HomeMy WebLinkAboutcc min 2012/07/12 Special SAMINUTES OF A SPECIAL MEETING OF THE CITY COUNCIL/ SUCCESSOR AGENCY TO THE REDEVELOPMENT AGENCY OF THE CITY OF CHULA VISTA July 12, 2012 4:00 p.m. A Special Meeting of the City Council/Successor Agency to the Redevelopment Agency of the City of Chula Vista was called to order at 4:04 p.m. in the in the Police Deparhnent Community Room, located at 315 Fourth Avenue, Chula Vista, California. ROLL CALL PRESENT: Council/Agency Members Aguilar, Bensoussan (arrived at 4:06 p.m.), Castaneda, Ramirez, and Mayor/Chairperson Cox ABSENT: None ALSO PRESENT: City Manager Sandoval, City Attorney/Agency Counsel Googins, City Clerk Noms, Senior Deputy City Clerk Bigelow ACTION ITEM RESOLUTION NO. 2012-007 OF THE SUCCESSOR AGENCY TO REDEVELOPMENT AGENCY OF THE CITY OF CHULA VISTA APPROVING AN APPROPRIATION OF $5,529,373 FROM ITS REDEVELOPMENT OBLIGATION RETIREMENT FUND TO MAKE THE REQUIRED PAYMENT PURSUANT TO HEALTH AND SAFETY CODE SECTION 34183.5(b)(2)(A), WITH A RESERVATION OF ANY AND ALL RIGHTS AND REMEDIES (4/STHS VOTE REQUIRED) City Manager Sandoval explained the bill and recommended the Council approve the payment under protest. He stated staff believes the payment calculation is flawed. Agency Counsel Googins stated that, along with other agencies, the City has engaged outside counsel to file a complaint against the County of San Diego and the State Department of Finance to prevent the County from collecting and distributing payment to the taxing agencies. At the request of Chairperson Cox, there was consensus of the Council to send letters to the recipient agencies requesting they not spend any monies received until the situation has been resolved. Assistant Director of Development Services Crockett stated that the amount billed is under dispute and that staff believes the correct amount would be approximately $2 million. Page 1 -Council Minutes July 12, 2012 ACTION: Agency Member Castaneda moved to approve Resolution No. SA 2012-007, heading read, text waived. Councilmember Bensoussan seconded the motion, and it carried 5-0. Chairperson Cox stated the Council would not convene in Closed Session to discuss the item below. CLOSED SESSION 2. CONFERENCE WITH LEGAL COUNSEL -ANTICIPATED LITIGATION Initiation of litigation pursuant to Government Code Section 549569(c) and significant exposure to litigation pursuant to government code section 54956.9(b) Potential cases: One City of Chula Vista and/or Successor Agency to the Redevelopment Agency of the City of Chula Vista v. State of California Department of Finance and possible other named defendants. ADJOURNMENT At 4:38 p.m., Mayor Cox adjourned the meeting. Kerry K.
