plan, Design Guidelines, the Public Facilities Financing Plan, the
Air Quality Improvement Plan and the Water Conservation Plan;
G. Environmental Determination
WHEREAS, the Development Services Director has reviewed the proposed project
for compliance with the California Environmental Quality Act (CEQA) and has determined
that the project was covered previously in Final Environmental Impact Report, Eastlake III
Woods and Vistas Re-planning Program Subsequent EIR #01-01. The Development
Services Director has determined that only minor technical changes or additions to this
document are necessary and that none of the conditions described in Section 15162 of the
State CEQA Guidelines calling for the preparation of a subsequent document have occurred;
therefore, the Development Service Director has prepared an Addendum (IS 10-008) to EIR
01-01.
IL NOW THEREFORE, the City Council of the City of Chula Vista does hereby find,
determine and ordain as follows:

A. CONSISTENCY WITH GENERAL PLAN
The City Council finds that the proposed amendments to the Eastlake III Planned
Community District Regulations and Land Use District Map are consistent with the
City of Chula V ista General Plan. The residential component of the proposed mixed
use would be consistent with the adopted high-density residential designation for this
project site and compatible with the surrounding residential and open space land uses
of the Eastlake azea.
B. APPROVAL OF PROPOSED AMENDMENTS
The City Council approves the amendments to the Eastlake III Planned Community
District Regulations and Land Use District Map as represented in Exhibit B.
III. EFFECTIVE DATE
This ordinance shall take effect and be in full force on the thirtieth day from and after its
adoption.

II 3..4.3 Accessory Uses and Buildings
Accessory uses and accessory buildings customarily appurtenant to a permitted vse are allowed
subject to the requirements of Chapter 19.58 C1/MC_
Roof mounted satellite dishes shall be permitted as accessory structures sub~led to the following
standards or conditions:
A. The dish shall be screened using appropriate matching architectural materials or parapet
wal s;
B. Dishes shall be of a neutral color, match the building, or as otherwise approved by the Zoning
Administrator;
C. A building permit shall be required; and,
D No adverfising material shall be allowed on the satellite dish antenna. Satellite dish antennae
contcining advertising material shall be considered signs,

11.3.4 5 Outdoor Storagec-,ate-:~r'v"=
Except where otherwise approved on a site plan, permanent outdoor storage areas shall be entirely
enclosed by solid walls not less than six feet in height to adequately screen outdoor storage areas
Stored materials shall not be visible above the required walls.
11 3.4 6 Trash Storage
A All developments in thz rd~mixed use districts shall prohde areas for trash storage as
determined by the City.. These areas shall be enclosed within a minimum five-foot high masonry wall,
or higher if deemed necessary in site plan approval, to adequately screen the trash area, built to
standards adopted by the city for a freestanding wall and shall be designed to accommodate the trash
containers used by the trash service company contracted with the city

11.3 4.8 Landscaping

accordance with the City Landscape Manual, All required landscaping shall be permanently
maintained in a healthy and thriving condition, free from weeds, trash end debris Decorative type
retaining walls shall be used where exposed to public view.

II 3.4.9 Periormonce Standards
A. The noise level emaneting from any commercial use or operation shall not exceed the
standards established in the Chula Vsta Municipal Code.
B. All ground mounted mechanical equipment, including hecting and air conditioning units, shall
be completely screened from public view and sun~ounding properties by use of a wolF o; fence,
or shall be enclosed within ^ building. No equipment so screened shall have o height greater
than that of the enclosing wall, fence or building. Structural and design pldns for any
screening required under the provisions of this section shcll be approved by the Zoning
Administrator.
G. All roof appurtenances. including, but not limited to, air conditioning units, ^ng mechanical
equipment shall be shielded and orchitecturollyscreeWed from view from on-site parking areas
and adjacent public streets

• Eave coverage for windows
- Earih berming against e~erior walls
• Deciduous shade trees on southerly or westerly orientations
• Refer to fhe SPA Design Guidelines for additional design guidelines and criteria
