RECITING THE FACT OF `rHE GENERAL ELECTION HELD IN SAID CITY ON THE 12TH DAY OF APRIL, 1966, DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW The City Council of the City of Chula Vista does hereby resolve as follows: WHEREAS, a regular :general municipal election was held and conducted in the City of Chula Vista, County of San Diego, State of California, on Tuesday, the 12th day of April, 1966, as required by law, and WHEREAS, notice of said election was duly and regularly given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed, and that in all respects said election was held and conducted and the votes cast thereat, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in general law cities, and WHEREAS, on the 19th day of April, 1966, at the hour of 7:00 p.m. the City Council duly assembled at .ts usual place of meeting and has canvassed the returns of said election and as a result of which, the City Council finds that the number of votes cast and the names of the persons voted for, the office each person was voted for, and other matters required by law to be as stated hereinafter; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CHUL1#r VISTA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: Section 1. That there were 65 voting precincts established for the purpose of holding said election consisting of consolidations of the regular election precincts in the City of Chula Vista and the Chula Vista City School District as established for the holding of state and county elections. Section 2. That said regular general municipal election was held for the purpose of electing the following officers of said City and City School District as required by laws relating to general law cities in the State of California, to wit: Two (2) members of the City Council for the full term of four years; Two C2) members of the Board of Ed~.ication of the Chula Vista City School District for the full term of four years. -1- ,~ t,~©y~f Section 3, That at said regular general municipal election, the following measures were submitted to the electors of said City, to wit: PROPOSITION A. Amend Article II1 of the Charter of the City of Chula Vista to be and to read as follows: ARTLCLE III. CITY COUNCIL. SEC'T'ION 300< MEMBERS AND TERMS. There shall be a City Council of five members consisting of four Councilmen and a Mayor, elected from the City at large at the times and in the manner provided rn this Charter and who shall serve for a term of four years and until their respective successors qualify The members of the City Council in office at the time this Charter takes effect shall .continue in office until th~~ expiration of their respective terms and until their successo~•s qualify The term of each member of the City Council shall commence on the first Tuesday following his election and shall continue until his successor qualifies. Ties among candidates for_ any office shall be settled by the casting of lots, SECTION', 302. COMPENSATION OF COUNCILMEN. The Councilmen of the City Council shall receive no compensation for their services as such, but shalJ_ receive reimbursement on order of the City Council for Council-authorized traveling a.nd other expenses when on official duty out of the city< In addition, each Councilman shall receive the sum of fifty dollars per month, which amount shall be deemed to be reimbursement of other out-of-pocket expenditures and costs imposed upon him in serving as a City Counc~.lman. SECTION 303. VACANCIES. A vacancy in the office of any member of the City Council from whatever cause arising, shall be filled by appointment by the City Council, such appointee to hold office until the first Tuesday follow- ing the next general municipal election and until his successor qualifies. At the next general municipal elect.lon following any vacancy, a Councilman o.r Mayor shall be elected to serve for the re- mainder of any unexpired term of said office<. If a member of the City Council absents h.~rnself from a.ll regular meetings of the City Council for a period o.1r sixty days consecutively =rom and after the last regular City Council meeting attended by such member, unless by permission of the City Council expressed in its official. minutes, or is convicted of a crime involving moral. t.urpi.tude his office shall become vacant. The City Council shall declare the evidence of any vacancy. In the event it shall fail to fill a vacancy by appointment within thirty days after such office shall have been so declared vacant, it shall forthwith cause an election to be held to fill such vacancy< SECTION 304A PRESTDLNG OFFICER, MAYOR (a> There shall be elected at the general runicipal election commencing with the general municipal election ?n April, 1968, a Mayor who shall hold office for a term of four years and until his successor is elected and qual.~fied. F'o:r the purpose of implementing this Section, the office of one of the Counc::~lmen subject to election at said general election shall. be terminated anal cease to exist on the first Tuesday following the election of the Mayor, and there shall be one councilmanc office less than the number which ma~1 be subject to election at said general municipal election pursuant to the pro- visions of the Charter in effect on ,7anuary 1, 1968. (b) The Mayor shall be a member of the City Council and shall perform all the functions and have all of the powers and rights of a duly elected Councilman. In addition. to said powers and duties, the Mayor shall have the power and duty: (l to report to the Council from time to time on the affairs of the City and to recommend for its consideration such matters as he may deem expedient,, and 12) to be the official head of the City for a.ll ceremonial purposes and shall be recognized by the courts for the purpose of serving civil process, for the signing of all legal instruments anal documents, and by the Governor for military purposes, and e,3~ i.n the time of public danger or emergency he may, with consent of the Council and for such period as the Council may fix, take command of the police, ma_ntain order and enforce the law, and 4~ to assume the primar~:~ but not the exclusive responsibility for :interpreting to the people th.e policies, programs 2 _, and needs of the City government and to informing the people of any major change in policy or program The Mayor masr represent the City in any and all matters involv;~ng other gover_nmentaJ_ agencies, provided that no act, promise, commitment or agreement entered Into or committed by the Mayor shall bc: b?.nding upon the City of ~:.h~~~.:ia Vista unless duly authorized or ratified by the City Council, and f5? to perform such other duties consistent with nis office as may be prescribed by this CY~arter or delegated to h.im or imposed on him by tl~e City Council if not inconsistent with the provis~.ons of this Cha.rt_er~ c" The Mayor shall receive an annaal salsz°y of SIX THOUSAND DOLLARS a$6,000.00~ pear year payable at t.l-ie .rate of FIVE HUNDRED DOLLARS t$500.00~ per month and sha11_ receive reimbursement on order of the Council for Council-authorized tra~,rel and othe~~ expenses when on official. duty out of the Czty, and iI7 addit~or., shall receive the sum of FIFTY DOLLARS P$50~OOa per month, which amount shall be deemed to be reimbursement of other out-of-pocket expenditures. The City Council may also prov~.de, by resolution., for the payment to the Mayor of an allowance of a su.m certain per month., to reimburse him for the additional demands ar~d expenses rr~.ade upon and incurred by him in serving as Mayor (d) Mayor Pro Tempore. T.he City Cou.r~ci1 shall also designate one of its members as Mayor Pro Tempore, who shall. serve in such capacity at the pleasure of the City Counc~~.lo The Mayor Pro Tempore shall perform the duties of the Mayor. during hip absence or disability. PROPOSITION B~ Amend Article III of the Charter of the City of Chula Vista to be and to read as follows: ARTICLE ITI. CITY COUNCIL, SECTLON 305. ]:'OWERS VESTED IN THE CITY COUNCIL All powers of the City, except as otherwise provided in this Charter, shall be vested. z.n the City Cour.~cx1?
