The project consists of the removal and replacement of failed asphalt concrete pavement (dig-outs) and application of an asphalt overlay on an existing asphalt paved sewer access road east of Canyon Drive within Bonita Long Canyon, and Full Depth Reclamation (FDR) reconstruction of an existing sewer access road parallel to Acacia Avenue and south of Fallbrook Court. The proposed action would award the contract to Kirk Paving, Incorporated and authorize the Director of Public Works to expend all available contingency funds up to $22,597.50. ENVIRONMENTAL REVIEW The Development Services Director has reviewed the proposed project consisting of rehabilitation of two existing sewer access roads for compliance with the California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Class 1 Categorical Exemption pursuant to Section 15301 (Existing Facilities) of the State CEQA Guidelines because the proposed rehabilitation work involves negligible or no expansion of an existing access road. Thus, no further CEQA environmental review is required. RECOMMENDATION Council adopt the resolution. BOARDS/COMMISSION RECOMMENDATION Not applicable. 11-1 10/2!12, Item Page 2 of 3 DISCUSSION The Public Works Department has initiated a program to maintain the City's sewer access roads throughout the city. This program is designed to extend pavement life and serviceability of the access roads through reconstruction, rehabilitation (i.e., overlays and dig-outs), and preventive maintenance (i.e., the application of various types of surface treatments and/or limited dig-outs). The proposed contract would rehabilitate (i.e., dig-outs and overlay) an existing sewer access road within Bonita Long Canyon east of Canyon Drive, and reconstruct another access road parallel to Acacia Avenue and south of Fallbrook Court within the Bonita Ridge Estates. This work must be completed on or before January 15, 2013 to comply with the Migratory Bird Act. On September 12, 2012, the Director of Public Works received six (6) bids for the "Sewer Maintenance Access Road Rehabilitation (SW267)" project. The following bids were received: TOTAL BID CONTRACTOR SUBMITTAL RESULTS SUBMITTED 1 Kirk Paving, Inc. -Lakeside, CA All requirements met $142,402.50 2 SRM Contracting and Paving - All requirements met $157,682.00 San Diego, CA 3 TRI- Group Construction & All requirements met $159,670.00 Development -San Diego, CA 4 MJC Construction, Inc. -Bonita, CA All requirements met $171,340.00 Minor Mathematical Error 5 Kevin O'Neill -Chula Vista, CA (Corrected Bid Amount is $178,850.00 $178,775.00 6 Hazard Construction -San Diego, CA All requirements met $192,110.00 The low bid submitted by Kirk Paving, Inc. is below the Engineer's estimate of $193,473.83 by $51,071.33 (or approximately 26.4% below the Engineer's estimate). The Contractor has satisfactorily performed construction projects of similar scope for the City in the past and staff has deemed their work to be satisfactory. The Contractor's License No. 749206 is current and active. Staff thoroughly reviewed Kirk Paving, Inc.'s bid and determined the bid package is complete, with no errors or omissions. Therefore, staff recommends awarding a contract in the amount of $142,402.50 to Kirk Paving, Inc. The proposed resolution would authorize the Director of Public Works to approve change orders over and above existing policy limits. Under City Council Policy No. 574-01, if an individual change order causes the cumulative increase in change orders to exceed the Director's authority ("Maximum Aggregate Increase in Change Orders"), then City Council. approval is required. The corresponding maximum aggregate contract increase that may be approved by the Director of Public Works under Policy No. 574-01 is $10,000.00 plus 7% of the original contract over $100,000.00, or approximately $12,968.18 total without Council approval. Approval of the proposed resolution would increase the Director of Public Works' authority to approve change orders, as necessary, up to the maximum available contingency funding amount of $22,597.50. Disclosure Statement Attachment 1 is a copy of the Contractor's Disclosure Statement. Wage Statement The source of funding for this project is Sewer Facility Replacement Funds. Contractors bidding this project are not required to pay prevailing wages to persons employed by them for the work under this project. Disadvantaged businesses were encouraged to bid in the Notice to Contractors for various trade publications. DECISION MAKER CONFLICT Staff has reviewed the property holdings of the City Council and has found no property holdings within 500 feet of the boundaries of the properties which are the subject of this action. Staff is not independently aware, nor has staff been informed by any City Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter. CURRENT YEAR FISCAL IMPACT The following is a summary of anticipated project costs: FUNDS REQUIRED FOR CONSTRUCTION A. Contract Amount $142,402.50 B. Contingencies (Approx. 22%) $ 22,597.50 C. Construction Inspections Staff Costs/Material Testing $ 20,000.00 D. Design Support/Survey/Monument Preservation $ 10,000.00 CONSTRUCTION TOTAL $195,000.00 Sufficient Sewer Facility Replacement Funds are available in CIP Project Account No. SW267 to complete the work. ONGOING FISCAL IMPACT Upon completion of the project, the improvements will require only routine maintenance using the appropriate sewer funds. ATTACHMENTS I. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby accept bids and award a contract for the "Sewer Maintenance Access Road Rehabilitation (SW267)" project to Kirk Paving, Incorporated in the amount of $142,402.50, waive City Council Policy 574-01, and authorize the Director of Public Works to expend all available contingency funds up to $22,597.50 in the project. ~ ~ Presented by: as to Richard A.
