RESOLUTION NO. 4051
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
APPROVING AGREEMENT BETWEEN THE CITY OF CHULA VISTA AND
TRi-COUNTX BUILDING, INC., PROVIDING FOR SINGLE OWNERSHIP
OR CERTAIN PARCELS OF PROPERTY TN SAID CITY
AND AUTHORIZING THE MAYOR TO EXECUTE SAME
The City Council of the City of Chula Vista does hereby
resolve as follows:
That that certain agreement between the City of Chula Vista,
a municipal corporation, and
dated the 13th day of June
Tri-County Building, Inc.
19 66 a copy of which
is attached hereto and incorporated herein, the same as though fully
set forth herein be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Mayor of the City of Chula
Vista be, and he is hereby authorized and directed to execute said
agreement for and on behalf of said City.
BE IT FURTHER RESOLVED that the City Clerk be, .and he is
hereby directed to record said agreement in the Office of the County
Recorder of San Diego County.

!~ THIS AGREEMENT, made and entered into this 13~ day of
~;~~:...~ 1966, by and between the CITY OF CHULA VISTA, a
munie~:pal corporation, hereinafter called "City", and TRI-_COUNTY
BUIL`DIh3G, INC., a corporation, hereinafter called "Owner';
W I T N E S S E T H
WHEREAS, Tri-County Building, Inc. is the owner of a certain
lot in the City of Chula Vista more particularly described as Parcel
No. 565-131-20, and
WHEREAS, Frank E. Ferreira, an individual, and principal
stockholder in Tri-County Building, Inc., is the owner of certain
lots adjacent to said parcel, more particularly descri~aed as the
Northerly seventy-eight feet (78') of Parcel No. 565-140-1 and Parcel
No. 565-131-3, and
WHEREAS, Frank E. Ferreira desires to construct a multiple-
family apartment building, consisting of some twenty-nine (29) units
on said parcel No. 565-131-3 and the Northerly seventy-eight feet
(78') of Parcel No. 565-140-1, and
WHEREAS, there is an existing apartment building consisting
of sixty (60) or more units owned by Tri-County Building, Inc., located
on Parcel No. 565-131-20, known as Whispering Trees Club and Apartments,
and
WHEREAS, the required parking for the existing apartment build-
ing and the proposed apartment building is accessible by means of a paved
roadway located on the Easterly fifteen feet (15') of Parcel No.565-131-20,
which roadway is required and necessary to provide ingress and egress to
the required parking spaces.
NOW, THEREFORE, in consideration of the premises and for other
good and valuable consideration, receipt of which is hereby acknowledged,
the parties hereto mutually agree as follows:
1. Owner agrees that the existing roadway, consisting of a
paved area located on the Easterly fifteen feet (15') of Parcel No. 565-
131-20 is essential to provide access to the required parking area for
the twenty-nine (29) units to be constructed on the adjacent parcels as
hereinabove described, and that said roadway will be preserved for said
purpose.
2. Owner further agrees that all of said parcels hereinabove
described shall be held under the ownership of Tri-County Building, Inc.,
and Frank E. Ferreira, an individual, as one common parcel, and in the
event that Owner or Frank E. Ferreira or their heirs or successors in
interest should divide the ownership of said properties, the existing
fifteen foot (15') roadway shall be granted by Owner by deed of easement
to any purchaser of those parcels of land whereon the proposed apartment
units are to be constructed. Said easement shall run with the land and
shall provide mutual benefit to both properties.
3. Owner and Frank E. Ferreira further agree that the grant-
ing of said easement shall be included as one of the conditions in the
escrow instructions involving the sale of either parcel of land.
IN WITNESS WHEREOF, City has caused this agreement to be
executed by having affixed thereto the signature of the Mayor of said
City, acting under and pursuant to Resolution No. 4051 of the City
Council of the City of Chula Vista, .and Owner has caused'-this agreement
to be executed, as authorized, the day and year first hereinabove written.
